'AFFAIRS OF TIIE RAILWAYS. The B-Xln-nifi: Four Deal. .New York, March 27. The directors of fhe C, C, C. & I. met at tho Grand Central iepot to-day and voted in favor of consolidating with the Cincinnati, Indianapolis.St Xouis& Chicago railroad. The latter company voted to the same effect on the 19th dnst, and the agreement has been executed, fiubiect to ratification by the stockholders of "both companies, who will meet in May. The new company is to bo known as the Cleveland, Cincinnati, Chicago & St. Louis railroad, and a majority of tho directors are to be Vanderbilt nominees. The capital of the company will be $10,C00.000 preferred and $JO,500,000 common stock. The preferred stock will be cxhanjred at par for shares of tho C, I., fct. X. & C, holders of tho latter to also receive $3,000,000 of the common stock, the 'balance of 17,500,000 common stock being given to holders of C, C, C. fc I. stock at the rate of iec.G0 for every $100. Before the "consolidation goes into effect the C, C, C. &. I. will declare a cash dividend out of the surplus at the end of last year and tho net earnings. Personal, Local and State Notes. W. Superintendent Whitcomb, of the Belt road, yesterday relieved two crews on acrount of the falling off in freight traffic over the Belt in the last few days. The offices of the general ticket and pasi 8enger agent of the Boston &, Albany road are to be removed from Springfield, Mass., to Boston on the 15th of next month. The steamships of the Inman line sail tinder the American nag for the reason that the steamship line is owned largely by ine Pennsylvania Kailroad Company. John T. Two Jndianians haverecentlv been allowed letters patent on brakes for railroad cars. Over three thousand brakes have i been patented. One of the latest is a simple affair in its workings. Push a button on one of the coaches and brakp.4 nm promptly set on the entire train. It is done through connection with the engine's air brakes. Until within two years past all the freight locomotives purchased by the Lako Shore road weighed Ji to 40 tons. Now they purchase none weighing less than lifty tons. The lighter engines are placed on tho division having tho lightest grades. The Cleveland Leader says that President Newell is now considering the advisability of purchasing still heavier engines to use bei tween Cleveland and Buffalo. The Indianapolis car-works are turning out tho new cars for the Chesapeake & Ohio road at the rate of sixteen a day. They aro & very substantial car, and so constructed that they can be loaded with grain or merchandise, or can be convenieutlv utilized for coal. The car is from a design of Win. .Garstang, formerly master mechanic of 'the Bee-lino at Bright wood, and now superintendent of rolling stock on tho C. & O. Toud. - Tho demand for Indiana stono from the southern part of tho State promises, this year, to bo largely in excess of any forinerone. The L., N. A. & C. is already hauling from Etone quarries on its line, lifty car-loads of etone a day, most of it going to Chicago and the Northwest, sonio as far as Omaha. Tho company expect, when the season fairly eots in, to load 100 cars a dav. The stone, "Which will be used in the soldiers' monument at Indianapolis, will como from quarries on its line. The new declaration of Judge Cooley and his associate commissioners practically notifies the railroad companies that they have no choice but complete submission to the law, whatever may be its cfiect on tho properties. It must be admitted that tho obvious Intention of the law was to require certain changes in the methods of and charges for transportation, without the slightest regard to tho question whether these changes would result in bankrupting veome of the roads. It is intimated that whether the Pennsylvania people secure control of tho Cairo fc Yincennes road or not, it will build an extension of the Indianapolis &. Vincennes road into Evansville to otlset the invasion of its territory 13 tho Mackey syndidato. If the Pennsylvania Company was to build into Evansville, it would be highly appreciated, doubtless, by the business men of that place, as they are now at the mercy of the roads controlled by tho Mackey syndicate as regards rate matters. The Central Traffic Association announces that reduced rates will bo given to persons from all points in Indiana who wish to attend the Shelby County Medical Society meeting on April 8; to the Woman's Presbyterian Missionary Society of the Northwest, which convenes in Fort Wayne April 53 to 25; to the Grand Chapter of Indiana, Order of the Eastern Star, which convenor at Indianapolis April J1 and J5. and to tho Grand Commander, Knights Templars of Indiana, which meets in Indianapolis April CO and May 1. President Mayer, of the Baltimore &, Ohio road, has issued a circular to the B. fc O. employes, citing the fact of the abolition of tho U. & O. Employes' Relief Association by tho Legislature of Maryland, .taking eflect April 1. Tho circular states that in order that the purposes of the association may bo carried out, tho board of directors have established a relief department, which is practically tho same, so far as purposes go. 'An employe will not be compelled to belong to it, but it will bo for his interest to do so. 'iiie giving or free passes, by pass or oinerwise, to or making a reduced rate for tho leader or any member of a party to secure the trans portation or the party wouia be "aiscrmnnation," and punishable by law; therefore, don't do it, as the liability rests upon the person who commits tho act. 5. The penalty for charging a passenger more or less than the regular legally established tariff rate, oror any other willful violation of the law, is a line of $5,000, or imprisonment in the penitentiary for two years, or both. CULLEiGS FROM TIIE COURTS. . Clements, Who Killed Nowland, lias His Preliminary Hearing Postponed. J ohn Clements, who shot and killed Lloyd Nowland, Monday night, was to have been given his preliminary hearing beforeMayor Denny yesterday morning, but it was postponed until Saturday. To those with whom he talked yesterday he threw no additional light upon the story of the killing, and positively asserted that he felt as if he had done his duty, for, he claimed, no matter what motive had brought Nowland to his home, the man was found at a time and in company with his wife when it was at best suspicious. Mrs. Clements, who was released from custody after she had given her testimony to Superintendent Travis, has decided to move to North Indianapolis, where her parents reside, and she was busy yesterday in packing up her coods in tho McCarty-street house, where Nowland was killed. She expressed intense regret at the result of the atl'air, but repeated the accusation against the dead man of being the direct cause of his being found in company with herself. According to her story, she met him at Jones's wine-rooms, which is coroborated by the fact that she left the place in his company. Prior to the killing both had been drinking, but if tho woman is to be believed, neither was intoxicated to any great degree. A Forensic Struggle. W. P. Fishback filed with tho clerk of tho Supreme Court, yesterday, the second part of tho answers of the defendants Niblack, New, Coflroth, Lowry and Nye, in tho Supremo Court commission case. Tho additional paper contains no new matter, but simply recites tho election of tho commissioners by tho Legislature, tho issuing of their certificates, and their former tender of them to the hief-justice. This completes the pleadings, and it is expected tho case will bo taken up for argument this morning at 10 o'clock. While the Tule of the court as to the time allowed for argument will be suspended, it is not believed that either sido will take up more than two hours and a half in presenting its claims. The arrangement for tho hearing of the Supreme Court commission case today, the city cases to-morrow, and the Insane Hospital case on Saturday, will permit the various points raised between the legislative and executive departments to bo considered by the court consecutively, and it is not likely that more than one will bo argued in each case. Thus the argument to-day will probably be confined largely to the right of the Legislature to delegato judicial authority. To-morrow tho talk may be expected to hover about the subject of homo rule and on Saturday the general question of the authority of the legislature to create and fill offices will be considered. It is likely, in view of the importance of tho matters to be determined; and the prominence of tho counsel who take part in tho argument, that the average audience which attends tho trial of cases before the Supremo Court will be considerablj increased. A Claim to Real Estate. Suit was brought yesterday in the Superior Court by Win. T., Charles W., Elizabeth, Florence and Andrew Peters against Gottisch and Emma Wachstetter and Freeman Stout, to quiet tho title to real estate inherited by the plaintiils from the estate of Itliiel Towne, and in addition to the disf ute over the title, damages are claimed, n 1S44 Towne died, in Connecticut, and his will, it is claimed, was duly admitted to probate in New Haven, a copy of which was tiled in tho Circuit Court of this county. He bequeathed tho real estate in question to his only daughter. Etha L. T. Peters, wife of Wm. T. Peters. In 1871 she died, at her father's homo in Connecticut, leaving the property to the husband, bin children and descendants. The plaintifi's now corao before tho court, and claim that the real estate was not sold at tho time according to tho provisions of his wife's will, and ever since tho parties named iu the suit as defendants nave laid a claim to the title, refusing to come to an amicable settlement. The property is on West Washingto street near Mississippi, and is valued at o,000. Sale of a Natural-Gas Company. The Capital City Natural-gas, Oil and Water Company, incorporated Feb. 24, 1SS7, has decided to discontinue its existence as such, and next Saturday the sheriff will dispose of all of its wells and other equip ments. At tho time of its organization there were nine directors, consisting of John Caven, Henry Schnnll, Dau H. Wiles, Jas. T. Layman, Wm. P. Johnson, Otto Stechhan and others. Twenty-four citizens took shares in its stock, and it was intended to push tho piping and completo tho project as soon as practicable. Tho first well sunk was near Urightwood, the first in this county, but it did not give gas in anything like paying quantities. Afterward wells were sunk on farms iu that neighborhood with much better success, but tho company was tied up by not having a right of wa Auditor of State lirnce Carr brought suit to satisfy a claim of 83,000 acainst tho company, and it is under an order of tho court, that tho sale is .to be made. A Question of Obscene Letters. Lorenzo D. Hright, of Winamac, arrested Tuesday by Deputy United States Marshal Wilkinson, of Fort Wayne, on tho chargo of sending obscene matter through the mails, was brought to the city, and in default of tl.OOO bail placed in jail to await the action of the grand jury. The prisoner was given a preliminary hearing before Commissioner Leonard, of Fort Wavne. It is alleged that liright had written iift'-six letters of an obscene character to another man, in which ho made unfounded charges against tho latter' a wife. Tli Court Record. Although the statute (Section 5314 authorizes county commissioners to grant liquor licenses to male inhabitants in a case where only males aro concerned, the act will be held constitutional. Whether or not there is an unjust discrimination against women or non-residents cannot affect such a case. 3.
