Sec. 4. And be it iurther enacted That every person, or the heirs or representatives of such persons claiming title to lands under any patent, grant, concession," or order of survey, dated previous to the twentyfourth day of January one thousand eight hundred and eighteen, which were valid under the Spanish govern mem, or by the law of nations, and ond which are not rejected by the treaty ceding the territory of East and West Florida to tin-United States, shali file, before the Commissioners, hit her, cr tHir claim, selling forth, particularly, Us situation, and boundaries, if to be ascertained, with the dciaigumert of titte, where tliey are r.vl the iantecs, or original claimants; which shall be recorded by the Secretary, and who, for his said services, th ill be entitled to demand from the claimants ten cents for each hundred weirds contained in said papers, so rerorded; he shall be entitled to twentyfive cents for eacti subposm issued: Pro :idcd, That if the amount so received shall cfccce&one thousand two hundred end fifty dollars, which is hereby declared the compensation for his services, the excess shall be reported to the Commissioners, and be subject to their disposition, and said Commissioners shall proceed to examine and determine on the validity of said patents, grants, concessions, and orders of survey, agreeably to the laws and ordinances heretofore existing cf the governments making the grants respectively, having du. regard, in all Spanish claims, to the conditions and stipulations contained in the eighth article of a treaty concluded at Washington, between his Catholic Majesty and the United States, on the twenty second of February, one thousand ciht hundred and nineteen; but any claim not filed previous to the thirtyfirst day of May, one thousand eight hundred and twenty three, shall be deemed and held to bs void and of rone tiTVrt. Provided nevertheless, nd te itfourther enacted That in all claims submitted to the decision of the Commis uoners, where tha same land, or ctiy part thereof, is claimed by tit';s emanating both from the British aiyd Spanish governments, the commissioners shall not decide the same, but shall report all such cases, with an abstract of the evidence to the Secretary of the. Treasury Sec. 5. And be it further enac!edt That the Commission; rs shah have powt r to inquire into the justice and validity of the claims filed with them; and shall be, and are hereby, authorized to rdminister oaths, to compel theaticndar.ee of witnesses; by subpecas issued by the Secretary, and the adduction of such testimony as may be wanted; they shall have access to all pap?rs and records tf a public nature relative to any land titles within said provinces, and to make transcripts thereof. Thcyshall examine into claims arising under patents, grcnts, concessions, and orders, survey, where the survey his ben actually made previous to the twentyfourth January, one thousand eight l adrcd and eighteen, whether they arc founded upon conditions, and how f r those conditions have been comphed with; and if derived from the liritish government, how far they have been considered valid under the Spanish government; and if satisfied that said claims be correct and valid, shall give confirmation to them: Provided, That such confirmation shall onlyoperate as a release cf p.ny interest which the U. ing the rights of third persons: and provided that they shall not have power to confirm any claim or part thereof where the amount claimed is undefined in quantity, or shall exceed one thousand acres; but in all such cases shall report the testimony, with their opinions, to the Secretary of the Treasury, to be laid before Congress for their determination Every witness attending under any process from the Commissioners shall be allowed one dollar a day, and one dollar for every tventy miles travel; to bs paid by the party summoning him; provided tievcriheles.it That the Commissioners shall not act on, or take into consideration, any British grant, patent, warrant, or order of survey, but those which are bora fide and owned by citizens of the United States, and which hatfe never been compensated for by the British government Sec. 6 And be it further enactedt That there shall be appointed, by the r resident of the United States, by and with the advice and consent of the Senate, a surveyor, who shall possess the power and authority, and receive the same salary, as by law appertains to the surveyor south cfthe State of Tennessee; but his r!u:ies shall not commence until the commissioners shall have examined and decided upon the claims in West Florida, who shall thereupon furnish the surveyor with a list of these admitted, and he shall thereupon proceed to siirvey the country, taking cars to have surveyed, and mai ked, ar.d iaid down upon a general plan; to be kept in his office, the metes and bounds of the claims so admitted causing the same to be surveyed at the expense of the claimants, the price whereoi shall be the same as is paid for surveying the public lands; but no surveyor shall charge for any line except such as my be run. He shall appoint a suitable number of deputies, and 6hall fix and determine their fees: provided. That the wrrole cost of survey shall not exceed four dollars a mile: Aid provided also, That none other than township lines shall be run where the land is deemed fit for cultivation; said surveyor shall reside at such place as the president of the United States may direct, and shall keep his cfticc there, and may charge the following fees; viz: for recording the plat and surveys of private claims made by any of his deputies, twenty five cent3 for each mile contained in the boundary of such survey, ard twenty -five cents for any copy certified from the books of his office. AN ACT to relieve the people of Florida from the operation of certain ordinances. Be it enacted by the Senate and House cf Representatives of the Unit' ed States of America in Congress AssemblSd, That an ordinance numbered three, made and passed on the eighteenth of July, eighteen hundred and twenty one, by Major General Adrew Jackson, Governor of the provinces of the Floridas, entitled "An ordinance providing for the naturalization of the inhabitants of the ceded territory;0 and an ordinance passed by the city council of St. Augustine, on the seventeenth October, eighteen hunhundred and twenty-one, imposing 5c laying certain taxes on the inhabitants, and all other laws; ordinances, or resolves, so far as they enforce or confirm the same, be, and the same are hereby, repealed, and declared nulj and void.

Sec. 2. And be it further enacted, That if any person shall attempt to enforce any of said laws, ordinances, or resolves, by demanding and receiving any tax, imposition, or assessment, authorised or prescribed thereby, such person shall, on conviction thereof, be punished by fine, not exceeding two hundred dollars, or by imprisonment not exceeding six months, either or both of said punishments. Sec. 3. And be it further enacted, That the President of the United States shall, in such manner and under such regulations as he may direct and prescribe, cause to be refunded to any person any sum of money which he may have paid under or by virtue of either of said laws, ordinances, or resolves. Sec. 4 And be it further enacted, That this act shall be in force from c after the first day of June next. . Washington, May 7 j 1 822 . Approved.

AN ACT authorising the locafion of certatA school lands in the State of Indiana. Be it enacted by the Senate ani House of Refiecsentatives of the United States of America in Comgresa as sembled, That the Register of the land office at Brookville be, and he is hereby, authorised to select school lands within said district equivalent to tho one thirty sixth part of the reservation commonly called Clark's Grant, for the use of schools within the same; Ec the Register of the land office at Terra Haute is hereby, in like manner, authorised to select, within his district, school lands, which, together with the eleven sections already selected, shall be equivalent to the one thirty-sixth part of the Vinccnnes donation trace, for the use of schools within said tract. It shall be the duty of the Registers aforesaid, in making such selections, to be confined to section nutn bered twenty, in each township, and the selection so made shall be reserved from sale Washing tou, May 7, 1822.
