ORDINANCE NO. 3 - 1967 AN ORDINANCE to declare Khat ! hall constitute a nuisance to prevent, abate and remove the same, and to provide for penalties for the maintenance thereof. BE IT ORDAINED by the Board of Trustees of the Town of North Liberty. Indiana: Section 1. It shall be unlawful for any person to er. ,t. construct, cause, permit, keep or maintain within the limits of this Town, anything wnaisoev < i which by occasioning noxious exhalations or noisome <a offensive smells or which i iom any reason becomes injurious to the health, comfort or property of the dents of that vicinity or the public*, or to cause or suffer any offal, filth or noisome substance to be collected or to remain in any place, to the damage, pi ejudiee or discomfort of others or the public. Any person maintaining, causing or permitting any of the above - named conditions shall be deemed the author and maintainer of a nuisance. Section 2. Any person who maintains a nuisance in violation of this ordinance shall within five (5) days after written notice thereof from the Town Board of Trustees of the Town of North Liberty, Indiana, served upon them personally or posted in a prominent place on the property on which the nuisance is mainr tained, cause said nuisance to be abated. Section 3. Any person who after notice of violation of this ordinance continues to maintain the nuisance shall be subject to suit for injunction in this County in accordance with law. Section 4. Any person who violates this ordinance shall be subject to a fine of not less than One Dollar ($l,OOl or more than Ten Dollars ($10.00) upon conviction thereof, provided that each day of violation shall be deemed to constitute a separate offense.
