ORDINANCE NO. 1-1968 An Ordinance regulating the use of house trailers and mobile homes within the town limits of the town of North Liberty providing for penalties t and injunctive relief for violation thereof. BE IT ORDAINED by the town of North Liberty as follows: 1. From and after the passage of this Ordinance it shall be unlawful for any-perann to park, place or use a mobile home or house trailer in the corporate limits of the town of North Liberty, St. Joseph Cotinty. Indiana, with the intention of residing therein or allowing others to reside therein unless said trailer is placed on a lot which will qualify as a mobile home park as hereafter defined and described. It shall also be unlawful to reside in a mobile home or house trailer located within the corporate limits after the passage of this Ordinance which is not hx’ated pursuant to the provisions hereof. This section shall not apply to trailers located prior to adoption hereof. 2. A mobile home park shall be a tract of land containing except those which are used exclusively for servicing said mobile home park and ekpect for the mobile homes and house trailers heated themn provided that all house trailers and mobile homes thereon shall br located on a b t area of not less than three thousand quare fe. t and provided that each mobile home and house trailer located threcon shall be serviced with public water and public sewage disp >sal facilities of private sewage disposal facilities meeting the standards and specifications required by the Indiana State Board of Health and provided further that no mobile home or house trailer shall be moved upon said mobile home park until such time as water ami sewage facilities as required are available, and unless it is connected to such facilities. 3. The town Board of Trustees of the town of North Liberty may grant temporary permits not to exceed six months for the temporary location of house trailers or mobile homes within the town of North Liberty where the location thereof is connected with and incidental to bonslruction activities going on within the town and provided further that such temporary use will not be detrimental to the public health and safety of the community. 4. Any person presently nwning or using a mobile home or house trailer within the town of North Liberty shall within sixty days from the effective date of this Ordinance connect said

mobile homo with the public water system, the public sewage system or to sewage facilities meeting the standards an I .specifications of the State Board of Health. Any person who fails to so connect his mobile home or house trailer shall, thirty days after receiving notice served by the town marshall of his failure tn comply unless he complies with this provision within such time, cease and desist from using said mobile home or house trailer. Failure to comply with this section after thirty days notice will constitute a violation of this Ordinance. 5. Violation of this Ordinance shall be construed to constitute a public nuisance and the provisions hereof may be enforced by injunction. 6. Each day a violation shall be in a constitute shall be in constitute a separate offense. 7. The town marshall after thirty days notice may remove any mobile home or house trailer used in violation of this Ordinance from the premises on which it is 1 rated and store same at owners expense. 8. Where a person violating this Ordinance is not a resident of the town notice may be served up< n him by registered mail, return receipt requested and where he can be located, notice may be served by posting same on the door of tlie mobile home or house t raller. 9. Person shall include partnership. coiporati< ms. business firms and the officers and managers thereof who fails to comply herewith. 10. Violation of this ordinance shall be punishable by a fine of not less than ten (SIO.OOI dollars. 11. If any provision of this ordinance is illegal or unconstitutional it shall not affect the validity of the remaining provisions hereof. 12. This Ordinance shall be in full force and effect upon posting and publication in accordance with law. Passed and adopted by the town Board of Trustees of the town of North Liberty.
