WALKERTON TOWN COUNCIL MINUTES December 5, 1994 The Walkerton Town Council met at 6:45 p.m. on December 5, 1994 with the following members present: Gene Reese, Gordon Hartsell. Cheryl Rizek, Walter Heil and Leonard Jaske. Attorney David Holmes and clerk-treasurer Judy Hiler were also present. The minutes of the last meeting were approved as read. Minutes of the Board of Finance Meeting were accepted on a motion by Gene Reese. Seconded by Walt Heil. Carried. MONTHLY REPORTS: David Behr's written report for the Walkerton Industrial Fund was reviewed by the Council. OLD BUSINESS: Our group health insurance rates are going up on January first, and Gene Reese is going to set up a meeting with our agent and Town employees to discuss different options. Our software company gave an approximate! quote of $3,220.00 for an enhancement to calculate power factor readings and compute the billing for low power factor readings. It was decided to not spend the money for the computer change since we might change systems in the spring. Gene Reese made the motion to have Dave Bolze hand compute the power factor readdings and for the clerk’s office to hand compute the bills. Seconded by Gordeon Hartsell. Carried. Attorney Holmes presented to the Council his Legal Services Agreement for the sewer extension project. This agreement is required by Fanners Home Administration, since they are giving us a grant for a portion of the project. Holmes advised that we will probably have to file condemnation proceedings on several properties that we have not been able to get easements on. Walt Heil made the motion to authorize Holmes to file suit against those property owners. Seconded by Gordon Hartsell.

Carried. Len Jaske made the motion to accept the Legal Services Agreement. Seconded by Gordon Hartsell. Carried. A Professional Consulting Agreement with J. S. Sawvel and Associates, for negotiating our new NIPSCO contract, was accepted on a motion by Len Jaske. Seconded by Walt Heil. Carried. NEW BUSINESS: Walt Heil said that he has received a couple of complaints about signs, at the intersection of Georgia Street and U.S. 6, being at eye level when you are sitting in a car. Chief Sobieralski has notified the sign owners of the danger. Gene Reese made the motion to do the first reading of Ordinance No. 1994-10, An Ordinance Eliminating the Walkerton Town Court, in short form. Seconded by Gordon Hartsell. Carried. Gene Reese made the motion to accept the first reading. Seconded by Gordon Hartsell. Carried. President Rizek said that this is just the first reading of the Ordinance, and a final decision as to whether or not to keep the court will be made at the next meeting. Claims 1255 through 1319 for $141,807.37 were accepted on a motion byt Len Jaske. Seconded by Gene Reese. Carried. James Seals told the Council that he has resigned as a police officer. Gene Reese made the motion to accept Seals resignation which became effective at the end of business on December 4, 1994. Seconded by Len Jaske. Carried. According to Town policy we pay an employee for a maximum of 30 days unused vacation time. Seals has approximately 52 unused vacation days and asked the Council if he can be paid for all of them. He said that he was told to use accumulated time rather than vacation days or sick days, when he wanted time off. Attorney Holmes said that it is not Town policy to not take vacation time or sick time, but it is our policy to limit the payment of unused vacation and sick days. Holmes added that the Council would be in trouble if they did not follow the policy that is set. In the past, employees who left the Town’s employ received only the maximums allowed in the policy. Seals said that he doesn’t feel that his request is unreasonable and asked the Council to reconsider paying him for the extra days. Attorney Holmes advised that Seals knew what the policy called for when he submitted his resignation. Seals said that he had resigned under protest. Four years ago Seals attempted to save a woman who died in a car fire. He told the Council that since that time he has been undergoing counseling and medical care, and is asking for

Attorney Holmes advised that the statute of limitations would have run out after two years. The Council decided to further discuss Seals requests in two weeks, in executive session, and a decision will be made at the first meeting in January. Chief Soberalski gave his monthly Police Report to the Council. Sobieralski asked permission to hire Jim Christie as a part time officer, and also to advertise for a new full time officer. Gene Reese made the motion to allow both requests. Seconded by Len Jaske. Carried. Mary Newland said that when they found out that they were being cited for a zoning violation, for having a lighted sign in their yard, they took it down. Newland stated that the people have trouble finding their business, unless they do have a large sign. She asked of the their property can be rezoned. It was recommended that she apply for a variance for the type of sign they need. Roman Brehm asked if anything

Brehm asked about the programming changes that were talked about at the last meeting. Rizek explained that since we may change systems in the spring, it was decided not to make any changes to present software. Rizek said that she would like to schedule an Electrical Advisory Board Meeting in January to discuss the commercial rate, and to set a 1995 budget. Gene Reese made the motion to adoum.
