LEGAL NOTICE Notice is herby given to the taxpayers of the Town of North Liberty, St. Joseph County, Indiana, that resolution number 1990-3, a resolution to designate certain real estate (specifically, lot number 2 of the North Liberty Industrial Park) to be within an “Economic Revitalization Area” pursuant to I.C. 6-1.1-12.1, et seg., thereby making the area eligible for abatement of personal and real property taxes in accordance with Indiana law, has been passed and adopted by the Town Council on the 7th day of November, 1990. Pursuant to I.C. 6-1.1-12.1(c), on December Sth, 1990, at 7:00 p.m., at the North Liberty Town Hall, 118 North Main Street, North Liberty, Indiana, the North Liberty Town Council will receive and hear all remonstrances and objections from interested persons. Resolution 1990-3, along with a Statement of Benefits and Exhibit “B” (a description of the area involved), may be examined at the North Liberty Gerk/Treasurer’s office and/or the St. Joseph County Assessor's office. 2tn22 ORDINANCE NO. 1990-09 AN ORDINANCE TO AMEND TITLE 3 OF THE NORTH LIBERTY TOWN CODE by adding a new Article 6 regulating the use of skateboards, scooters, roller skates, bicvcles and motorcycles in the Town of North Liberty. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF NORTH LIBERTY. INDIANA, THAT: Section 1. Title 3 of the North Liberty Town Code is hereby amended by adding a new Article 6 reading as follows: Article 6: Use of Skateboards, Scooters, Roller Skates, Bicycles and Motorcycles. CHAPTER 1 DEFINITIONS Section 1. For purposes of chapters 2, 3 and 4 of Article 6. the following definitions shall apply: “Skateboard”: A board consisting of man-made or natural material which is mounted upon a wheel or wheels. “Scooter”! Any wheeled vehicle which is propelled by its operator by resting a portion of his or her body weight upon the vehicle while pushing against the ground with another portion of the operator’s body. “Roller Skate”: A shoe, boot or mechanism designed to attach to a shoe, boot or a person’s foot, which is mounted upon one or more wheels. “Bicycle”! Any vehicle coming within the common definition of the term, having one or more wheels, including, but not limited to, unicycles or tricycles. “Motorcycle”! A two-wheeled (or, if equipped with a sidecar, three-wheeled) vehicle propelled by an intrnal-combustion engine and resembling a bicycle, but usually larger and heavier, and often having two saddles. “Central Boaineaa District ”i The Central Business District (CBD) shall be defined as the main business district in the Town of North Liberty and more specifically described as follows: The 100 block of North Main Street between Harrison Street and Center Street and the north side of the 100 blocks of West and East Center Street between Main Street and Jefferson Street and Main Street and Lafayette Street, all as delineated on the official zoning map of the Town of North Liberty. “Residential District”: Residential District (RD) shall be defined as any residential district in the Town of North Liberty as delineated on the official zoning map of the Town of North Liberty, including any R-8 Low Density Residential District, R-12 Medium Density Residential District, and
ROP Residential-Office-Profes-sional Districts. CHAPTER 2 CENTRAL BUSINESS DISTRICT Section 1. No person shall operate or ride a skateboard, scooter or roller skate or skates on any street or sidewalk located within the Central Business District. Section 2. The use of bicycles shall be permitted on any street or sidewalk within the Central Business District. Section 3. Persons who operate or ride a bicycle on any street or sidewalk where permitted must at all times exercise due care for the safety of other persons using the street or sidewalk. Section 4. Persons who operate or ride a bicycle on any street or sidewalk where permitted must at all times yield the right of way to pedestrians and give pedestrians audible warnings before overtaking and passing them. Section 5. Persons crossing a street on a bicycle shall come to a complete stop and give the right of way to all vehicular traffic before crossing said street. Section 6. Any person who violates any provision of this chapter shall be subject to a fine of $25. Further, when any person shall commit a second or subsequent violation of any provision of this chapter, the skateboard, scooter, roller skate or skates being used by such violator shall be impounded by the North Liberty Police Department and returned to the violator upon payment of the said $25 fine. If said violator is under eighteen (18) years of age, the impounded item shall be returned only to the person of the parent or legal guardian of the violator, upon payment of said fine. CHAPTER 3 RESIDENTIAL DISTRICTS Section 1. No person shall operate or ride a skateboard, scooter, roller skate or skates on any street located in a residential area. CHAPTER 4 MOTOTCYCLES Section 1. It shall be unlawful to operate a motorcycle anywhere except on a public street or alley or on a disignated driveway or parking place located on private property. Section 2. No motorcycle shall be operated on a railroad right of way or private property, unless the express wirtten consent has been obtained from the owner of the real estate. Section 3. Persons operating motorcycles shall not operate them more than two abreast on any
street or alley in the town. Section 4. Any person who violates any provision of this chapter shall be subject to a fine of $25, or removal and detention of the license plate from such person’s motorcycle for a period of thirty (30) days or by any combination thereof. Section 2. Serverablllty. If any section or part of this Ordinance or Code be for any reason held unconstitutional or invalid by a court of competent jurisdiction, that holding shall not affect the validity of the remaining portion of the Ordinance or Code, but the remaining portion shall be and remain in full force and effect. Section 3. Effective Date. This Ordinance shall be in full force and effect from and after its adoption by the Town Council, its publication as herein above provided, and filing in the office of the Gerk/ Treasurer as hereinabove provided. Pine St., North Liberty, passed away at 11:45 p.m., on Thursday, Nov. 8. at Michiana Community Hospital, South Bend, after an illness. He was born on Nov. 13, 1918, in Anderson and lived in North Liberty for six years coming from Anderson. Oct. 26, 1985, he married Ruth L. Lewis, in North Liberty, who survives. He retired in 1985 from K-Mart, Anderson, as a clerk. Also surviving are a daughter, Karen Stevens, of Mobile, Alabama; two sons, Larry with the Army station in Germany and Gary, of South Carolina; 14 grandchildren; three great-grandchildren and a sister, Greta, of Florida. Services were held at 2:00 p.m., on Monday, in the A.M. Manuel Funeral Home, North Liberty, with Rev. Timothy Stewart, officiating. Burial was in Westlawn Cemetery, North Liberty. He was a veteran of World War II and a member of the American Legion Post 365, North Liberty. DAISY E. LIGHTFOOT Daisy E. Lightfoot. 84, of Interlachen, Florida, formerly of Lakeville, passed awav on Sunday, Nov. 4, at H.C.A. Putman County Hospital, Florida. She was bom on Dec. 24, 1905, of Lakeville and moved to Interlachen from Lakeville in 1985. Daisy Milliken married Clem Lightfoot on July 14. 1923, in North Liberty, who preceded her in death in 1985. Surviving are a daughter, Delores Roy, of Interlachen, Fla.; a son, Kenneth E., of Gainesville, Georgia; four grandchildren; two step-grandchildren; six greatgrandchildren; two step greatgrandchildren; two sisters, Marie Pletcher, of Elkhart and Mildred Nelson, of Mishawaka; and two brothers, Lester Milliken, of South Bend and William Milliken, of Mishawaka. Memorial services and burial were held at 10:00 a.m., on Saturday at the Lakeville Cemetery. The Palmer Funeral Home was in charge of the arrangements. Maple St., North Liberty, passed away at 10.20 a.m., on Friday, Nov. 9, in Memorial Hospital, South Bend. She was bom on May 15, 1912, in LaPorte. She lived in the area most of her life. On Feb. 28, 1932, she married George Heim, in LaPorte, who survives. Also surviving are a daughter, Mary Spier, of South Bend; five sons, Gerald, of South Bend, Alfred, Kris, Robert and James, all of North Liberty; 19 grandchildren; 12 great-grandchildren; a great-great-grandchild and a sister, Helen Bunton, of New Carlisle. Two sons, Bill and Richard, preceded her in death. Services were held at 10:00 on Monday at St. Patrick’s Catholic Church, with Rev. Robert Yast, officiating. Burial was in Westlawn Cemetery, North Liberty. The Rannells Funeral Home, Koontz Lake Chapel, was in charge of the arrangements. ROGER L. SIX Roger L. Six, 71, of Ind. 4, Fish Lake, passed away at 7:25 a.m., on Sunday, Nov. 11, in the LaPorte Hospital. He was boro on July 19, 1919, in North Liberty and lived in Fish Lake for 41 years going there from North Liberty. He married Zola K. Houser, on June 11, 1949, in North Liberty, who survives. He retired from Local 20 of the Sheet Metal Workers union. South Bend. Also surviving are two daughters, Sue Dittmar, of North Liberty and Deborah Miller, of Mishawaka; a son, Timothy A., of Great Falls, Montana; six grandchildren; five sisters, Hazel Reed, of Walkerton, Eva Kloth, of Holland, Mich., and Juanita Malkowski, Florence Holderbaum and Rhoene Shoemaker, all of North Liberty and three brothers, John, of North Liberty, Charles, of Walkerton and Russell, of Baldwin, Mich. Services were held at 11:00 a.m., on Wednesday, at the NusbaumElkin Funeral Home, Walkerton, with Rev. Tim Davis officiating. Burial was in Westlawn Cemetery, North Liberty. He was a veteran of World War 11 and a member of the North Liberty VFW Post 1954, Wilbur Bud Crane American Legion, Post 400, Fish Lake and Sheet etal Workers Local 20.
