NOTICE OF PUBLIC HEARING The Walkerton Town Council hereby gives notice to a Public Hearing at 7:30 p.m. on Tuesday. July 5. 1994 during the Town Council Meeting in the council meeting room of the Walkerton Town Hall, 510 Roosevelt Road, Walkerton, Indiana, on a resolution confirming the adoption of a Declaratory Resolution designating — See Exhibit "A" to be an Economic Revitalization area for the purposes of property tax abatement. Persons appearing at such public hearing shall have the right to be heard on the proposed project. All documents related to the proposed tax abatement are available for public inspection at the ClerkTreasurer's office at the Walkerton Town Hall. | PARK TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A FIVE YEAR PERSONAL PROPERTY TAX ABATEMENT AND A TEN YEAR REAL PROPERTY TAX ABATEMENT FOR: AMERICAN ROLLER COMPANY. WHEREAS, a petition for real property tax abatement has been filed with the Town Gerk for consideration by the Town Council of the Town of Walkerton, Indiana, requesting that the area commonly known as Walkerton Industrial Park, Walkerton, Indiana, and which is more particularly described as follows: A tract of land located in the West Half of the Southeast Quarter of Section 23, Township 35 North, Range i West, Second principal meridian, Lincoln Township, St. Joseph County, Indiana, described as follows: Commencing at the Northwest comer of the Southwest Quarter of said Section 23; thence South 00°02’0r’ East, along the West line of the Southeast Quarter of said Section 23, 1466.39 feet to the Point of Beginning of this description; thence North 89°53’50" East, 712.75 feet; thence South 00 o o6’lo’’ East, 398.47 feet to the Northerly right-of-way line of New York Central Railroad; thence South 28° 14’27” West along the said railroad right-of-way 493.10 feet; thence South 89°50’35” West, 479.70 feet to the West line of the Southeast Quarter of said Section 23; thence North 00°02’01” West, along the said West line 832.95 feet to the Point of Beginning. Subject to the rights of a public highway and any easements, covenants or restrictions of record. and which has Key Number 10-1056-1361, be designated as an Economic Revitalization Area under the provisions of Indiana Code 6-1.1-12.1-1 et seq.; and WHEREAS, the Walkerton Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Town Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1.1-12.1-1, et seq.; and has further prepared maps and plats showing the boundaries and such other information regarding the area in question as required by law; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Walkerton, Indiana, as follows: Section 1. The Town Council hereby determines and finds that the Petition for Real Property Tax Abatement and the Statement of Benefits from completed by the Petitioner meet the requirements of Indiana Code 6-1.1-12.1 et seq. Section 2. The Town Council hereby determines and finds the following: A. That the description of the proposed redevelopment or rehabilitation meets the applicable standards for such development; B. That the estimate of the value of the redevelopment or rehabilitation is reasonable for projects of this nature; C. That the estimate of the number of individuals who will be employed or whose employment will be retained by the Petitioner can reasonably be expected to result from the proposed described redevelopment or rehabilitation; D. That the estimate of the annual salaries of those individuals who will be employed or whose employment will be retained by the Petitioner can be reasonably expected to result from the proposed redevelopment or rehabilitation; E. That the other benefits about which information was requested are benefits that can be reasonably expected to result from the proposed described redevelopment or rehabilitation; and F. quested deduction, all of which satisfy the requirements of Indiana Code 6-1.1-12.1-3. Section 3. The Town Council hereby determines and finds that the proposed described redevelopment or rehabilitation can be reasonably expected to yield benefits identified in the Statement of Benefits set forth as Sections 1 through 2 of the Petition for Real Property Tax Abatement Consideration and that the statement of Benefits form prescribed by the State Board of Accounts are sufficient to justify the deduction granted under Indiana Code 6-1.1-12.1-3. Section 4. The Walkerton Town Council hereby accepts the report and recommendation of the Walkerton Redevelopment Commission that the area herein described be designated an Economic Revitalization Area and herebyh adopts a Resolution designating this area as an Economic Revitalization Area for purposes of real property tax abatement. Section 5. The designation as an Economic Revitalization Area shall be limited to two (2) calendar years from the date of the adoption of this Resolution by the Town Council. Section 6. The Town Council hereby determines that the property owner is qualified for and is granted real property tax deduction for a period of ten (10) years and personal property tax abatement for five (5) years. Section 7. The Town Council directs the Town Gerk to cause notice of the adoption of this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana Code 5-3-1 and Indiana Code 6.1.1-12.1-2.5, said publication providing notice of the public hearing before the Town Council on the proposed
