The commissioners appointed by the last legislature of this slate, to relocate the seat ot justice of Scott county, met at Lexington on UV first Monday of this month agreeably to the provisions of the act, and after proper examinations of the situation of the rounty, and due deliberation, have decided that the seat of justice shall re maiu In Lexington, where it now is. md. ' When about departing for the race course on Tuesday last, Mr. Randolph : uggesled to- some gentlemen that it would be a good time to elect a Presi dent of the United Stales, as there would be an assembly of 50 or 60,000 people from the different parts of the Union,, and probably every state would be represented. Fro?n the Cine innati Ga2r. The negroes in the neighborhood of te Dismal Swamp near Norfolk, have recently committed several murders on the whites. They conceal themselves through the day in the woods and marshes, and commit their depradations in the night. A. Mr. William Walker, Post Master at the "Great Bridge," was shortn his own house in the dusk of the evening by a black man who hail secreted himself behind the chimney. A detachment of 200 men has been ordered out to scour the country and bring these deluded wretches to punishment. From the Pub. Adf. The passengers on board the Olive Branch, Capt. A Miller, which arrived on Tuesday last, brought from NewOrleans upwards of SS 100,000 in specie, a few more such arrivals would have a considerable effect on the rate of exchange. ,s CHARLESTON, may 29 By the United States'schooner Mary, Lieuten am Downing, attached to Com Porter's So4uadron. arrived this morning in 7 days from Key West, we learn that the U. S. Steam Galliot, Com.; porter, store ship Decoy, and schrs. Greyhound and Jackal!, were at Ky West when the Mary sailed. The re-r.-.sinder of the Squadron were on a cruise The crews were generally in good hcnHh. No recent captures of p':ratcs had been ma'Je, nor had any late depredations of theirs come to the knowledge of Com. porter. The vigilance and activity of every part of the Squadron continued unabated; and had no doubt given an effectual check" to hi piracies; that had been so longand extensively cartied on with impunay. MILITIA LAW. AN ACT o amend an act for the bet tcr regulation of the militia of the sute of Indiana, and lor other purposes. Sec. 1 Re it enacted by the General Assembly of the state of Indiana That all officers, whose duly it is made by law, to order courts of enquiry, to determine contested flections, shall in ca?e the boardof officers, which may be ordered to determine any contested election, fail to meet at time and place fuvjniuted, have full power from lime to time, to order another board, or boards of officers unul said contested ch-ction shall be fully determined, any !nv to the contrary notwithstanding. Sec. 2 The brigade major, and inspector of each brigade throughout the, state, shall be allowed the sum of three dollars, for each regiment he may in sscct, to be paid by the pay master of each regiment,-that may be inspected by such brigade major, out of any monits it his hands, arising from fines assessed in such regiment, . Sec. 3 The adjutant general of the militia shall from and after the first day of March next, reside and keep his office at the seat of government. Sec. 4. No major general, or brigadier general, shall be authorized, hereafter to take command of any regiment, on any of the days of regimental muster, unless requested by the commandant of such regiment so to do. but either of said superior officers, may give such legal orders or instructions, as thry may deem necessary and proper, to perform any manoeuvre or evolution of the day, which the commandant of such regiment shall obey. Sec. 5. That hereafter it shall not
be lawful, for any person to contest the election of any militia officer, who shall have been declared to be dulyelected, where two or more are equal, and highest in number of votes, uctil after the result of any such electon, shall be determined in manner following, to wit: if a company officer, the elcctioo shall be determined by lot, drawn by the judges of the election present; it the election of a field officer, under the rank of general, it shall be determined by lot, drawn by tho judges ot the election present; if the election of a general officer, it shall bo determined by the judges of such election from the different regiments present. Sec. It shall hereaftsr be the duty of the adjutant general, to keep a roster of the general and field officers of each division, in his office. Sec 7. Whereas doubts exist; as t tho legality of staff officers Toting
at elections for field officers; therefore, be it turtfesr enacted, that all staff officers of the militia of this state, be, and they are hereby authorized, to vote at any election for field officers, in their respective bounds, and that hereafter it shall not be lawful, for any staff officer tA vote for either brigadier or major 'general ol tho militia of this state, norshall any officer; whose commission may become extinct, be entitled to vote Tor either brigadier, or major generals. Sec. 8, That it shall be the duty of the commandants of regiments, to receive from the commandants of brigades, written notices of the time and place of holding their regimental musters, and brigade drill musters, to which they shall add, the time and place of holding their regimental drill Musters; a copy of which, they shall cause to be delivered to the commandants of companies, on or before the first day of March anuall; and it shall be the duty of , such commandants of companies, to add thereunto, the time end plies of holding their company musters for that year; a copy ot which shall be by them delivered to the sergeants of their companies, on or before the fifteenth of March annually; and it shall be the duty of such ser geants,Jo deliver a copy thereof, to each and "every person, belonging to their respective companies; on or before trie first day of April annually: Provided, that in all caies, three days notice," oTthe time and place of holding any muster, shall be deemed sufficient. ' V-v ' Sec. 9, f That there shall be one company muster held annually, in tho month of May, at such lime and place, as the commandant thereof shall appoint; and there shall be a regimental drill muster annually, to be holden at such time and plavc in the momh of April, as the commandants of regiments shall direct, to continue two day; and it shall be the duty of all commissioned and non-commissioned and staff officers belonging to the regiments, to attend .such drill muster, the commissioned officers to be armed with a sword or hanger, and the noncommissioned officers, with fire arms only; and the same shall perform camp duty during the night. Sex. That there shall be a brigade diiiriiiust'cr or officers annually, to continue three days, at such time and place, in the month of September, as the f ommandants of brigades shall direct, where all the commissioned and staff officers, belonging to such brigade shall attend, armed with swords and fire arms, and the same shall perform cmp duty, during the nights of 6uch drill; and it shall be the duty of the brigadier general, or officer highest in command, that may be present at such drill, to call the roll on each day of said drill, and note all delinquencies, whether as to absentee, arm's, : fee. and make report of the tame, together with all and every person, cither iifiicer sr citizen, who may be guilty of ungentlemanly and unofficerlike conduct, to the regimontal court of assessment, where suqh person may reside; who shall impose the same fines on such delinquents, as are now provided for like offences or delinquencies, by the act to which this is an amendment. Sec. II. That where any regimental court of assessment of fines, or regimental court of appeals, shall fail to meet, sod proceed according to Uw, to the discharge of their duties, it shall be the duty of the commandants of regiments, to order the officers composing such courts of assessment or appeals, to meet ai any other time; and such courts when so met, shall have the same powers, and be subject to the same rules and regulations, as such courts would have had, and been subject to, had they convened at the proper time.1 " , . Sec. IS. That in all casts where volunteer corps shall be ordered out, Under the provisions of the fourth seclion of die act to which this Is tn arnendmsnt, it shall not be the 'duty cf the commandant thereof, to ra&e a return of the .delinquencies at such musters, to the court of assessment; but it shall be his duty, to convene tho subaltern o&cers ot his company, on the eseoad Monday in November, sonusll7, end assess such fines, as may be rvstly due from such delinquent, and appoint some suitable person belonging to such company, to collect ench finssf who shall bo governed in
V all respects, as the collectors of other militia fines are; which, when collec. tected, he shsll pay over to the treasu rcr of such company, for the sole use of the same: Provided however, that any person who may feel himself aggrieved, by the decision of such company court of assessment, shall have the right of appeal to the regimental court of assessment, as in other cases. Sec. 13 That in no case, shall anypersonal properly that now is, or hereafter may be exempt from execution by law, be taken to satisfy any militia fine; any law, usage, or custom to the contrary notwithstanding Sec 14 That part of the act, to which this is an amendment, extending the privilege of exemption, from militia duty in time cf peace, to officers who shall thereafter serve five years, shall be so construed as to extend to officers, who may have hereto fore served for the term of five years,, and all that part of. the twenty fifth section of the said act, which makes it the duty of brigrade inspectors, to make out brigade returns, and transmit the same to the major general, and adjutant general of this state, together with the sixteenth section of said act; and all acts and parts of acts, coming within the purview or meaning of this act, be and the same are hereby repealed.
