I Be it enacted by the general assembly of the state of Indiana. That vlicn hereaft r, any insolven. debtor shall file his petition and sched tile, attested by oath or affiiuation, ii the clerk's office of the proper county, with bond and security to the party :i whose suit he is imprisoned, o be approved by the clerk of said ffficc, con ditioned as is required in tiic a t to which this is an amendment, it shall be the duty of said cleik, if civil process of any kind shall have issued aframst such petitioner, to issue a supersedeas to such process, which all sheriffs ant? other officers are hereby rrquiied to obey. Sec. 2. All the contracts and dealings on account of the said prison, sall be transacted by and in the name of the agent of the Jeffersonville pri sen, and by that name he and his sue ct-ssors in office, shall be capable in law of suing and being sued, pleading and being impleaded, answering and oeing answered unto defending and being defended, in all courts and pla ces, and in ail actions, suits, complaints matters and causes concerning the said prison, and by that name, the a for the time being, shall be and is hereby authorised and empowered, to sue for, prosecute and recov-. r and receive of and from all persons indebted to any former agent, or on ac count ot the said prison, such sums of monty an shall become due or damages that shall accrue of and from any person or persons. Sec. 5 The said agent, by and with the consent of the managers is authorised, to contract with the President ojid Directors of the Jeffersonville -Ohio Canal Company, for the employment of the able bodied convicts, in labor on the said canal, in such manner as may be thuugl t expedient. While the sheriff is engaged in carrying any convicts to the said prison, he shall have the like authority to demand the assistance of any cf the people of this state, as if he were acting in his proper county, and all persons shall be aiding and assis I ting such sheriff under the tame pen - i aities. The sum ofthree thousand dollars is hereby appropriated toward the building of the said prison, which shall be paid out of any aionty arising from the sales of lots at the permanent seat of government: Provided, That after all txpences lor the support of the convicts, cl )thing, Ecc. and suitable allowances to the officers of the prison are paid, the proportion ot the residue of their earnings, -which would belong to the stated according to the different sums p3id, shall be laid out in the purchase of canal stock for the benefit of the state, and the proportions belonging to individuals according to the amount by ihcm subscribed and paid, shall be apportioned in such mnnner, as the said managers may direct their said agent to contract with such individuals on their subscribing Sec. 12.
