AFFAIRS OF THE RAILWAYS. Verdict Against the 3riilland. Special to th IntUanapoIia Journal. CRAWFOKDS VILLE, Ind., Fob. 11. An important case against the Midland railroad f has been decided in favor of the plaintin'a. ' It was brought in the Montgomery Circuit Court by Livingston T. Dickinson et al. to recover a balance duo for ties furnished, when the road was constructed. Tho action was to force a lien upon all that part of tho Midland railroad in Montgomery county, and also to have tho lien paramount to a $10,000,000 mortgage that had been placed upon the railway. Tho case "was taken to Tippecanoe county, on a change of venue, and. Judge Langdon ban held that the lien is first on the list, and has ordered all that ' part of tho road lj'ing in Montgomery county be sold to pay the $7,000 yet duo for ties. tJt seems that in January, 1837. the mortgage :was given, and recorded in February, and that the lien was not tiled until November, 3SS7. It was claimed by the plaintiffs that no bonds had been actually given prior to "the tiling of the lien. Upon thin point neither side ottered any evidence, each saving that the other had the most proof. It was held that tho defendants were supposed to know tho facts abont the mortgage affair, and as they introduced no evidence on this point, it was therefore conclusive that the plea, of the plaintiff's was correct.
liurllngton Earnings. Chicago, Feb. 11. The Chicago, Burlington &, Quincy Kailroad Company to-day issued its statement of earnings and expenses for tho month of December, and tho year 1858. The gross earnings for the month were 2,167,673, an increase of $4,285 over those of the corresponding period of the previous year. There was an increase of 318,048 in the operating Expenses, and a decrease of $313,703 in net earnings. For tho twelve months ending Dec. 31, tho gross earnings were $23,7by,lC7, a decreaso of $3,785,010, while the net earnings were $5,985,054, a decreaso of $6,378,147, as compared with 1SS7. Personal, Local and State Notes. - It is stated that the Mackey syndicate . .will take control of the Louisville, EvansVille &, &L Louis road on May 1. D. T. McKay has been appointed agent of the Interstate Dispatch, at Chicago, vice H. C. Smith, transfered to Toledo, O. ; Tickets for the inaugural trip to Washington, D. C, will be sold commencing Feb. '25, and will be good to return up to March 8. The receipts from sales of tickets at the outside offices of the Uee-line at thi9 point for January, 1880, exceeded those of January, 18SS, $1,434.10. W. G. Brimson. formerly a train-dispatch-r on the Lake Erie fc Western road, has been appointed a division superintendent on the Northern I'acitic. The next big move, it is predicted, will .lie the consolidation of the Pennsylvania 'lines with the Vandalia and the Cincinnati, Hamilton & Dayton, systems. The actual earnings of tho Lake Erie &. Western for the nrst week in February vere $47,750, an increase over those of tho corresponding week in 1S88 of $13,078.41. In the year 1S58 there were shipped ont of Jlichigau City f,812 car-loads ot lumber, l'he Lake Erie &, Western led the Louisville, New Albany & Chicago by 138 cars. i It is stated that tho Now York Central Toad is still showing a falling oil' in its west-bound business, while the business of the Delaware &, Lackawana is increasing proportionately. - The Western Freight Association will jneet at Chicago, to-day, to grapple with the rate question and to put into effect fxmo schedules which are made necessary by the decision of Judge Brewer. - There is a rumor that tho Lake Shore road is to prosecute the Hoosac Tunnel line before the interstate commission. Some action is evidently needed to force minor w roads to fullill their obligations and agreements. , Negotiations are said to be pending between tho Louisville fc Nashville and tho Chicago & Eastern Illinois companies for a closer traffic alliance, through which the CL. & N. will secure entrance into Chicago over the C. &. E. I. tracks. In the last half of 1888 the business of the -Midland fast-freight line increased over 100 per cent, above that of the corresponding .period in 1887. Imt few fast-freight lines nave increased their business to the extent which this lino has. It is stated that tho Louisville, New Al'bany &, Chicago's net earnings for 1888, "based on actual lignres for the -whole year, will be $110,000 better than in 1S87, and that charges will be $35,000 less, which will result in a surplus of $145,000 for last year. The Wabash Western 6hows an increase in gross earnings in the month of January over the corresponding month in 1888 of 838,210. This increase was made largely by the passenger service; in fact, the freight rarnings dropped below those of January, 1SS3. , Superintendents Ewan, Bender, Van :Vinklo, Wilson, Boyd, Whitcomb, Bennett and I jams left for Cincinnati last night in the special car of Superintendent Ewan to attend the monthly meeting of the Superintendents' Association, which convenes in .that city to-day. If the Cleveland, Columbus, Cincinnati St Indianapolis and the Cincinnati, Indianapolis, St. Louis &, Chicago roads are to bo consolidated, it is to be hoped that the financiers who are arranging the deal will invent a shorter title for the two concerns than the legal name of either of tho two original corporations. Amos L. Hopkins, who last week retired from tho second vice-presidency of the Missouri Pacific and Iron Mountain roads, denies that there was a lack of harmony between him and the Goulds. He remains as a member of tho executive committee on loth roads. Tho position of second vicerresident has been abolished. The committee appointed to arrango a uniform classification for use by all roads in the United States, has completed that portion of the work. Tho more difficult task of grouping all articles of freight in a manner satisfactory to every section of the country remains to be perfected. Several months will be required for tho work. F. Chandler, general ticket agent of the . "Wabash Western, has printed a folder which is so arranged that it gives the timo of arrival and departure at all points of every train, and tho distances between every station distinctly. On tho last leaf of the folder is a condensed! time-table of every road operated west of tho Missouri river. Tho most stubborn fight in the history of Maryland roads was settled on Saturday last. I he roads involved in tho war were the Pennsylvania, the West Virginia Central, tho Baltimore fc Ohio, and the Cumberland & Pennsylvania, The case has cost over $100,000. It kept the courts busv for nearly six months, and it necessitated the maintenance of an armed force four months. During tho war tho track was torn up twice. Favorable progress is reported in carrying out the project for extending the Cairo fc Vincennes, making it a better Chicago line. The project known as the Danville, Chicago t Northwestern is backed by tho syndicate which owns the C. & V. Tho connection for the Northwest will .probably be made at Strawn, on the Streator division of the Wabash road. John McNulta is president of tho company, and M. A. McDonald vice-president. The West Shoro road increased its graiu tonnage into New York last year, over that of 1887, 1,500.000 bushels, but it seems to have been done at the expense of the New York Central road, which delivered at New York, in the year 1888, 18.0l,845 bushels of grain, against 21,079,i25 bushels in 1SS7, a loss last year of nearly 0,000,000 bushels. The New York Central, in 1885, delivered at New York 28 1-2 per cent, of the grain ehipped to that point; in 1887, 1U.57 per cent, and in 1S8, but 17.91 per cent. The bondholders' committeo of tho Wabash state that antagonistic parties to tho reorganization scheme have persistently misconstrued the report of the master in chancery. President Ashley, of the Wabash estern, states that there is nothing at all in the reports prejudicial to the interests of the reorganization party. The report of the masters does not decide anv legal points whatever, but it is regarded mainly as a suggestive document to the court to bo used . when formulating the decree for the foreclosure ale. The Pennsylvania Company has about completed a train of live passenger coaches -vith a new hot-water heater that promiaea

to settle the question of heating passenger trains. A test of the train is to be made between Chicago and Pittsburg, over the P., Ft. W. fc C. road, this week. The water is heated over the boiler of the locomotive, and through a series of pipes will be run into the cars. A Fort Wayne engine has been remodeled to heat tho water. In the dome over tho center of the boiler, which was fonnerlv known as tho sand-box, coils of copper pipe will be laid, throngh which the water will pass. As the dome rests upon the hottest part of the boiler, and the steam circulates around the pipes inside the dome', it is claimed tho coldest water can be made scalding hot in a few minutes. It was definitely settled, yesterday, that Wilbur Lee, general passenger agent of tho Lake Erie & Western road, would, on the 1st of March, sever his connection with the L. E. fc W. to accept the position of assistant general passenger agent of the Union Pacific road. Mr. Lee and General Passenger Agent Lomax of tho Union Pacific were for some jears associated on the C, B. & Q. road, and the latter knows Mr. Lee's qualifications as a passenger man. Mr. Lee belongs to a railroad fainty'. His father is now engineer of maintenance of way on the Baltimore &, Ohio road, and he has three brothers holding important railroad positions. Mr. Lee, through the change, gets an increased salary, and places himself in the line of reaching a still more important position than the passenger department offers. General Mana'ger Bradbury said last evening that the successor of Mr Lee had not been decided on.
Legal Right of a Bicyclist. Kingston Freeman. A case has lately been decided by tho Court of Appeals oi Rhode Island affirming a decision ot a lower court which laid down the law that a cycler has tho same right on a road that a man has who drives a horse and wagon. A cycler and a man driving a wagon approached each other on a road. The cycler turned to the right, but tho man driving the horse refused to turn out. There was a collision. Tho court .decided that the driver of the horse had violated the law by not driving reasonably to the right of the traveled center of the highway. A Convenient Article. Nebraska State Journal.
