Three Bill Package Filed By Rep. Mangus A three bill package intended to remedy eminent domain problems defined by a legislative study committee has been filed bv State Representative Richard Mangus (R Lakeville) in the 1977 Indiana General Assembly. Mangus said his legislation represents an attempt to incorporate public interest safeguards in Indiana condemnation law. The veteran legislator has been involved in a study of eminent domain over a four-year period which uncovered numerous abuses of the power and weaknesses in the law. Over 70 agencies or entities in the state have the power to force landowners to sell their property for "the common good." In summary, the Mangus legislation would: — Require a condemner notify a landowner of his rights by providing the landowners with a written description of the land needed, the dollar amount offered for the property, and a summary of legal options available to the landowner. The bill requires notice be given at least 30 days prior to the filing of a condemnation suit. Instances of landowner harrassment by condemning agents would hopefully be minimized, said the District 10 legislator. — Require that all new pipelines over 70 pounds pressure be located on state or county rights-of-way,

Monies which are now paid property ow ners to acquire new rights-of-way could be diverted to the state highway or county highway account, and provide a new revenue source for highway maintenance. Mangus pointed out the concept has environmental advantages. and would promote efficiency in the courts by eliminating many time-consuming condemnation suits. — Make the condemning authority liable for "future damages" in court cases where a blanket easement is taken, and in certain other situations. Mangus cited the hypothetical instance of a power failure requiring a utility to make repairs, and in the process limiting a farmer s crop yield. Under present law, the landowner has no legal recourse. — Require the Board of Directors of a condemning authority to pass a resolution of eminent domain for every land acquisition requiring court settlement. Currently. a landowner cannot fix legal responsibility on a corporation, agen cy or utility. The Mangus proposal would enable a landowner to bring suit against each member of the Board of Directors. — Require prior approval of certain eminent domain projects by the Public Service Commission. Presently, condemning authorities do not have to prove a project is necessary to serve the public or that it has any relationship to future economic development. — Require condemning agent pay court costs if refusal of an outof court offer by the landowner pushes the case to court ami the
eventual ruling is in the landowner’s favor. FINAL DAY TO BE BUSY ONE AT FARM SCIENCE DAYS The final day of Farm Science Days 1977 — Saturday. January 15 — could well become the busiest. Five agricultural related groups will meet on Purdue Universitv's campus that day. These groups will include the horse and pony devotees, rabbit breeders, Christmas tree growers and Indiana Rural Youth, plus a newcomer to Farm Science Davs — the Indiana Beekeepers Association. Actually, the Christmas tree growers will kickoff their program Friday, Januarv 14. with a board meeting in the afternoon and their annual banquet that evening. Orion Samuelson, director of agricultural services. WGN, Chicago, will speak at the banquet. At the general session, commencing at 9:00 a.m. Saturday, in Stewart Center Room 214, growers will hear these discussed: tree prices and capital gains; the 1976 Tax Reform Act; what’s new from OSHA; Christmas tree insects and diseases. What’s new on tree seedlings, shaking and cleaning trees, starting in the Christmas tree game and "things could happen" will be afternoon topics. A business meeting is also planned. A separate session for the ladies has been ar ranged from 1:00 p.m. to 3:30 pm. Selection of the proper horse for the job, selection of the hunter jumper and event horse, and selection of the trail horse will be morn :ng presentations at the Horse and Pons program in Stewart (enter’s Loeb Plavhouse. Registration will begin at 8:00 am., with the program starting at 9:00 am.
