Myers Dr. Myers, one of the architects of the Social Security System in 1934, was Chief Actuary for the system for 23 years, 1947-70. He later became Deputy Commissioner, and in 1982-83 played a key role in averting the system’s financial failure. He is currently Chairman of the Board of Advisors of The Seniors Coalition. Dear Mr. Myers, I’d like to talk about the Spouse Pension Offset. How can the law consider my Social Security from my husband’s death a windfall when my government pension is only S3OO a month? How can our legislators possibly think I have a windfall with 12 years of Social Security and 19 years of civil service, with only 13 years on the pension fund? Do I really have to repay the overpayment they mistakenly gave me after the death of my husband? Why can’t it be waived? I think it discriminates against women for working instead of going on welfare. I had four children to rear on a GS-3 salary after age 46; therefore, you know I could not earn a decent pension. I earned my Social Security on $1.07 per hour. —Mrs. L.F. Oakland, CA Dear Ms. R., The theroy underlying the Spouse Government Pension Offset provision is that, if both spouses worked under Social Security, the widow’s benefit based on her own earnings is offset against the widow’s benefit coming from her husband’s earnings — i.e., only the larger of the two benefits is payable. Accordingly, to give equitable and consistent treatment when the husband worked under
Social Security, and the wife worked under a government plan not covered by Social Security, this offset provision was enacted. lam sorry, but I believe that you must repay the overpayment. Dear Dr. Myers, I receive Social Security retirement benefits. If I take a job that pays less than my pervious employment will my payments eventually be cut? —Mr. J.D. Helena, MT Dear Ms. D. Any work performed after the claiming Social Security benefits may result in the reduction (or even temporary elimination) of benefits while so working. However, the benefit amount over the long run will not be reduced by low earnings after first receiving benefits, as compared with previous earnings. Such “post-retirement” earnings can, under some circumstances, increase the eventual benefit amount — namely, if they were higher than those in any year used in the benefit computation.
