THE PUBLIC SCHOOLS. THB COUNCIL AUTHORIZES THE CITT TREASURES TO RECEIVE SCHOOL WARRANTS IN PAYMENT FOR SCHOOL TAXES THB ORDINANCE PASSED BT COUNCIL AND OPINION OF CITT ATTORNET ELLIOTT THAT THE USE OF $75,000 OF WARRANTS 18 LEGAL. At the meeting ot tho Council last night, Mr. J. J. Bingham, Secretary of the Board of School Commissioners, presented the following statement proposing a plan by which the Board could be enabled to provide for current expenses during the present stringency of the money market, which the Council received and concurred in: ' ? The current etpenoes, not included in the foregoing, such as repairs, cleaning school houses, fuel, pas, new furniture, stationery, books, apparatus, etc. lor the same period, will amouut to about $10,ooo. THE ORDINANCE AUTHORIZING THE WARRANTS The ordinance accompanying the statement, which is as follows, was then taken up and passed unanimously: Ordinance to aid the Board of School Commissioners of the City of Indianapolis to pay its current expenditures. bKcrioN 1 . Be it ordained by the Common Council of the Citv of Indianapolis, That for tbe purpose of enabling the Board of School Commissioners of tbe city of Indianapolis to pa the salaries of the teachers, officers, janitors and other employes of tbe P a blic schools, the accruemg indebtedness to contractors for the erection of school houses, and the cni rent expenditures of the said Board, the City Treasurer is directed and authorized to receive in payment for school taxes tne wsrrants which may be issued by the said Board of School CommisKioners, not exceeding in the aggregate the sum of seventy-five thousand dollars ($75,000). faic. The City Treasurer is directed, and it Is made his duty, to cancel the said warrants issued bv the Board of School Commi-sion-ers that be may receive in pament ef school taxes on the day that be receives the same, noting on each of said warrants the date when received and the amount ol interest due and allowed on same, and the said warrants thus received and cancelled by the City Treasurer snail be delncted from the payment to be made to the Treasurer of the Board of School Commissioners for the taxes collected for school purposes by the City Treasurer. bEc. 3. This ordinance shall take effect and be In force from and after its passage. CITT ATTORNEY ELLIOTT'S OPINION. Before proceeding in the matter, tbe President and Secretary of the Board of School Commissioners asked the opinion ot City Attornev Elliott upon the legality of the pro posed issue ot $75,000 of warrants, which he gave as lollows, asserting their perfect legality: Indianapolis, September 89, 1873. Messrs. Thomas B. Elliot and J. J. Bingham: Gentlemen I have your communication of this date, in wnich two questions are asked me. First. Has the Board of School Commissioner power to issue warrants to pay for the construction of school buildings, the salaries of teachers, and the ordinary school expenses? Second. Ha the Common Council power to authorbw the City Treasurer to receive such warrants in payment of taxes levied by the city for school purposes f The law under which the Board of School Commismissioners acts is that of March 3, 1871, and in that law there Is the following provision: "S e. 4. Such Board of School Commissioners is hereby authorized." 'Fifth. To purchase grounds, construct school houses pnrchasc supplies, employ and pay teachers " There is, therefore, a broad grant of power to do these things, and no restriction as to bow payment shall be made. The authorities are very uniform that a corporation empowered to purchase property. or to employ agents may issue wnai rorm oi onngation in payment that may be deemed expedient. This distinction is well illustrated by ihe case of Geipecte vs. The City of Dubuque, decided by the Supreme court or tne unuea awies. in mat case a contract was made by the city to pay a sum of money, with interest, to one who had assumed the payment of inureet due, and to become due on the city's indebtedness; and it was held that the con tract was a valid one, ana was noi a Borrowing of money." Tho principle decided applies strongly to the mesent question. I am of opinion, therefore, that the School Board has power to issue these warrants, and thut payment can be enforced. It follows that If the Board has power to Issue these warrants, the Council may authorize tbe Treasurer to receive them in oayment of taxes levied for school purposes. Tbe revenue from taxes levied for school purposes is bound for the pa merit of these warrants, and It is within tee power of the Council to direct the application of it to the payment of tbe warrants Issued by the Board of School Commissioiiers.
