WALKERTON TOWN BOARD MINUTES The Walkerton lown Council met at 7:00 p.m. on December 17, with the following members present: Cheryl Rizek, Maggie Gaddis, Gregory Williams, Walter Heil and Leonard Jaske. Attorney David Holmes and Clerk-Treasurer Judy Hiler were also present. The minutes were approved as read. At a plan commission meeting held just previous to this, the plan commission members approved the plat for the dedication of the Industrial Park Northeast. Len Jaske made the motion to accept the dedication of the Industrial Park Northeast. Seconded by Walt Heil. Carried. David Behr, Walkerton Industrial Fund, is going to have the dedicated plat recorded. CITIZEN’S INPUT: David Behr said that several citizens have approached him in regard to a hit and run accident that occurred on Walkerton Trail and Willow Drive. Those concerned about the traffic in that area, would like for the Council to look into installing stop signs at Willow Drive. Superintendent Back and Police Chief Gassensmith are to inspect the intersection, and report back to the Council. Amy Wardman submitted the names of Vivian Williams, Richard Gine and Leigh Roy hahn for reappointment to the Historical Society for 1991. Wardman showed the council a little of the work she's been doing for the Historical Society. She told how she categorizes and cross references items, and also how they are kept in acid free paper and boxes for better preservation.
SALARY ORDINANCE NO. 1990-13 An ordinance to establish compensation for officers and employees of the Town of Walkerton, Indiana for services performed during calendar year, 1991. WHEREAS, it is deemed necessary to establish salaries for the employees and officers of the Civil Town of Walkerton, Indiana. NOW THEREFORE, BE IT ORDAINED by the Town Council of the Town of Walkerton, Indiana, that there is hereby established the compensation from the several funds to be paid Civil Town Officers and employees for services performed during the calendar year 1991. A resident complained about her neighbor's dogs, which bark constantly. She said that she has reported the dogs to the police department a number of times, and it has not done any good. Although the patrolmen have been out to the neighbor's house, nothing has been done about the problem. The resident said that if the Town Council couldn’t help her tonight, she is going to see the Prosecuting Attorney. Attorney Holmes said that seeing the Prosecuting Attorney might be the thing to do. He added that the council cannot site anyone, but they can talk to the police chief about the problem. Holmes also advised that she should call the police every time the dogs start to bark. Williams said that we should have a copy of the ordinance concerning barking dogs, at the next meeting for review by the attorney and the council. AMBULANCE: Defibrillation equipment, supply costs, heart monitor and defibrillation were discussed. PTL airways cost approximately $27.00, combi-tube airways are $35.00 and electro-pads are $28.00. The following patient charges were decided upon: PTL airwav. $30.00: combi-tube airways are $35.00 and pads, $30.00; flat charge for use of heart monitor, $5.00; and flat charge for use of the defibrillator, SIO.OO. It is hoped that these charges will help to defray the cost of new batteries fbr the defibrillators. Len Jaske made the motion to accept these charges. Seconded by Maggie Gaddis. Carried. Judy Baker proposed that the Town Court be reduced to part time, twenty hours a week, and submitted to reduced budget for 1991. The probosed budget is as follows: judge salary, $4,000; bailiff and clerk salary, $500; supplies, $700; seminars, $100; telephone, $750; gasoline/mileage, $200; and
bond premiums, SIOO. Total budget for a part time court is $6,350. Attorney Holmes advised that the Council could go ahead and pass the ordinance eliminating the Town Court at the end of 1991, and also make it part time fbr 1991. If the Council wishes to continue the court after 1991, they can pass another ordinance to re-establish it. Judge Baker submitted her resignation, from the Town Court, as of December 31. 1990. The Council accepted Baker's resignation and although she as accepted another position, she is willing to help her replacement get started. Williams said that a replacement for Baker would be appointed by the Council, and the Gerk is to advertise for applicants fbr the position. Len Jaske made the motion to approve the third ordinance No. 1990-12, An Ordinance Eliminating the Walkerton Town Court. Seconded by Cheryl Rizek. The ordinance passed with a vote of three ayes and two nays. Ordteaace Ne. 1990-12 AN ORDINANCE ELIMINATING THE WALKERTON TOWN COURT WHEREAS, the Town of Walkerton, by Ordinance No. 1982-10, approved December 2C, 1982, established a Town Court; and WHEREAS, The State of Indiana has established Traffic and Misdemeanor Courts of record for St. Joseph County since the establishment of the Walkerton Town Court; and WHEREAS, the Walkerton Town Court is infrequently used by law enforcement agencies other than the Municipal Police Department; and WHEREAS, the cost of maintaining the Court far exceeds the revenues produced by the court; and WHEREAS, the Town Council is determined that since the establishment of the Town Court there are reasonable alternatives avail-

NOW, THEREFORE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WALKERTON. INDIANA: I. That the Walkerton Town Court is hereby eliminated effective December 31. 1991, by repealing Ordinance No. 1982-10 (codified as Section 24 of the Walkerton Town Code). Sectieu 2. That there shall be no further municipal elections or nominations for the office of Town Judge and that the office shall be eliminated with the conclusion of the current term at the end of business on December 31,1991. Section 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 4. That notice of the elimination of the Walkerton Town Court shall be given to the Division of State Court Administration of the Office of Judicial administration. Sectiea 5. This ordinance shall be in force and effect from and after its passage, approval, recording and publication as provided by law. Judith R. Hiler, Gerk-Treas. The third reading of Ordinance No. 1990-11 was done, and the Council discussed the nonprecurring charges. Bad check charges are going from SIO.OO to SIB.OO, and water deposits are going from $50.00 to $50.00 for home owners and SIOO.OO for renters. These rates bring the water non-recurring charges in line with those of the electric rates. Walt Heil made the motion to accept Ordinance No. 1990-11. Seconded by Cheryl Rizek. Carried. ORDINANCE NO. 1990-11 AN ORDINANCE AMENDING RATES AND CHARGES FOR THE USE OF AND SERVICES RENDERED BY THE MUNICIPAL WATER UTILITY OF THE TOWN OF WALKERTON. INDIANA. WHEREAS, a review of the rate schedules of the Municipal Water Utility reveals that the Water Utility has not been property charging fbr the service; and WHEREAS, it will be necessary to increase residential, commercial, and industrial rates in order to recover the income lost to the utility and to more property bill the actual costs of service; and WHEREAS, the Town of Walkerton is no longer subject to the regulatory authority of the Indiana Utility Regulatory Commission; NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNGL OF THE TOWN OF WALKERTON. INDIANA: Sectiou 1. That the rate schedules of the Walkerton Municipal Water Utility are hereby amended to conform with the schedule attached hereto, made a part hereof, and marked Exhibit "A”.
