WALKERTON TOWN COUNCIL MINUTES The Walkerton Town Council met at 7 p.m., on Nov. 20, 1995, with the following members present: Cheryl Rizek, Gene Reese and Walter Heil. Attorney David Holmes and ClerkTreasurer, Judy Hiler, were also present. The minutes were approved as read. Bid opening for the 1988 Dodge police car was as follows: William Lappin 11, South Bend - $450.00; Arlie Keehn, Walkerton $526.00; Joe Snyder, Walkerton - $236.00 and Jeffrey Waters, South Bend - $502.00. Walt Heil made the motion to accept Arlie Keehn’s bid of $526.00, seconded by Reese, carried. Joe Snyder Salvage also submitted a bid of $65.00 for the 1978 Chevrolet pick up that had previously been advertised for sale. It was felt that this bid was too low, and Attorney Holmes advised that we can call around and get other bids since it had already been advertised. President Rizek announced that at our 1996 tax rate will be 3.4318, which is only a .0347 increase over our 1995 rate of 3.3971. Rizek said that although we have been able to keep the tax rate low, raises were given for 1996 and everything is running smoothly. Monthly Reports: Jeff Zehner reported on the sewer projects. He recommended that the 90 hook up period for the North Sewer Project begin in the spring, but that we allow those who want to hook up now, to do so.

Zehner further reported that he had checked with residents on St. Rd. 23 North and found that Hunsley’s, Isley’s and the Sale Barn do not want to be annexed. Attorney Holmes advised that if they decide, in the future, that they want to be on our sewer line, they should be required to be annexed. Zehner had done a street inventory for the Council to approve. This inventory will insure that all the town’s streets have been accepted, and we can gain some additional funds with the increased mileage. Resolution No. 1995-C, Accepting Certain Streets into the Municipal Street System for Maintenance, was accepted on a motion by Walt Heil, seconded by Reese, carried. We have some streets that had only been annexed to the middle of the road. Reese made the motion to annex both sides of Tyler Road, Harrison Street (pass the creek) and Virginia Street, seconded by Heil, carried. Attorney Holmes advised that as of the first of the year there has to be a drug and alcohol testing policy in place, for those who have CDL licenses. There needs to be a contract with a doctor to do the drug testing, and the Police Department can do the alcohol testing. This policy will be scheduled for approval at the next meeting. Citizen’s Input: Terry Roush told the Council that he is on the South Sewer Project, and had been told that his water bill would be cut in half since he was watering the replacement grass seed. After he was told this, the Council found that they could not cut the water bills, and Roush said that
he had not been notified of the change. His water and sewer bills were quite high and he asked for an adjustment to his bill. Attorney Holmes advised that it would be possible to give those residents on the new sewer line the sprinkler rate on their sewer bill. After some discussion it was decided to apply the rules for the sprinkler rate, for all the residents on the South sewer line, for the water useage for the months of September and October. Reese made the motion to allow, seconded by Heil, carried. Old Business: Workman’s Compensation rates were reviewed. Miller’s Insurance, Bremen, had gotten a quote of $21,129.00 from Monroe Guaranty. Ed Walz had gotten a quote of $19,391.00 from Indiana Public Employers’ Plan (IPEP). Attorney Holmes advised that the Council should know that these quotes are estimates and that the actual premiums are based on payroll records. Audits are done on the payroll, and adjustments are commonly made io premiums. Reese made the motion to accept the IPEP quote, seconded by Heil, carried. Reese made the motion to approve Resolution No. 1995-E, joining the IPEP Membership Program, seconded by Heil, carried. Attorney Holmes said that since there were changes to the Council in the recent election, he thought it would be appropriate to submit his resignation in order to allow incoming Council members to select their own legal advisor. In addition, Holmes is cutting back on his work load. He said that he would like to clear up some loose ends before year
end and would be willing to set up some additional meetings. President Rizek said that she thinks that Attorney Holmes has served the town very well for the last eight years. Reese added that he has personally been impressed with Holmes knowledge of the law and will feel uncomfortable with someone else who may not be as familiar with municipal law. Attorney Holmes said that NIPSCo has finally filed transmission rates, and there will have to be another meeting of the towns. Holmes said that he has contacted Triple M Investments in regard to Grover Johnson’s easement, and they won’t approve it without a survey. Zehner is to ask Wightman Petrie to do the survey. There is a suit pending on the damage done to Park Drive last year. The Clerk is to give Attorney Holmes an update on Steven Groves payments on his promissory note. Resolution No. 1995-D, Adopting a Plan for Application of Cedit Funds, was accepted on a motion by Reese, seconded by Heil, carried. In 1996 and 1997 the Cedit money will be used to pave alleys located in the business, commercial and industrial districts, which are currently gravel. In 1998 the Cedit money will be used to help pay for the construction of an addition to the fire station. New Business: Heil made the motion to do the first reading of Ordinance No. 1995-15, A Special Ordinance Relating to the Annexation of Certain Contiguous Real Estate to the Town of Walkerton, in short form, seconded by Reese, carried. Reese made the motion to accept the first reading of the ordinance, seconded by Heil, carried. Whiteman’s Landscaping, Plymouth, submitted a quote of $649.75 for maintenance of the downtown trees in 1996. This was a $46.00 increase over previous years. Reese made the motion to accept, seconded by Heil, carried. Zehner said that it is possible that the tree in front of the Starlite was damaged during the fire. Attorney Holmes advised that we should submit a claim now, if it was damaged in anyway. He added that we should not wait until next spring. The Chamber of Commerce had submitted a ballot for election to the Board of Directors for 1996. Those names listed on the ballot were Dr. Del Gardner, Larry Klinedinst and Richard Parker. The Council agreed to vote for these three people. Claims 1328 through 1364 for $190,016.78 and payroll

PINEAPPLE ORANGE WALNUT BREAD 1 cup broken walnuts 2 cups flour 1 teaspoon baking powder 1 teaspoon baking soda 1/4 teaspoon salt 3/4 cup plus 2 tablespoons sugar 1/4 cup butter 1 egg 1/4 cup plus 1 tablespoon orange juice 1 tablespoon grated orange peel 1 can (8-1/4 oz.) Dole Crushed Pineapple in Syrup 1 cup raisins Pulverize walnuts in blender. Combine with flour, baking powder, soda and salt. Cream 3/4 cup sugar with butter until light and fluffy. Beat in egg, 1/4 cup orange juice and peel until blended. Beat in 1/3 flour mixture until blended. Beat in 1/2 undrained pineapple until blended. Repeat, ending with flour. Stir in raisins. Pour into 9 x 5-inch loaf pan. Bake in 350°F oven 65 to 70 minutes until cake tester inserted comes out clean. Cool in pan 10 minutes. Turn onto wire rack to cool completely.
