Federal Wage Garnishmenr Lw Some time ago I wrote about the Indiana Wage Garnishment Law with respect to the collection of debts by creditors through wage garnishment. I pointed out at that time that considerable investigation was going on of the various having harsh garnishment laws. 1 also pointed out that Indiana’s law is not a; harsh as other states inasmuch as only ten percent of a debtor’s wage is subject to garnishment after the statutory exemption of $15.00 is allowed. Now the Congress of the United States has passed a now federal law which affects wage garnishment in all states. On July 1. 1970 this new law will become effective which greatly limits the light to garnishee a debtor's wage. This law will be enforced by the Wage ano Hour Division of the Department of Labor and it is binding on all state courts and employers everywhere in the United States. The new federal law basically

provides that only twenty-five percent of the disposable earnings of a person subject to garnishment can be reached by creditors. In addition, an exemption of SIB.OO is granted and after this exemption is applied against the disposable wage of the employee only twenty-five percent above that amount can De subject to garnishment. Disposable income is defined in the Act as that amount of money which is left after things which must be withheld from wages are taken out as requited by law. This refers, of course, to Federal income tax, Social Security Tax and any state tax or other deduction required to be withheld by law. This means that if a person has SBO.OO take-home pay and is granted his exemption of SIB.OO, then $32.00 would be subject to wage garnishment. However, since the garnishment is limited to one-fourth of the disposable income, which would be one-fourth of SBO.OO, only S2O in this case could be reached by garnishment. The interesting erf ct this will have on Indiana law !r that persons with income of $48.00 or less will no longer be subject to garnishment proceedings in Indiana courts. For those who make more than $lB 00 per week disposable income, the Indiana law will still apply because it has a esser imnact on the debtor than the federal statutory standard. While most commentators feel this is a step forward in debtorcreditor proceedings, it is *ruly unfortunate that one of the most harsh area of garnshment proceedings was not affected by the Act. .That is. collections for federal taxes were not covered by the Act. leaving the federal government in a position to take the entire wage for tax claims Possibly on reflection. Congress will have opportunity to relent on this particular provision of the Act and determine whether or not this garnishment proceeding should be ameliorated. Summer time moans fun in the sun and of course the water. But if you're not safety conscious, it can be a time of tragedy. Drowning is the fourth leading cause of accidental death.
