Johnson said they would like to get on the new sewer line, and this was their first step. Rizek said this has been turned over to Attorney Holmes, and she thought that it had been taken care of. Johnson said that she hasn’t heard anything yet, and has some questions about the bid process. Rizek said that Attorney Walter will take these questions back to Holmes and hopefully get an answer for her soon. Old Business: At the last council meeting, it had been decided to give those residents on the south sewer project a fifty percent break on their water bills for two month, because they will be watering their new grass seed. In a letter, Holmes advised the council that the water rates are established by ordinance and must be fair and* equitable for all customers. Therefore, it is not possible to simply arbitrarily abate the payments of some customers. Holmes recommended that the sprinkler rate be used, but the sprinkler rate gives residents a break on their sewer rates and these residents don’t have sewer yet. Bolze told the council that he remembers that a number of years ago the State Board of Accounts said that you
can not give metered water away. There was some discussion of having the fire department water the grass from.their tanker truck, but this is still metered water and cannot be done. Attorney Walter said that although there are expenses to the residents on the south sewer project, being on the sewer line will substantially increase the value of their homes. Reese said that he would like to be able to give some type of relief to these residents. Rizek asked Walter to check with Attorney Holmes to see if anything can be done. Walter said that holmes advise was that an ordinance can be passed to gr e adjusted rates in cases like these, but it can not be retroactive. That would mean that the ordinance would not be passed, * and in force to do any good for these residents, but would give a break to residents involved with any future projects. When asked, Jeff Zehner said that nothing was done for residents in the past. . He feels that changing the rates might cause some future problems and set some precedents. We can’t unilaterally change that contract. When they issue bonds they have bond orders that go out with certain terms and conditions. You can’t change the terms and conditions after the bonds have been issued. The start date for the ninety day hook up has to stay at September 25th. The clerk is to put a notice in the paper about the water rates and the hook up period. The clerk asked attorney Walter to check with attorney Holmes to see if our credit plan is ready. We have budget hearing in November and this plan needs to be in place in order to spend the money budgeted for credit. Rizek said that we received a letter from Tom Frame detailing various restoration problems at his

mother’s house on Georgia Street. Rizek asked what the problem is with the construction company, are they doing the work sloppily? Bill Dutton said that he would bring this letter up to them, and would continue to keep nagging them on other problems as well. Dutton suggested that we get the restoration work done somehow, and deduct it from their retainage. Walter advised that it would be appropriate to hold back a proportional amount of the retainage for work not done satisfactorily, but we need to wait and see if they are going to finish the job. Jeff Zehner said that of the seven sidewalks that were installed, he has a problem with one of them. He asked if the council would like tp pay the contractor for the six satisfactory ones, and withhold payment on the one unsatisfactory one. Reese felt that we should not pay anything to the contractor until the job is complete. (To be continued next week)
