At this Juncture iho marshal announced that ho had served nearly all the men In tho city, in trying to get a jury, and had failed. Ho asked bis Honor to give him a carte blanche to go out In the country outside of tho city limits. Some on# hero suggested to go up to Boone county, but tho marshal was aided by two or three assistants, and tho search was continued for a Jury. The publication made In tho Journal and the reason givou of tho wlmlp affair, hud to a certain exiont, forestalled public opinion and rendered It hard to get »jury. That Madam Dally was in the habit of leaving her money In the safe oftho defendant, whose place of business was within a few feet of her residence. That It was perhaps the marshal ofthedty who had made a raid on Madam Dailey and made n levy of about ninety dotlura as her share ol tho penalties lor keeping a house of prostitution. That she, having no money, sent for Warren Tate, who was getting shaved at LRllo’s Hotel, and he then went down and found the police In the house with Madam Halley and her girls, drinking wine and bumping the girls around and feeling their ankles. That the police then arrested tho defendant without any warrant, which the Major here argued waa without law or justice, and was wrong. She la known a portion Of the time by the name of Maggie Thoma*. Bhe has the reputation of being • prostitute, and stays at the residence or home of Jenny Dailey, which Is a bouse of ill fame. Warren Tate and Maggie Murphy were walking close together; as close as people generally walk together. 1 was a little north of and opposite the house of Jenny Dailey, on Nouth Now Jersey street, when 1 saw them walalng together on the opposite side of tho street. journed until eight o’clock.
At eight o'clock the court aaeembled and
the’ counsel in the case made lengthy arguments. Tho case was not submitted to the Jury until about eleven o’clock. After a brief consultation the jury returned a verdict for the defendent of "not guilty,” and he was im-
mediately discharged from custody.

Police Court.—Alfred Williams, an exgrocery keeper, had a little bill against one William Mann—a colored man and brother— for sundries long since eaten up, For some reason or other Mann failed to p»y tbo little bill, notwithstanding frequent presentations, until finally Williams got mad and confidentially informed Mr. Mann that he was tbe black male offspring of a female dog. Mann chose to consider himself provoked at this, and caused Williams to disburse $1105. If Mann had been disposed to be malicious, we think he might have made two cases against Williams. The mere fact of his presenting his bill was provocation to an assault and battery, without impugning the penu* of his respected maternal ancestor. Mary Holman, drunk, commuted her fine by ten days jail.
