ORDINANCE NO. 1994-02 AN ORDINANCE AMENDING THE ELECTRIC RATE ORDINANCE TO INCLUDE DIRECT READOUT OF THE POWER FACTOR OF ALL CUSTOMERS OF THE MUNICIPAL ELECTRIC UTILITY OF THE TOWN OF WALKERTON, ST. JOSEPH COUNTY, INDIANA. WHEREAS, the Town of Walkerton, by it* Town Council, previously enacted an Ordinance establishing electric rates for the customers of the Walkerton Municipal Electric Utility; and WHEREAS, the Walkerton Electric Utility, after conducting a study updating its Electric Ordinance and Rates, has recommended amending the previous ordinance to include Direct Power Readout of all customers of the utility; and WHEREAS, the Town Council of the Town of Walkerton finds it to be in the best interests of the Town of Walkerton to amend the Electric Ordinance and Rates.. NOW, THEREFORE, BE IT OR DAINED AND ENACTED by the Town Council of the Town of Walkerton, St. Joseph County, State of Indiana: Section 1. That Ordinance No. 87, Rate “P”, is hereby amended by deleting the original Subsection Power Factor and substituting the following: Power Factor The Customer agrees to maintain unity power factor as nearly as practicable. The Municipal Electric Utility reserves the right to measure such power factor at any time. Should such measurements indicate that the madmom lagging power factor for the billing period is less than 95% the demand for billing purposes shall be the demand as indicated or recorded by the demand meter multiplied by 95% and divided by the measured average power factor in decimal. Section 2. That in all other respects the Ordinance shall remain in full force and effect. Section 3. This this Ordinance shall be in full force and effect from and after its passage and publication as required by law. Clerk-Treasurer NOTICE OF PUBUC HEARING The Walketon Town Council hereby gives notice to a public hearing at 7:30 p.m. on Monday, March 21, 1994 during the Town Council meeting in the council meeting room of the Walkerton Town Hall, 510 Roosevelt Road, Walkerton, Indiana, on a resolution confirming the adoption of a Declaratory Resolution designating See Exhibit "A” to be an Economic Revitalization area for the purposes of property tax abatement. Persons appearing at such public hearing shall have the right to be heard on the proposed project. TOWN OF WALKERTON, INDINA, COMMONLY KNOWN AS: WALKERTON INDUSTRIAL PARK TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF A FIVE YEAR PERSONAL PROPERTY TAX ABATEMENT AND A TEN YEAR REAL PROPERTY TAX ABATEMENT FOR: PREMDOR CORPORATION. WHEREAS, a petition for real property tax abatement has been filed with the Town Clerk for consideration at the Town Council of the Town of Walkerton, Indiana, requesting that the area commonly known as 111 Muskin Rd., Walkerton, Indiana, and which is more particularly described as follows: See EXHIBIT “A” attached, and which has Key Number, be designated as an Economic Revitalization Area under the provisions of Indiana Code 6-1.1-12.1-1 et seq.; and WHEREAS, the Walkerton Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Town Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1.1-12.1-1, et seq.; and has further prepared maps and plats showing the boundaries and such other information regarding the area in question as required by law; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Walkerton, Indiana, as follows: Section 1. The Town Council hereby determines and finds that the Petition for Real Property Tax Abatement and the Statement of Benefits from completed by the Petitioner meet the requirements of Indiana Code 6-1.1-12.1 et seq. Section 2. The Town Counci hereby determines and finds the following: A. That the description of the proposed redevelopment or rehabilitation meets the applicable standards for such development; B. That the estimate of the value of the redevelopment or rehabilitation is reasonable for projects of this nature; C. That the estimate of the number of individuals who will be employed or whose employment will be retained by the Petitioner can reasonable be expected to result from the proposed described redevelopment or rehabilitation;. D. That the estimate of the anual salaries of those individuals who will be employed or whose employment will be retained by the Petitioner can be reasonably expected to result from the proposed redevelopment or rehabilitation; E. That the other benefits about which information was requested are benefits that can reasonably expected to result from the proposed described redevelopment or rehabilitation; and F. That the totality of benefits is sufficient to justify the requested deduction, all of which satisfy the requirements of Indiana Code 6-1.1-12.1-3. E. The Town Council hereby determines and finds that the proposed described redevelopment or rehabilitation can be reasonably expected to yield benefits identified in the Statement of Benefits set forth as Sections 1 through 2 of the Petition for Real Property Tax Abatement Consideration and that the statement of Benefits form prescribed by the State Board of Accounts are sufficient to justify the deduction granted under Indi-

ana Code 6-1.1-12.1-3. Section 4. The Walkerton Town Council hereby accepts the report and recommendation of the Walkerton Redevelopment Commission that the area herein described be designated an Economic Revitalization Area and hereby adopts a Resolution designating this area as an Economic Revitalization Area for purposes of real property tax abatement. Section 5. The designation as an Economic Revitalization Area shall be limited to two (2) calendar years from the date of the adoption of this Resolution by the Town Council. Section 6. The Town Council hereby determines that the property owner is qualified for and is granted real property tax deduction for a period of ten (10) years and personal property tax abatement for five (5) years. Section 7. The Town Council directs the Town Gerk to cause notice of the adoption of this Declaratory Resolution for Real Property Tax Abatement to be published pursuant to Indiana Code 5-3-1 and Indiana Code 6-1.1*12.1-2.5, said publication providing notice of the public hearing before the Town Council on the proposed confirming of said declaration. Section 8. This Resolution shall be in full force and effect from and after its adoption by the Walkerton Town Council. All of which is adopted this 7th day of March, 1994.
