SUIT BROUGHT BY BONDHOLDERS. They Want a Receiver for the Ohio, Indiana X Western Kaihray Company. A suit Las been filed in the United States Circuit Court by the Central Trust Company, of New York, find Frank IC. JSturgis, who hjos on behalf of himself and other bondholder?, against the Ohio, Indiana t Western Railway Company. The plaintiffs ask that tho amount payable npon the bonds issued by tho defendant bo determined, and that the company be ordered to pay tho same. In default of payment the plaintiffs ask to have the- road sold under tho direction of tbe court and that the riroeeeds be applied to tho payments of moneys duo plaintiffs. The prayer of the complaint is also for tho appointment of a receiver. It is set forth tfit about April 2, lssf the defendants issnt?d a fierie of firt mortgage bonds anion. ntiDg in-tho aggregate to .."jOO.OOO of which were preferred bonds, and in case of aDy 8ae f the property mortgaged tho plain, tiffs were to havo a prior claim on' the proceeds of such sale. These bonds were made payable April 1, l'J'JS, with interest from A l'- at tiie rate of 5 per cent. A deed of trust was executed and delivered to the plaintiffs by the railway company which conveyed to them 3 security

The deed also provided that in case of sale by judicial authority, under foreclosure of the first mortgage, the proceeds of any such fale should bo distributed as follows: First, to the payment of. interest upon the preferred bonds. Second, to tho payment of the principal and accrued interest of bonds secured by first mortgage. Third, atter the tirst-mortgago bonds should have been paid, tho balance of such proceeds should be applied to the payment of the principal and accrued interest of such of the accrued interest certificates secured by the first mortgage. It is , also claimed that the surplus, if any, after this was done, was to be paid over to the railway company. This deed of trust was recorded in the States of Illinois, Indiana and Ohio. The complaint also states that the railway company paid the interest upon the ."00,000 preferred bonds when the tame became clue, but did not pay the interest on the non-preferred bonds, which became payable the 1st days of April, July and October, Tbe plaintiffs state that the mortgaged premises are inadequate security for the payment of the moneys now due upon tbe bond; that the amount of principal and outstanding and unpaid bonds secured by first mortgage is $6,500,000, and that the interest thereon has been paid to the let of January, lbSO; that the principal on unpaid accrued interest certificates secured by first mortgage is $G4."),C00, the interest having been paid to October, lb88; that the amount principal on unpaid bonds secured by second mortgage is' 52,000,000, the interest thereon having been, paid to the 1st of October. 1888, and that the amount of the principal in second mortgage accrued interest certificates is $242,000, the interest having been paid to Oct. 1, . No other interest on bond certificates has been met.
