"The church gave me my wives and I do not think the ch'.rch could be consistent in taking them a -a y." said Mr. Smith in answer to a question as to why he did not agree to the Woodruff manifesto. Continuing the Senator said it appeared that polygamous cohabitation is forbidden by both the law of the land and the law of the church, as laid down in the Woodruff manifesto, and. addressing the witness, he asked: "Then, as head of the church, you sre violating the laws of the land, and the ordinances of your church as well." "Not the ordinances," said Mr. Smith. "Well, the law. then." "No. The rule," said the witness. "The rule, after all. is the law of conduct," said Senator Bailey. "I was only trying to emphasise what the revelations are. I don't know as much about nice distinguishments in religion as I hope to about the law, but it appears that both the rule of the church and the law of the land forbade polygamous conduct and you. as the head of the church, violated both." "I will not quarrel with the senator about that," the witness replied. Later ho raid that Senator Bailey's a3sumption was correct. In reply to Senator Overmsn Mr. Smith aid the revelation of the manifesto of 1S90 had not beeW published in the latent edition of doctrine and covenants, but that this was an oversight and would be corrected. Replying to Chairman Burrows. Mr. Smith aid that in does not teach polygamy, and added: "I am not openly and obnoxiously practicing unlawful polygamy." "How could you better teach polygamy than by practicing it?" Mr. Burrows continued. The reply was: "I am not practicing polygamy. I am practicing polygamous conduct, which is not polygamy. Polygamy is plural marriage and I have tket no plural wives since the manifesto of 1S90." Replying to a question from Senator Overman Mr. Smith said the pamphlet containing the manifesto did not state in terms that it was a revelation from God, but that the statement was made that it was published by authority of the church, whic'i was sufficient. It then appeared that the manifesto had not been put in as evidence and Mr. Tayler then introduced it with other documents. March 5.-Circulars of the Zion's Co-operative Mercantile Institution. of Utah, bearing on the Smoot case, and sent out from Salt Lake City, have been received in Chicago. The full text of the circulars follows: "From .ion's Co-operative Mercantile Institution. Salt Ltke City, Utah: "Gentlemen Once more the country la being disturbed by an anti-Mormon agitation, the purpose In view being the expulsion from the United States Senate of Heed Smoot. a senator from Utah, who was duly sleeted and seated, notwithstanding the disturbance created at the time by over-zealous and mistaken religious enthusiasts. "It is conceded by his opponents thnt Senator Smoot is not. and never has been polygamist; that his persona! character Is beyond reproach; that nothing can be alleged against him except that he is an apostle In the Mormon Church. "The hostile public sentiment has been fomented by a coterie of sectarian ministers in this city whose heated harangues have excited religious circles until appeals to their reason, justice and Christian tolerance seem to be in vain. "Senator Smoot is a director in this institution, is a thorough business man, and Is lndentifled with a number of Utah enterprises which have relation with the manufacturing and mercantile world. He la a representative man. and no constitutional or rational objection can be raised against him. The present commotion is injurious to the buslne.-s Interests of this institution and of tlis State. It hinders the influx of capital and obstructs commercial progress. PROSPECTIVE CONDITIONS OF REALJSTATE MARKET Dealers Believe the Spring Months Will Bring Unusual Activity.
PERMITS AND TRANSFERS Indications in the real-estate: market point to an active spring, and last week opened the season with an encouraging number of sales of more than average magnitude. Nine of these average in value over $15,000. and the total transfers for the week amounted to over $300,000. Real estate-dealers generally express confidence of an active and succesful season. A number of large deals are reported to be pending, that are expected to be closed within a week or two. The large property on the east side of Meridian street, north of Fall creek, has been sold by Joseph W. Selvage to Jesse Fletcher, for a consideration of $25.000. Mr. Fletcher also purchased of Mr. Selvage and wife property on Meridian street, near Thirtieth street, for $10,500. Henry II. Dollman has purchased of Louis H. Hj .$63,115.00 MUCH DAMAGE WROUGHT BY PERU EARTHQUAKE Lima, Callao and Chorillos Felt Shock in Its Greatest Severity Railway Blocked. NEW YORK, March 5. Only one person was killed, but many walls fell and much damage was done by the earthquake, which occurred Friday, says a dispatch from Lima, Peru. One of the structures seriously affected was the Cathedral. Its right tower was cracked and much damage was done to statues and works of art. Scarcely a house In the city escaped damage. Doors and windows were opened and reshut by the tremors. Roofs were dislodg d and pictures, mirrors and glassware in shops were destroyed. The balconies of a large part of the buildings in the city tumbled to the ground. A dispatch from Chorillos says that the earthquake was more destructive there thfn in Lima. It cracked the walls of churches and destroyed pictures, statues and crockery. In Callao walls of numerous houses fell, while the docks and the iron bridge suffered seriously. Traffic on the Central Railway was stopped by rocks falling on the track. COMBINE FORMED BY ELECTRIC COMPANIES Bullock and Allis-Chalmcrs Companies Enter Into a Business Consolidation. MILWAUKEE, Wis., March 5. The Evening Wisconsin to-day says: The AllisChalmers Company has comh'ned with the Bollock Electric Manufacturing Company of Cincinnati, whereby the business of the latter concern Is taken over to be conducted as that of a single interest. The Bullock company will be conducted as heretofore by its present management under the form of the Bullock, Kh etiv a I Manufacturing Company, organized under the laws of Ohio. George Bullock will be president and George Neaze vice president. Both are of Cincinnati. This combination will giw the AllisChalmers Company the facilities of a well organized electric manufacturing company and thjt Bullock company will have its output constructed by the Allis-Chalmers Company. MONUMENT OF SAVIOR AS A PEACE OFFERING Argentina and Chile to Unveil It at an Altitude of 20,000 Feet Above Sea Level. SANTIAGO, Chile, March 5. On Sunday. March 13. a monument representing the Savior will be unveiled on the summit of tho Cordillerax, 20,000 feet above sea level, as a token of the gratitude of Argentina and Chile at the maintenance of peace between the two countries.
