NOTICE OF ANNEXATION The following is a complete text of the Resolution of Annexation adopted by the Board of School T rustees of Polk I mcoln-Johnson School Corporation on January 20. 1981 BE IT RESOLVED. THAI Polk I incoln Johnson School C orpora Hon of St. Joseph ('ouniv. State of Indiana (hereinafter called "acquiring School Corporation"), does hereby annex from South Bend C ommunity Sch<x»| C orporation of St Joseph C ounty. State of Indiana (hereinafter referred to as "Losing School Corporation"), the territory hereinafter described upon and subject to the following terms and conditions. I After the effective date of an novation, the name of the Acquiring School Corporation shall con tinue to be Polk I incoln-Johnson School ( orporation. 2. Ihe territory hereby annexed is the territory contained within the boundaries of I ibertv Tow nship of St. Joseph County. Indiana as that township exists on the date of the adoption of this resolution. 3. The time the annexation takes place shall be the date upon which the latter of Losing School Corporation’s or Acquiring School Corporation s school board adopts this resolution. 4. Io facilitate the education of the pupils residing in the annexed territory, the Acquiring School Corporation shall educate pupils residing within liberty Township for the entire 1981-1982 school year and the Losing School Corporation shall pay to the Acquiring School Corporation the sum of >402.686 from its general fund tax receipts and shall transport those pupils to Acquiring School Corporation’s schools from August 25. 1981 through December 18. 1981 without charge Ihe Acquiring School ('orporation shall include pupils residing in liberty I ownship in its official reports submitted during the school year to the Indiana Department of Public Instruction for per capita state support for liberty Township pupils during the calendar year 1982 and the Losing School Corporation will cooperate with the Acquiring School Corporation to assist it to obtain approval of a new maximum normal general fund ad valorem property tax lew for real property taxes to include Liberty low nship in the lew of 1982 taxes and to include in its budget for that year the cost of providing education to pupils in Liberty Township. 5. Disposition of assets and liabilities of the Losing School Corporation in the annexed area shall be as follows: Delivery of all real and personal property to be transferred from the Losing School Corporation to the Acquiring School Corporation shall take place on June 8. 1981. with utility charges and other operating costs for such property being assumed as of that date by the Acquiring School Corporation. Student activity fund balances shall be prorated accord ing to the resident of students contributing to them as of June 8. 1981 Title to all real property and personal property with the excep lion of several items listed on I xhibit D to the Agreement between Acquiring and Losing Cor porations and used in the schools in liberty low nship regularly shall be transferred to Acquiring School Corporation on June 8. 1981 Acquiring School Corporation shall assume and pay a proportionate share of principal, accrued interest and interest currently becoming due on bonded indebtedness of the losing School Corpora tion and all bonded indebtedness allocated for purchase of one parcel of real property located in Liberty I ownship which is transferred to Acquiring School Corporation and a proportionate part of outstanding lease rental payments due and un paid as of January I. 1982 Payments shall be required on a semiannual basis on said indebtedness on June 15. and December 15 of each year beginning in 1982 until
