AFFAIRS OF THE RAILWAYS. The Banner Week of the Tear. , The train records for the week ending Oct. 22, show it to have been the banner week of the fear in the movement of loaded cart, there being received and forwarded at this point a total t 24,365 ears, of which n amber -19,304 were loaded cars. This is an increase in moremen orer that of the preceding; week of 7S2 loaded ars; over the corresponding week, 1886, 813: over the corresponding week, 1885, 3,418 loaded cars;' in d there is not a road centering here that would have done more business could the cars ind power to haul been commanded. Eastftound there has been a decided improvement li business the last few days. Shipments of rrain to interior points have been heavier; export business is a-ain brisk, then there is a betMr movement in Inmber, and the shipments of Ive stoek have reached olden-time figures with 4e Bee-line and Pennsylvania lines. The five cading Eastern roads last week forwarded from this point 4,780 loaded cars, against 4,688 the jor responding week, 18S6, and against 1.394 the correspondine week, 1885. West-bonnd business continues heavy Oeyond parallel, and with most of the through, lines exceeds the eaut-bound tonnage. The C, St. I. & P., last week, for instance, broueht in from the East 1.176 loaded cars, against 936 forwarded. The Bee-line, however, makes an exactly reverse exhibit, forwarding 1,467 loaded tars asains 1.196 broueht West. North-and-outh roads, it will be noticed, are doing a good business, more especially the C., L, St L & C. and the J.. M. &L Local business is heavy beyond parallel. There is a large movement of merchandise of a miscellaneous character, and coal of all descriptions is moving in all directions in quantities never before known in October; especially is this trae of Indiana coals, the tonnage being limited only by the car which can be commanded. The hog crop begins to move quite briskly, and the shipments of cattle East are unusually heavy. Below is given the number of cars received and forwarded at this point in the week ending Oct. 22, as compared with the movement in the corresponding weeks 1886 and 1885:

A Word for the Baggageman. Upon no class of metric, the railroad service is more abuse heaped than on the bacgagebandler. No one stops to think that a breathless span of time is allotted him to hand down his pile of trunks, and that the work must be accomplished to the minute, while all around him is excitement and hurry, trains arriving and departing by the half dozens at the same minute. It is quite essential at a station like the Union Depot that the baggagemen be ex- ' perts in the matter of handling trunks. A greenhorn csn at once be detected. He tackles a trunk with bungling awkwardness, he rolls it

with puffing labor, falls over it "and tilts and drops it a score of times. To watch an expert ooloading a train you will observe how his one hand rests upon one corner, and the other upon the side. He lands the trunk upon the floor, , never upon any corner, always on the full end. The corner is the wrecking point, even of an iron c:ad. He most dexterously hurries it to oue side with the ease of a toy, and hurls another after it with the grace and pose of a ballplayer. He always prefers a large trunk to a small one it is better to handle. The wrecking is never done by an expert who handles hundreds of trunks at the great confluences of railroads. It is done by the small fries of the least work and particularly by the inexperienced hands of road expresses. Banner Week on the Belt Road. crease over the number transferred in the corresponding week 1886 of 3.203 cars. The movement was the largest in the history of the Belt road, exceeding that of any former week, 1,180 ears. During the week Belt road engines handled 1,313 car-loads of live stock against 1,085 the corresponding week 1886.

.. Iiooal nnd Stat Notes. The Cleveland, Columbus, Cincinnati & Indianapolis road (Bee-line) earned in September $426,193. Last week 110 new cars were shipped northward from the Indianapolis car-works over tho ' Lake Erie & Western. The Lake Erie & Western road earned the

Jones, of the Northwestern road, has been appointed secretary of the Western classification committee in place of N. P. lglehart, resigned. On Friday last fifty freight trains were run over the Indianapolis division of the Bee-line. Every engine on this division was in service throughout the entire day. The tables have turned with the L, B. & W., which has for some weeks past been showing a decrease in earnings. The second week in October an increase of $6,275 is shown. The officials of the Pennsylvania corapauy located in Pittsburg, Pa., wiil on the 1st of January, occupy their new building. It is said to be one of the largest and most conveniently arranged buildings for railroad offices in this country. Freight trafflo with the I., B. & W. is improving. The last week 'all of their monster "consol" engines were in service for the first time since purchased, and the traffic would be much heavier were cars to be had to move the business offered. O- P. McCarty. formerly of the I., B. & W., more recently assistant general passenger agent of the Union Pacific, has accepted the position f chief clerk in charge of passenger rates of the trunk-line association, bis headquarters to be New York. The Pennsylvania inspection party will reach he city at 4 p. M. to-day. They number thirtytwo, and have engaged rooms at the New Deniton House. To-morrow morning thev go south over the J., M. & I., one of the best divisions of their system west of Pittsburg. J. W. Sherwood has been offered one of the high official positions on the Wisconsin Central road and has its acceptance under consideration. On his return from Nevada, where he has gone to look after some mines in which he is intersated, be will doubtless again enter railroad service. Geo. Stevens, superintendent of the Wabash road proper, is an expert with the telegraphio Instrument. He of ten, at the same time, will be sending a message with one hand and writ'.Dff another message coming in on another wire, and he does it with a correctness which cannot be excelled. In answer to the complaint that the Chicago & Alton is partial to the I., B. & W., General Passenger Agent Charlton says that this road works with its friends, and whenever the Vandalia and the L. & St. L. roads treat the C & A. as if they bad a lna between St. Louis and Kansas City all grounds of complaint will be promptly removed. The Middle States Lumber Association at its recent meeting appointed Gaylord Beach general manager of the Bee lint, and J. M. Kerp secreary of the association, to confer with General Manager Henderson, of the I., B. & W.. as to the road he represents signing the articles of Agreement, which agreement means a proper division of the business and the maintenance of rates. The annual election of directors and officers kf the Chicago & Eastern Illinois, the Evansville & Terre Haute and the Cbicaeo & Indiana Coal roads are to be held on the same day in the eity of New York, a circumstance which the Terre Hants Gazette thinks is indicative that a consolidation will then be effected through the purchase of the the E. & T. H. road br the ther interests. The friends of the proposed Evansville Ss Richmond road, although dishearted over the trouble to raise money for new railroad enterprises, have not by any means abandoned the orojeot, and where the time allotted to them to nild the road to secure certain subsidies has ixpired they are moving to have new elections, Hoping that in due time they will be able to build the road. Judge Gresham says that it will be some two weeks before be and bis associate jnde. who seard the argument asking for the appointment .for a receiver of the Vandalia give their decision U the matter. In railroad and legal circles the

belief prevails that no receiver will be appointed. So averse is Judge Greshan to courts running railroads that the necessity of appointing a receiver must be made quite apparent before he will appoint one. The following buir item appears in the Evansville Journal of day before yesterday: The Illinois Railroad and Warehouse Commissioners will be down here in a few days on a tour of inspection over the Peoria, Decatur & Evansville railroad. The officers of the line are said to be more than willing, as the condition of the road has been badlv misrepresented by evil-disposed persons, probably with a view of depressing the value of the stock in the market. Now that the Western Passenger Agents' Association has fixed upon two cents per mile for one-thoasand-mile tickets it is highly probable that the roads in the Central Traffic Association will make the same rate, as it would seem hardly practical that the roads east and west of the territory covered by the Central Traffic Association should be selling one thousand-mile tickets at $20 and the roads in the Central Traffic Association making the rate $25 per one thousand miles. The Pennsylvania Company gives notice that the South Chicago & Southern railroad is now open for business its entire length, excepting from Colehour Junction, I1L, a point on the Pittsburg, Fort Wayne & Chicago railway, fourteen and two-tenths miles from Chicago, to South Chicago and Southern Junction, 111., where the South Chicago & Southern railroad connects with the Chicago, St. Louis & Pittsburg railroad, nine and three-tenths miles from Colehour Junction. Who owns the Cincinnati, Hamilton & Dayton road is now one of the leading questions. The parties who are seeking to throw the road into the bands of a receiver do not own or control over one-fifth of the stoek, and the other fourfifths is in the bands of the assignee of H. S. Ives or the parties whom H. . S. Ives borrowed money from and put upC, H. & D. stock as collateral. Some of the holders of these collaterals, it is said, have disposed of their stock to persons whose names do not appear on the surface, and said persons are just as likely to be interested in the Pennsylvania road and purchasing it for that company as for their personal holding. The announcement came last week with a good deal of bluster, from the office of George Blanchard. chairman of the Central Traffic Association, that Indianapolis had been made a "milling in transit" point At first millers, grain dealers and others supposed that Indianapolis would be able to again take its stand as a grain center; but investigation shows that under its provisions it would cost just i cent more to get a hundred pounds of grain from Terre Haute, Peoria or some such point to the seaboard than it would were no attention paid to the provision made by the traffic association, which makes this city a "milling in transit" point. The Chatsworth accident, save the Railway Age, of a few weeks ago. was followed by a demand, in some of the daily papers, that sleeping cars should be run at the front instead of at the rear of trains, the argument being that their great weight and strength caused them to crush through the lighter coaches in front in case of the sudden stoppage of the train. The recent disaster on the Chicago & Atlantio presents an argument for exactly the opposite theory. This was a rear collision, and it is shown that the two heavy sleepers at the end of the train acted as a buffer to the tremendous shock of the colliding engine and train, and not only withstood the blow so that their passeugers escaped without injury but intervened so as to prevent more complete destruction of the cars in front. A reporter of the Pittsburg Dispatch asked one of the officials of the Pennsylvania road, who was in that city a day or two ago. what the company was oing to relieve the car famine, and he answered as follows: "We are doicg all we can. That ss the one thing that puzzles us greatly, and we would be glad to receive any suggestions. We can't find the cars. We do not know what becomes of them. We built 11,009 cars this year, and where in the world they have gone to we do not know. President Roberts is beginning to think that if we did not build any more cars they would not be so scarce. The simple fact is that the cars of our road are being used very largely on other lines. The gauge has been made uniform all over the country, and the cars go to all points and are not returned. Where a father placed his child in the care and keeping of another person, a verbal agreement by him that such person might hare her care and custody during her minority, he is not estopped from thereafter re -claiming that custody. (2 ) In order that the appointment of a statutory guardian may be conclusive as against the father's rights to the custody of hi child, it must in some way appear that he was in court in such manner that' the court in appointing the guardian mu9t have passed upon the question of his fitness to have such custody. (3. ) The doctrine of res adjudicate will aopiy to habeas corpus proceedings where the enstody of a child is sought. This proceeding (habeas corpus) is net barred by the plaintiffs former proceeding to have appellee removed as guardian, and himself substituted. The evidence necessary to sustain this proceeding would not have sustained the former. (4. ) The return to the writ asserting the unfitness of appellant to have the enstody, training and education of the child, is sufficient as against the general exception to it. 12754. Melissa S. Funk vs. John Beverly. Warren C C Reversed. Elliott, J. Complaint for slander. The alleged slanderous words given in the complaint are these: "I know all about that case. While she was ont there claiming to be the wife of Gnorge W. Fuok she was back here claiming to be my wife." These words are not actionable per se. The complaint was bad on demurrer. (3.) The fact that the publisher of libelous words avers that he heard them from another, and that it is true that he did is no justification. Cardinal Glbbons's red bat, the especial insignia of his dignity as a cardinal priest of the church, is still at the house of the cardinal's friend. Mgr. John D. Keiley, jr., on Clermont avenue, in Brooklyn. There seems to be a good deal of promiscuous misinformation in the public mind regarding red hats. A press dispatch stated, during Philadelphia's latest centennial celebration, that "Cardinal Gibbons wore the red hat of the eardinalste just bestowed upon him by the Pope," and ninety-nine editors out of a hundred printed it. Cardinal Gibbons did not wear anything of the sort. The hat lately bestowed on him by the Pope was resting snugly in its bandbox at that time. Cardinal Gibbons wore the little red skull cap, which looks exactly like the lining out of a Derby bat. It is called a "zuehetta." TRANSCONTINENTAL TRAVEL.

The Santa Fe Line Taxed to Its Utmost Capacity The Rate War in Full Blast. Special to the Indianapolis Journal. Santa Fe, N. M., Oct 22. Within the past ten days upwards of five thousand people have passed down the main line of the Santa Fe road en route to California. Last night the westbound train was run in three sections, and about 1,500 people were on board. Triple headers will be run during the remainder of this month. Passengers say that many are compelled to wait several days at Kansas City before they can secure accommodations on Santa Fe trains. The recent circular letter of the Southern Pacific Company to the various transcontinental lines advocating that the California terminal lines buy up the return portion of these tickets to California, which are now selling at $60 with a six-month's limit, for $20 each, in order to keep them out of the scalpers' bands, has precipitated a great war on transcontinental rates. The move was a direct stab at the Santa Fe company, and from passengers who came in from Kan & as City last night it was learned that the war is on in earnest. The Santa Fe and Union Pacific are both crowding the fight. At first they made the west-bound rate from the Missouri river $40, but within three days past tbis has been cut to $30, and many of those who went through last night are traveling at this rate. It is thought the Southern Pacific will now carry out its threat to haul California passengers from the Middle and Western States for $15.
