WHWERAS. an application has been made to change the zoning classification on a certain tract of land within the Walkerton zoning area from residential “R-3” to light commercial “C-4”; and WHEREAS, the Walkerton Plan Commission has met and unanimously recommended by all members of the Commission present that a portion of the parcel subject of the petition for rezoning be in fact, rezoned; NOW THEREFORE. The Town Court shall send a Judgement letter notifying the violator of nonpayment of the possible suspension of their driving privileges by the Bureau of Motor Vehicles and filing of misdemeanor charges pursuant to IC 34-4-32 g. 40.92 Payment Os Fines Any person receiving a Uniform Traffic Citation for a traffic violation pursuant to the provisions of this chapter shall, prior to the court date on the citation, appear at the Town Court, 510 Roosevelt Rd., Walkerton, Indiana 46574 and pay the imposed penalty by depositing such amount along with the Uniform Traffic Citation. The Town Court shall send a Judgement letter to those who do not comply with the above. This Judgement letter will indicate payment and notification of the possible suspension of driving priviledges by the Bureau of Motor Vehicles and the filing of Misdemeanor charges pursuant to IC 34-4-32 g. In addition to the penalties provided for herein, the Town Marshal or Deputy Marshal may cause any vehicle parked in violation of any provision of Indiana traffic statutes or Walkerton ordinances to be removed to a private garage or place where the same shall be impounded and retained. Such vehicle shall be released only upon the order of the Town Marshal or a Deputy Marshal after payment of the fine required by this chapter to be paid in compromise of such violation and all costs of towing and storage. 40.93 Non-exclnslve Jurisdiction The Town Marshal or Deputy Marshal may file any motor vehicle violation committee within the Town of Walkerton in any other court of competent jurisdiction in lieu of using the provisions of this Ordinance. 40.94 Repealer All ordinances or parts of ordinances in conflict herewith are hereby repealed. 40.95. Effective Date This Ordinance shall be in full force and effect after its passage and publication. Margaret Gaddis motioned to pass this ordinance on first reading. Ward seconded, all agreed. The False Alarm Ordinance was motioned by Ward to read by short title only on the 2nd and 3rd reading. Gaddis seconded and all agreed. 2nd reading: AN ORDINANCE REGULATING FEES FOR ALARM SYSTEMS AND SETTING ASSESSMENTS FOR FALSE ALARMS.
Gaddis motioned, Ward seconded — passed. 3 Reading: AN ORDINANCE REGULATING FEES FOR ALARM SYSTEMS AND SETTING ASSESSMENTS FOR FALSE ALARMS. Gaddis motioned, Ward seconded — passed. To be in effect September 1, 1986. Marvin Williams asked for a street sweeper at a cost of $3,500. Ward motioned to accept, Gaddis seconded — all agreed. A request for a salt spreader at $5,840 was accepted on a motion by Gaddis, seconded by Ward. Ward made a motion to send David and Kenneth Bolze to Water Treatment School at a cost of $160.00 each. Gaddis seconded the motion and all agreed. Leonard Northam, Park Board President, informed the Town Board that they have two proposals on residing the Community Building. Novicki Construction for $3,979.35 and Martis Construction $3,687.00. Mr. Northam asked if the Town might be able to defray some of the cost. Gaddis made a motion to spend $1,000.00 out of Cumulative Capital Improvement Funds to help with the costs involved. Ward seconded the motion and all approved. Mr. Northam also asked for some gravel to be replaced in front of the Youth Building and asked if the ground displays for the 4th of July fireworks could be stored in the Wastewater Treatment Barn. The Salary Ordinance for 1987 was passed on a motion by Ward, seconded by Gaddis. (Appears elsewhere in this issue) The 1987 budget will be advertised in the South Bend Tribune and the Walkerton IndependentNews on July 30th and August 6th. The pre-adoption hearing will be August 13th and the adoption will be August 25. 1986. A claim for H.R.P. for $15,989.00 was approved conditioned upon settlement with the necessary release documents all signed before the warrant is sent. Ward made the motion and Gaddis seconded the motion. CITIZEN INPUT: June Baker asked about the funds for the street sweeper and salt spreader. The monies are available in the Motor Vehicle Highway Fund. Monies that are in excess of the 1986 budgert therefore must be reappropriated for 1986. An ordinance regarding the utilities pulling out of Indiana Public Service Commission was read on the first reading and passed on a motion by Ward, seconded by Gaddis. ORDINANCE NUMBER AN ORDINANCE TO SUBMIT QUESTION TO VOTERS OF WALKERTON AS TO REMOVAL OF WALKERTON MUNICIPAL UTILITIES FROM THE JURIS DICTION OF THE INDIANA PUBLIC SERVICE COMMISSION. WHEREAS, the Town Board of Trustees of the Town of Walkerton, Indiana, has been presented with a petition signed by more than five percent (5%) of the registered voters of the Town of Walkerton requesting that the Walkerton municipal water and electric utilities be removed from the jurisdiction of the Indiana Public Service Commission for rate-making purposes; and WHEREAS, said petition is made pursuant to the provisions of I.C. Section 8-1.5-3-9, BE IT ORDAINED BY THE TOWN BOARD OF TRUSTEES OF THE TOWN BOARD OF WALK ERTON, INDIANA: Section 1. That the following question shall be submitted to the registered voters of the Town of Walkerton, Indiana, at the next election: “Shall the Walkerton municipally owned electric and water utilities be taken out of the jurisdiction of the Indiana Public Service Commission for approval of (continued on Page 9)
