ORDINANCE #B6-002 AN ORDINANCE REGULATING FEES FOR ALARM SYSTEMS AND SETTING ASSESSMENTS FOR FALSE ALARMS WHEREAS, the former policy established by the Town of Walkerton for fees relating to the alarm systems pertaining to police and fire alarms has been ineffective; and WHEREAS, the Board is desirous of forming a new policy for the regulation of fees for alarm systems and for assessing businesses whose alarm systems cause false alarms; and WHEREAS, the Town of Walkerton has an inordinate number of false alarms in which both the police and fire departments are required to respond and which are very costly for the Town; NOW. nect to the Walkerton Police and Fire Departments alarm systems will contract with the Town per the terms set forth in the Alarm Installer’s Contract which is attached hereto and made a part hereof as EXHIBIT “A”. All businesses in the Town of Walkerton and the surrounding area will be assessed an annual fee of Twenty-five Dollars ($25.00) for alarm systems that are directly connected to the Walkerton Police and Fire Departments as set out in said Contract. 2. The annual fee collected herein will be used to defray the costs of administering and responding to the various connected systems. Included in this administration, is the unnecessary expenses of two (2) false alarm runs that are allowed per business per year. 3. A false alarm is any alarm received by either the Walkerton Police or Fire Department in which either department initiates a response but later learns that said response was unnecessary and unrequired due to human error or malfunctioning equipment of a particular business. Said false alarm to be assessed to said business
shall not be caused by any fault of either Department or the systems owned by the Department or of an act of God. 4. In the event of the third false alarm and for each subsequent false alarm, a charge of Twenty Dollars ($20.00) for in-town false alarms and Thirdy Dollars ($30.00) for out-of-town false alarms will be assessed to that business responsible for said false alarm, whether it be a Police or Fire false alarm. 5. Revenues collected as a result of the false alarms will be deposited into the General Fund for the Town of Walkerton, but that said Fund shall be considered for future appropriation to training programs and equipment for the benefit of the Police and Fire Departments depending upon which department responded to the false alarm. 6. No businesses will be permitted to hook up or connect directly with the Town Police or Fire Department’s alarm systems without first executing a contract in the form previously described. WHWERAS, an application has been made to change the zoning classification on a certain tract of land within the Walkerton zoning area from residential “R-3” to light commercial “C-4”; and WHEREAS, the Walkerton Plan Commission has met and unanimously recommended by all members of the Commission present that a portion of the parcel subject of the petition for rezoning be in fact, rezoned; NOW THEREFORE, BE IT ORDAINED, by the Town Board of Trustees for the Town of Walkerton, Indiana, that: 1.
