NOTICE OF PUBLIC HEARING Notice is hereby given to all interested persons that a public hearing will be held at the Town Hall. 510 Roosevelt Road. Walkerton. Indiana on the 2nd day of January. 1990. at 7:00 0.m.. or as soon thereafter as the matter can be heard. This hearing is for the purpose of considering the following ordinance. ORDINANCE NO. 1989-12 AN ORDINANCE AMENDING RATES AND CHARGES FOR THE USE OF AND SERVICES RENDERED BY THE MUNICIPAL ELECTRIC UTILITY OF THE TOWN OF WALKERTON. INDIANA. WHEREAS, a review of the rate schedules of the Municipal Electric Utility reveals that the Municipal Electric Utility has not been properly charging for the large commercial service; and W'HEREAS. it will be necessary to increase residential, small commercial. large commercial and power service rates in order to recover the income lost to the utility and to more properly bill the actual costs of service; and WHEREAS, the Town of Walkerton is no longer subject to the regulatory authority of the Indiana Utility Regulators- Commission; NOW. THEREFORE. BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF WALK ERTON. INDIANA: Section 1. That the rate schedules of the Walkerton Municipal Electric Utility for the residential service — Rate "R”; small commercial service — Rate "Cs”; large commercial service — Rate "G”; and the power service — Rate “P”. are hereby amended to conform with the schedule attached hereto, made a part hereof, and marked "Exhibit "A". Section 2. All ordinances and parts of ordinances in conflict herewith arc hereby repealed. Section 3. This ordinance shall be in force and effect from and after its passage, approval, recording and publication as provided by law. Passed and adopted by the Town Council of the Town of Walkerton. ORDINANE NO. 1989-13 AN ORDINANCE OF THE TOWN OF WALKERTON AMENDING ORDINANCE NO. 1985-11 ESTABLISHING NON-RE-CURRING CHARGES FOR THE WALKERTON MUNICIPAL ELECTRIC UTILITY. WHEREAS, the Town of Walkerton previously adopted an Ordinance establishing Non-Recurr-ing Charges for the Walkerton Municipal Electric Utility, which charges need to be updated for several years; and WHEREAS, the Town Council believes it to be in the best interests of the Town of Walkerton adopt the schedule of charges as sei forth hereinbelow; and WHEREAS, the Walkerton Municipal Electric Utility is no longer subject to regulation by the Indiana Utility Regulators Commission. NOW. THEREFORE. BE IT OR DAINED by the Town Council of the Town of Walkerton. Indiana as follows: Section 1. That Section 34.4.1. of the Walkerton Town Code be and hereby is amended as follows: 34.4.1 That all the following non-recurring charges shall be assessed to all users of the Walkerton municipal electric utility effect ion February 1. 1990. A. Dishonored check — SIB.OU. B. Disconnect and reconnect charges: (I) $30.00 each during business hours (2) $50.00 each all other times. C. Meter test — actual cost of billing to Town by outside contractor. D. Deposit — connection fee: (1) Owner $50.00. (2) Renter SIOO.OO. (After one year of prompt payment deposit to be applied to monthly bill without any accrued interest. E. Sen ice call $30.00 per hour; Emergency service call — utility property damage. (1) Regular hours — $30.00 per hour per man. $50.00 per hour per truck. (2) After working hours — $45.00 per hour per man. $50.00 per hour per truck. F. Customer service call — $30.00 per hour. G. Penalty for late payment — 10% of first $3.00 plus 3% of all amounts in excess of $3.00. H. Meter reading charge — SIO.OO if meter was originally read correctly. I. Meter tampering charge — $50.00 plus cost of meter repair, replacement or testing and any other charges for material required to return installation to serviceable condition. Labor at $25.00 per man hour shall be a part of the charge. J. Minimum payment still due and payable, whenever service has been temporarily disconnected for the benefit of the customer. Section 2.
