WALKERTON TOWN BOARD NEWS (continued from Page 1) asked about enforcement of this ordinance. Holmes said that almost all ordinances are enforced on a complaint made basis. He added. that although the Police Department and the Humane Society will be out on routine patrol, they will be looking for dogs running at large. Walt Heil asked about the fees that will be charged for registering dogs and cats. The registration fee for a neutered dog or cat is $2.00. A dangerous dog permit is $50.00. Heil asked about the cost of the tatoo which is required for dangerous dogs. A representative of the Humane Society replied that the cost ranges from SIB.OO to $35.00. All the licensing and paperwork will be done by the Humane Society. It will be possible for people to pick up registration forms in Walkerton and mail them in to the Humane Society, and therefore won't have to drive in to Mishawaka. The public hearing for this ordinance will be held on September 8, 1992. Attorney Holmes recommended that the Council adopt ground rules for the public hearing. Holmes suggested that there be a sign up sheet for people who wish to speak, each person will be given a number and allowed to speak when that number comes up and each person will be given two minutes to address the issue. Holmes also advised that two members from the Humane Society, the Police Department or members from a recognized citizens group be allowed to divide up 10 minutes to give their viewpoint on the matter. Each group, Humane Society, Police Department and citizen’s group, will be given the 10 minutes to divide between two people or one person could use the whole 10 minutes. President Rizek announced that if anyone has a question when an ordinance is read in short form, they can step forward and get a copy or stop in the clerk’s office to obtain one. The public hearing for the 1993 budget was held, and Ordinance No. 1992-08 was read. Len Jaske made the motion to accept the first reading. Seconded by Gordon Hartsell. Carried. This ordinance will be adopted at a special meeting on August 24,1992. There was no citizen’s input.

OLD BUSINESS: The clerk announced that Bau Construction has said that they have completed all the residential sidewalks Superintendent Back is to inspect the sidewalks and make sure that they meet our specifications. A meeting to work on redistricting will be scheduled soon. The Council will get together with attorney Holmes sometime in September to review the Town Code. The meeting to review the Fire Contract with the Lincoln Township Trustee, scheduled for tonight, was cancelled and will have to be rescheduled. Attorney Holmes told the Council that he may not be able to make it to our September Bth meeting, because of a conflict. This meeting is on Tuesday since Labor Day is on Monday the 7th. If Holmes is unable to attend the September Bth meeting, the public hearing for the Animal Control Ordinance will be postponed until September 21, 1992. Holmes is to let the clerk know if he can attend the September Bth meeting. Holmes advised the Council that they need to adopt a policy about Plan Commission meetings. He said that the petitioner is not supposed to call a meeting. He added that we should have at least two weeks notice of a petition even if it doesn’t require publication in the newspaper. This allows time for copies of the proposal to be reviewed by the Town superintendent, so that he can see if he can serve it with electric, water and sewer and also see if the streets are the way we want them. The building commissioner also needs to review the proposal and plans. Len Jaske added that the Plan Commission also needs a chance to review everything before a meeting. After some discussion, Len Jaske made the motion to set the third Monday of each month as the day that the Plan Commission can meet. All petitions to the Plan Commission must be in the clerk’s office a minimum of two weeks before the third Monday of the month. Seconded by Gordon Hartsell. Carried. Ordinance No. 1992-07, An Ordinance Allowing Disbursement of Funds for Lawful Town Purposes in Advance of Council Allowance Pursuant to IC 36-5-4-12, was read in short form on a motion by Len Jaske. Seconded by Gene Reese. Carried. Gene Reese made the motion to accept the second reading. Seconded by Gordon Hartsell. Carried. Len Jaske made
the motion to accept the third reading. Seconded by Gene Reese. Carried. Jeff Zehner talked to the Council about the sewer problem in the 800 block of Ohio Street. Earlier, a suggestion was made to connect the West York main sewer line to the Washington Street line. Zehner told the Council that he would not recommend doing this because the Glenn-L Subdivision now flows to the Washington Street main, and it would overload the line during storm flows. Zehner said that they have used the drag lines to clean the two block section that had the problem. He feels that this will help prevent major backups, in West York, in the future. Zehner pointed out that during one of this summer's storms we had over an inch of rain in 30 minutes, and this was also a contributing factor to the backup. According to Zehner, the overall solution would be to eliminate the storm water. One way of doing this would be divert some of the storm water flow into a dry well type system. Zehner will bring figures to the next meeting on the cost of this [ project. He feels that cleaning the : lines should have corrected the [ backup problem in the 800 block of Ohio Street. Zehner had gotten three quotes for a shoring shield box, and they were: Allied Hydraulic, $4,166.40; Efficiency Hydrashield, $4,575.00; and Speed Shore, $4,885.00. Len Jaske made a motion to accept Allied Hyddraulic's quote of $1,466.40. Seconded by Gene Reese. Carried. The cost of this equipment will be shared by the Water and Wastewater Departments. All seven industries, in the West Industrial Park, have hooked up to the sewer system. Gassensmith and Back's recommendation to the Council is that a three-way stop be put in at the intersection of Jackson and Ohio Streets. Len Jaske made the motion to put in the three-way stop, with a temporary warning sign to be put up to alert drivers of this change. Seconded by Gordon Hartsell. Carried. The clerk told the Council that the new radio antenna, on the roof of the Town Hall, is being paid for out of the Cumulative Capital Improvement Fund. Rized asked about insurance coverage on the antenna. The clerk said that she had contacted the insurance agent and was told it was not covered because it was not listed on the Inland Marine policy. Inland Marine covers any equipment that leaves the building, and must be listed with the insurance company. Gassensmith said that he couldn't understand how it could be considered as something that leaves the building when it is a stationary item that is attached to the building. After further discussion, it was decided that Gassensmith will check with the insurance company to make sure that they know it is attached to the building. Walt Heil asked of the street department should remove the dirt from Shawn McCrum’s sidewalk on Roosevelt Road. Holmes advised that anything obstructing the public right-of-way can be removed. It was decided that the I street department will clean off this sidewalk. Attorney Holmes presented an ordinance, to the Council, to amend the rates and barges for the use of jiujifLAGooNi ;! Holmes said that he didn’t think it would be good policy to make our ordinance different than the State’s but will amend ours if that’s the Council’s wish. tomey Holmes advised that the clerk can write-off past due accounts, and they can still be collected if they are not over five years old. Holmes added that his office will file suit, in small claims court, for any substantial past due amounts. A substantial amount would be $300.00 to $400.00 or more, and his office would keep one third of whatever is collected. The collection agency keeps one half of anything they collect. Claims 836 through 893 for $165,363.53 and Payroll Docket dated 8-5-92 for $19,037.79 were approved on a motion by Len Jaske. Seconded by Gene Reese. Carried. Gene Reese made the motion to adjourn.
