To date Judy Baker has made restitution in the amount of $1,870.00 to the St. Joseph County Probation Department, and this amount was sent to us. Attorney Holmes is going to write to Judge Schlifke to see how he feels this remittance should be handled. There was no Citizen’s Input. OLD BUSINESS: Jeff Zehner said that there are some questions that need to be resolved in regard to the guidelines for the 100 percent funding for sidewalks for senior citizens. Attorney Holmes suggested that we might want to use a point system to grade applicants. Points would be given when certain criteria is met. Those having the highest points would be given first consideration, as there is a limited amount budgeted for this program. Zehner reviewed some of the criteria with the Council, and Walt Heil volunteered to go over the applications with Zehner. President Rizek asked for the Council to approve the appointment of Gladys Prentis to the Board of Zoning Appeals. Gene Reese made the motion to approve. Seconded by Len Jaske. Carried. Hartsell was elected as the vicepresident. David Bolze has replaced Jollie Back on the Electric Advisory Board, since Back has retired. Kenny Bolze, assistant, has also been newly appointed to the Electric Advisory Board. Rizek will name another member to the Park Board since Leonard Northam has moved to North Liberty. Appointed to the Historical Society for 1995 are: Betty King, Charles Sherland and William Rhodes. Rizek said that we need an updated list of member of the Redevopment Commission since one or two of the members have moved out of town. Gordon Harsell told the Council that he now has some free time and can start working on the appreciation night for the ambulance and fire volunteers. Gary Anspaugh’s doctor has given him a permanent partial impairment rating for this back injury. The letter states that Anspaugh won’t be able to do the heavy lifting or bending and twisting that he has done in the past, because it will aggravate his back discomfort. Aetna Casuality has noltified Anspaugh that he is eligible for a settlement based on the doctor’s rating. Attorney Holmes said that based on the doctor’s evaluation, it appears that Anspaugh can no longer work for the Street Department. Holmes advised that Jeff Zehner, street commissioner, should talk to Anspaugh. There is a dispute with Roger Holston over trash pick up at his sixteen units off of Harrison Street. Holston feels that he can act as a business and hire his own trash hauler, where the town feels that these are residential units and fees for trash pick up should be paid to the Town. Attorney Holmes said that Holston is paying for dumpster rental but is not paying for the trash hauling. The trash hauling is being paid by the town. In order to pay Superior for trash pick up we have to collect from his tenants along with all the residents of Walkerton. Holmes suggested passing an ordinance modifying what we have, stating that where
there’s more than one unit and the town does not send bills for electric, water or sewer; the property owner will be directly responsible to pay the town for the trash pick up. Attorney Holmes is going to bring an amendment to our ordinance to the next meeting. The clerk is to write a letter to the residents of the Holston units, and an opinion letter from attorney Holmes is to be enclosed with the letter. Last year it was decided that on the first day of the month the clerk would mail the previous month’s vochers and bills to the township trustee. The trustee then has to send them on to the county for payment. It was hoped that by mailing the vouchers to the trustee on the first of the month it would help us get earlier payment on these bills, but this has not happened. It has been taking at least three weeks, from the mailing date, to receive payment. In the meantime, these bills are being assessed late charges which are being written off. In 1988 or 1989 the trustee asked the council to write off the late charges if the customer had applied to her for help before the fifteenth of the month, and the council voted to allow the write offs. The council now discussed changing their policy, and not write those late fees off. It was decided to write to the trustee, informing her that the council is considering changing their policy on late fees and ask her if the vouchers can be sent to the county in a more timely fashion. At the last meeting the clerk had gotten one quote for a new counter, and was asked to get at least one more. Contry quotes were as follows: Veba Construction $3,533.00; George Martis & Son $3,539.00; and Lowry Construction $2,435.00. Len Jaske made the motion to accept Lowry Construction’s quote of $2,435.00. Seconded by Gordon Hartsell. Carried. Terry Baugher explained to the council that the wastewater treatment plant operates under an NPDES permit, and we have to chlorinate to disinfect wastewater effluent. There is a new requirement that says after you disinfect, and have a chlorine residual from the disinfection, you have to introduce a chemical to remove that chlorine residual. Baugher said that the council needs to approve a construction permit, to be submitted to IDEM, for approval of dechlorination facilites. Len Jaske made the motion to allow Cheryl Rizek to sign the permit application. Seconded by Walt Heil. Carried. Potentially affected persons are supposed to be notified, so a notice will be put in the paper. A copy of the permit and drawings will be on file in the clerk’s office. Baugher said that he and Dave Bolze have gone over the proposed water main that may go down Washington Street. Baugher recommends running the water main down Washington Street from Roosevelt Road to Ohio Street, going down Ohio to Adams Street and then running the main down Adams to Virginia Street. One of the advantages of going down Adams Street is that the right of way is wider. would like to be ready to start this project in the spring. Urey Middle School will need their water tap by late summer or early fall. Gordon Hartsell made the motion to allow Baugher to start the engineering on this project. Seconded by Len Jaske. Carried. Some other water projects that Baughter has gone over with Dave Bolze are: checking to see if the water tower needs to be cleaned and repainted, cleaning of the wells and further work on locating water valves. New Business: There were three quotes for renovating the upstairs apartment, and they were: George Martis & Son, $6,309.91; Lowry Construction, $7,860.00 plus stairwell, $710.00; C. H. Vandall, $3,415.00 plus stairwell, $225.00. There was some discussion as to why the Vandall quote would be so much lower than the others, and after a review of the quotes it was decided to make sure that the quote includes installation of the carpet. Len Jaske made the motion to tentatively accept Vandall’s quote, < if it includes installing the carpet । and if the job can be completed within the sixty days. A $50.00 a day penalty is to be assessed for 1 each day over sixty days. Jeff < Zehner is to look at the carpet and vinyl samples to see if they meet 1 the specifications. Seconded by : Gordon Hartsell. Carried. Attorney Holmes presented his 1995 contract for legal services to the council. Monthly retainer will be $400.00 and $85.00 an hour will be charged for other services. Walt Heil made the motion to accept the contract. Seconded by Len Jaske. Carried. At the Board of Finance meeting held last November, the clerk was instructed to distribute the town’s funds proportionately to Teachers Credit Union and Ist Source Bank. The clerk reported that in January she invested an additional $500,000
