NOTICE OE ADOPTION OE ANNEXATION ORDINANCE Residents of the Town of Walkerton and Lincoln Township, St. Joseph County, Indiana, and in particular owners of real estate hereinafter described in Exhibit “A” are hereby notified that the Town Council of the Town of Walkerton, Indiana, has adopted Ordinance No. 1994-03, an Ordinance annexing certain real estate to the Town of Walkerton, Indiana, hereinafter described. Interested parties and owners of the land annexed may appeal the annexation by filing a wTitten remonstrance within sixty (60) days of the date of last publication with a court cf competent jurisdiction in St. Joseph County, Indiana, which written remonstrance shall be signed by the majority of owners of land in the annexed territory or the owners of more than 15^9 of assessed valuation of the land in the annexed territory. Said ordinance reads as follows: ORDINANCE NO. 1994-03 A SPECIAI ORDINANCE RELATING TO THE ANNEXATION OF CERTAIN CONTIGUOUS REAL ESTATE TO THE TOWN OF WALKER TON. ST. JOSEPH COUNTY, STATE OF INDIANA. WHEREAS, a petition has been signed by the Town Council regarding certain real estate lying contiguous to the existing corporate limits of the Town of Walkerton, St. Joseph County, Indiana, and has been filed with the Town Council of said Town, in accordance with applicable statutes of the State of Indiana, requesting the annexation to the said Town of said real estate (See EXHIBIT “B” attached) described in said petition by the passage of a Special Ordinance therefor; and WHEREAS, the Town Council has conducted a study of the costs and benefits of providing services to the subject property as EXHIBIT “A” (See Resolution 94-C); and WHEREAS, said Town Council deems said annexation to be desirable and finds that said petition is true and correct and should be granted; NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Town Council of the Town of Walkerton, St. Joseph County, State of Indiana: Section 1. That the real estate described and set forth in EXHIBIT “B” hereof which is attached hereto and made a part hereof, which said real estate lies contiguous to the existing corporate limits of the Town of Walkerton, St. Joseph County, Indiana, be and hereby is added to, taken in, annexed and made a part of the Town of Walkerton, Indiana. Section 2. That upon the taking effect of this Ordinance, the corporate limits and boundaries of the Town of Walkerton, St. Joseph County, Indiana, be extended to include the above described real estate hereby annexed and be redefined as shown on the attached map as per the Exhibit. Section 3. That the real estate referred to and described in EXHIBIT “A” hereof, is hereby assigned to and made a part of the Town of Walkerton, St. Joseph County, Indiana. Section 4. That this Ordinance shall take effect and be in full force and effect from and after its passage and publication and that this is a Special Ordinance passed in accordance with applicable statutes of the State of Indiana. Section 5. That pursuant to Indiana Code 36-4-3-8(2) the taxes imposed on the territory herein annexed shall be impounded in a special fund hereby established for a period of three years and used solely for the extension of municipal services to the annexed area. Section 6. That said annexation is in the best interests of the Town and the territory sought to be annexed and the terms and conditions thereof are fair and just and the Town is financially able to provide municipal services to the annexed area within the reasonably near future. And said area is needed for development of the Town in the reasonably near future. That said area is urban in character, being an economic and social part of said Town. RESOLUTION NO. 94-C A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN AND ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA. W'HEREAS, the Town of Walkerton desires to annex the area known as Rossborough Manufacturing, more specifically described in Ordinance No. 031994; and WHEREAS, responsible planning and state law require adoption of a written fiscal plan and a definite policy for the provision of services to annexed areas; and WHEREAS, such a plan has been developed and presented to the Town Council, entitled “Fiscal Plan, Annexation of Rossborouth Manufacturing”; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Walkerton, Indiana, that: I. The Town Council of the Town of Walkerton, St. Joseph County, Indiana, hereby approves and adopts the Fiscal Plan, Annexation of Rossborough Manufacturing, which Plan is attached hereto and made a part hereof, and hereby approves and adopts the specific policies for implementation of the Plan as set out therein; 2. Any monies necessary for the provision of services as described and itemized in the attached plan shall be budgeted and appropriated from the applicable fund, pursuant to State Law and the Town’s budget procedure; 3. It is anticipated that this annexation will not result in the elimination of jobs for employees of other governmental entitles but nothing herein shall require the Town to hire any employees. Hiler, Clerk-Treasurer EXHIBIT “A” FISCAL PLAN: PROPOSED ROSSBOROUGH ANNEXATION. I. AREA FOR CONSIDERATION An area generally described as abutting the Walkerton Town Limits on the East, and is more particularly described on EXHIBIT “A”, attached, and shown on the Map, EXHIBIT "B”, also attached. This area is irregular in shape and has about one-half ('/z) of its perimeter contiguous to the Town of Walkerton. It consists of varied agricultural and industrial uses and is zoned consistent with its use. 11. COST ESTIMATES OF PLANNED SERVICES AND METHODS OF FINANCING SAID SERVICES. Estimates Income Estimated Expense 1994 — None 1994 — Minor expenses payable 1995 — None out of existing budget 1996 — Property tax 1995 — Same as 1994 (See tax statements attached) 1996 — Same as 1994 111. ADMINISTRATION AND EXTENSION OF SERVICES. Electric Department Expenses: The area in question is currently in the Town’s service area. General Administration: The Town of Walkerton employes a superintendent of utilities, attorney, comprehensive engineering firm, along with a grant administrator. The Town is active in the pursuit of state and federal grants (with success) which Offers its residents a greater return on the dollar. The administrative staff, as presently composed, has the ability to meet any challenge presented by the proposed annexation. Police Protection: The Walkerton Police Department is in radio range of all of the proposed area and response time normally is faster than county officers who must cover a much larger area and are located 20 miles away. Fire Department: Walkerton has a volunteer fire department consisting of 29 men. Present equipment in number and type is sufficient to handle any contingencies that may arise in the annexed area. In addition, the Town currently provides fire protection to this area under contract to the Township. Water System: The annexed area will be serviced by the Walkerton Municipal Water Works, a study of extension of service to the area is attached. Sanitary Sewers: Sanitary sewer service to the annexed area is also the subject of a study attached. Roads and Streets: All roads in the area are state or federal highways maintained by the State. The annexation would have no effect on the roads, nor require any expenditures by the Town. Storm Sewers: No new construction is contemplated. Refuse Collection: Routine refuse collection is available to residential properties, however, there are currently no residences in the area. The present practice of one time pickup per week will be maintained in the annexed area. The annexed area can participate in the special pickup for large items and deliver cut brush to the Town collection center as scheduled by the Street Superintendent. Snow Removal: Routine snow removal and salting of streets will be performed as required. Park and Recreation: The area will be incorporated into the Town's park and recreation Master Plan within one (1) year. Inspection and Code Enforcement: Current practices, as applicable to the present area, will be applied to the newly annexed area. Planning and Zoning: Comprehensive planning studies for the newly annexed area, in coordination with the existing present Town zoning and planning, are currently under way. Electric Department: The annexed area is in the Town's service area, thus there would be no change in current practices.
