That all lots and property contiguous to the portion of the unnamed street and public alley to be vacated are lands owned by the petitioners herein; B. That the vacation of the portion of Georgia Street sought to be vacated will not hinder the growth or orderly development of the unit or neighborhood in which it is located or which it is contiguous; C. That the vacation of that part of Georgia Street sought to be vacated would not make access to the lands of any aggrieved person by means of public way difficult or inconvenient; D. That the vacation of that part of Georgia Street sought to be vacated will not hinder the public’s access to a church, school or other public building or place. E. That the vacation of that portion of Georgia Street sought to be vacated will not hinder the use of the public way by the neighborhood in which it is located or to which it is contiguous. F. That the dedicated right of way for Georgia Street, as it runs along lots 1 through 12 of Vinedge's Addition and Lot 1 of Clark’s Addition overlaps approximately 30 feet onto said lots and that for whatever reason the overlap. said right of way line should correspond with the occupied right of way line. 2. That on the basis of said findings of fact as hereinabove presented, and based upon the fact that the surveyor, namely, Robert D. Palm, registered land surveyor #50307, discovered that the dedicated right of way for Georgia Street overlapped the lots owned by the property owners on the East side of Georgia Street and that in order to resolve the overlapping and disparity of various lot lines and to further offset any future problems concerning differences of opinions by surveyors in the future, the parties agree that said property shall be vacated as per the description hereinabove set forth so as to extend the property lines for the lots on Vinedge’s Addition to the curb line and that said above described portion of the Gerogia Street right of way as for that section that overlaps onto the lots of Vinedge’s Addition is now hereby vacated to the above land owners subject to the retention by the Town of Walkerton, Indiana of any utility easements over and through said vacated portion of right of way.
