WHEREAS, a review of the rate schedules of the Municipal Electic Utility reveals that the Municipal Electric Utility has not been properly charging for the large commercial service; and WHEREAS, it will be necessary to increase the large commercial service rate in order to recover the income lost to the utility and to more properly bill the actual costs of service; and WHEREAS, the Town of Walkerton is no longer subject to the regulatory authority of the Indiana Utility Regulatory Commission; NOW. Character of Service Alternating current, sixty hertz, three phase at voltages of approximately 480. 240 and 208 volts or single phase service at a voltage of approximately 120/ 240 volts. The utility will supply service from its electrical supply lines at only such frequency. phase, regulation and primary voltage as it has available in the location where service is required, and. if transformation of voltage is desired by the customer, will transform its primary voltage to one standard secondary voltage as herein above set forth. The reasons for such decision not to prepare such statement are as follows: Early coordination letters and an Environmental Assessment determined that the proposed project will not have any adverse effect on the community and that it will, in fact, benefit the community. An Environmental Review Record respecting the proposed project has been made by the Town of North Liberty which documents the environmental reivew of the project and more fully sets forth the reasons why such Statement is not required. This Environmental Review Record is on file at the above address and is available for public examiniation and copying upon request between the hours of 8:00 a.m. and 4:30 p.m. No further environmental review of such project is proposed to be conducted prior to the request for release of funds. PUBLIC COMMENTS ON FINDINGS All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the Town of North Liberty to the Town Hall. Such written comments should be received at the Town Hal! on or before March 17. 1989. All such comments so received will be considered, and the Town of North Liberty will not request the release of Federal funds or take any administrative action on the proposed project prior to the date specified in the preceding sentence. RELEASE OF FUNDS The Town of North Liberty will undertake the project described above with Community Development Block Grant funds from the State of Idniana under Title I of the Housing and Community Development Act of 1974. The Town of North Liberty is certifying to the State that Scott King, in his official capacity as Town Board President, consents to accept the jurisdictiou of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews. decision-making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Town of North Liberty may use the Block Grant funds and the State will have satisfied its responsibilities under the National Environmental Policy Act of 1969. OBJECTIONS TO STATE RELEASE OF FUNDS The State will accept an objection to its approval only if it is on one of the following bases: (a) that the certification was not. in fact, executed by the certifying officer or other officer of Applicant approved by the State; or (b) that Applicant’s Environmental Review Record for the project indicated omission of a required decision, finding, or step applicable to the project in the environmental review process. Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to the State of idniana, Indiana Commerce Center.
