Legal Vetera. By the Conatltutloe, the laws, and our form of government, each State, for ftself, regulates the qualification* of voters, who Shall vote. Congress, nor any other power, can prescribe wbo shall vote or who shall not vote. Then our Constitution is as follows: Section 1. All elections shall bo free and equal. Section 2. In all elections, not otherwise provided for In this Constitution, every while male citizen of the United States, of the age of twenty-one years and upwards, who snail have resided in the State during the aix months Immediately preceding such election, and every white male of foreign birth, of the age of twenty-one years and upwards, who shall have resided in tbe United States one year, and shall have resided in this State during the six months immediately preceding such election, and shall bave declared hi* intention to become a citizen of tbe United States, conformably to the laws of the United States on the subject of naturalization, «AaH be entitled lo vote in the township or precinct where he may reside. Section 8. TheGeneral Assembly shall bave power to deprive of tbe right of suffrage, and to render Ineligible any peraon convicted of an infamou* crime. A white person, within the meaning of thia provision, I* any one with more than sevsnsigoths of white blood. Tbero is no State law, nor State authority, to exclude a man from voting bocauae he baa been guilty of any crime or mtademeanor, unless be has been convicted thereof by a tribunal having Juriidlctlon of tbe offense charged. There is no |£fa(e late excluding a man from voting because, through accident, design, inability, or for any other oauae, he may have failed to answer to a draft,or to a roll call in the army. If such a law existed, the exclusion could not attach until he had been convicted by a tribunal having jurisdiction— as each individual may have had a legal excuse, if he bad been cited to trial; no mere order, or declaration, or entry, of an officer, can take the place of a tnal, where a man can show his defense, or excuse. But no such law exists tn this Stats, under which any attempt can be legally made to exclude persons falling within this class, If any there be. As to persons born tn foreign parts. A mi who bss been In this country one year, and in this State six months, and declared his intention lo become a cities*, is entitled to vote without bis Anal papers. He Is not obliged to produce bis papers, but may show tbe fact that be Is entitled to vote by bis own oath, if required, when he offers to vote, fudges of elections aro not, as a matter of course, compelled to receive a man’s ballot because be swears to facts showing he Is entitled to vote; but they reject it at their peril. That Is, suppose for Instance, a person evidently but fifteen or sixteen yean old,should sw-ar that be Is twenty-one, (or a bawd should swear that bar name was Olivxr p. Morton.) they would not bo bound, thereby, to reci lvo tbe vote. But if they wroagfnlty and oppressively refuse a vote, they are liable to a civil action and a criminal prosecution. If the person offering to vote swean to bl* rfgh’t, other evidence can not be heard by tbo judges, but they determine upon that. It he Insists upon bis right to vote, but refuse to be sworn, other witnesses may be hoard. A person offering to vote is not bound to answer any question as to the commission of crime or offense, dlsfranebtsing him; nor ens any evidence, except as to Identity Of person, be received other than the proper record evidence of conviction. * As to residence in the State, it muat have been for six months; as to the county, township or precinct, no fixed length of time is necessary, but the person must be located and and Intend, in good faith, permanently to remain in the township where be offers to vote. To be domiciled on business or pleasure, or for a temp'ji ary purpose, with intent to return to another place as home, is not a sufficient residence. A* to penalties: For voting or offering to vote illegally—fine not less than five nor more than one hundred dollars. Any offieer of election who shall knowingly, etc., refuse to receive a legal vote, shall be lined not less than ten nor mors than one hundred dollar* for each offoase—and for trying to Influence votes or for marking ticket*, etc., fine not more than one hundred dollars. As to any person who shall go from cm county to another, or from another State to this, with the fraudulent intent to vote—like punishment. As to any person wbo shall procure suck illegal vote* by money, asstatance or counsel— Boo not less than flfty nor more than One hundred dollars, to which may be added Imprisonment.

It was also resolved that they moat be whipped up to the work, and compelled to makes second effort. The " leyal ” people and the Grand Army heroes did not take Into consideration the fact that the reporters of tbe Journal bad completely exhausted themselves tn magnifying two penny affairs into tarrfbia upheavals of*universal patriotism, and consequently, when an occasion for a display of fine lying came around, fouid themselves utterly worn out and impotent. But tbe loyal men were determined to have aseeond attempt made to properly inflate the Inglorious fizzle of Thursday night, and the deacon of the box stuffing establishment—tbe same pious cuse wbo hired a man to do bis editorial work while he was In the Legislature and didn’t pay him for it—was pressed into the service. The second account of the Grand Army fizzle appears in Saturday’s issue, and consist# of half a column of meaningless glorification of brave deeds he was himself too cowardly to emulate. From this account we learn that we have a welkin somewhere about the city, and that it was mode to ring. We don’t know exactly what sort of a thing a welkin is, but presume it is some new fangled piece of loyal machinery Invented by Governor Morton. We learn, further^ that “ Tbe voices which made the welkin riag, were tbe very same which sounded along the slopes of Lookout, and rung through tbe thicket* of Shiloh and the Wlldeiuees.” We take issue with our hex stuffing, mob ' astigatlng neighbor. If the welkin rang at all—or, having rang, did not ring of its own free win and accord, a* becomes a good, loyal welkin, but only sounded ita grand diapason on compulsion, (if tbe worthy deacon had not been worn down by constant lying, he would certainly have got tbe diapason into bis article,) It was not tbe soldiers o( Lookout, Sbtloh and Ibe Wilderness, who coerced the ringing, but tbe little, barefooted, barebreeebed follows wbo make the vicinity of the Union Depot reverberate with their shouts of "Shine ’em up, sab?” They could not earn fifty cents easier than by carrying a paper lantern in tbe funereal proceasion, at tbe same time

BT At the Circle, on Saturday night, a man made a speech who says he is a Christian minister, and that bs would rather go to b—1 with negroes than to go to heaven with white r«b<l*. Be tiw* arraign* God’s wisdom ss to final rewards and punishments. He says he Is, npon a certain contingency, in favor of destroying the people and property of tbe South with fire and sword, reselling the lands, and repeopling tbs country; and that be is a Christian. He says bis health was shattered by lying ^n prison, when it is well known It is not so—but by bis debaucheries. He once abused all anti slavery men as fiends of b—1, and imps of the D—l, using his own chaste Isagusge. These same men, in view of his estimate of them, are now feasting him, and exhibiting him as they would a pet hyena. He, for years, oontanded that slavery was a divine Institution; and denounced every man who differed with him as an atheistical reprobate. Could tbh rebellion change tbe decree* of God as to the divinity of slavery. If K wan divine? It pays better now to be bawling radical Ism—therefore he bawls. Need we name him?

XlcDonnld—Vsorhees. The Journal of Saturday morning started up like a rocket, on these men, and esme down like a stick. It bad previously urged Ita followers to rote ogamstconacrvativc candidate* for the Legislature, because, if elected, sud men might cast their votes against Morton for United States Senator. To that we could only reply that such was the very thing we wanted them to do. Because the name of Mr. Voorhef-s had, by It—not by us, been mentioned in the same connection, it seizes hold of our statement that wo wanted men to vote with the understanding that tbe purpose was to beat Morton, and goes off into a conniption fit, over tbe supposition of lu own, that McDonald wa* not, and Vooriief^ was, the candidate, etc. To quiet the nerves of that delectable sheet, we would state that neither McDonald nor Voohuv.m are now candidates for the Senatorsbip. Whether both or either will hereafter be, depends, no doubt, upon clrcum. stances over which the Journal editor can (as editor) have no control—although one of tbe proprietors may bave, unless he is very much misrepresented by men of bis own party who profess to know whereof they speak, when they say he can make more votes to his pa/ty In onc'night, than all their speakers can fh a whole canvass. Perhaps this was the way the editor qf the Journal—m friend of Morton— hoped to be elected to tbe Legislature—and, perhaps, this will explain tbe reason that paper has not, aa yet, spoken in favor of a fair, honest election this fall—has really turned a cold shoulder to all attempts at a division of election boards.

13-That tbe radical candidates for the Legislature are In favor of a severe, rigid liquor law, perhapa, equal to that of ISM-3, which punished tbe " use or sale of spirituous, vinous or malt liquors,” by any one, unless he wa* appointed to so act by the county board. This, we have several times shown to have received the sanction of one of these men, if it was not drafted by him and Coburn. W# bave labored to get them to come out over their own signatures, in favor oi or against ■uch a Uw. They utterly refuse to so commit themselves, while it is known, that they are secretly and privately pledged to tbe temperance leage, to favor such laws.

t3T The radicals claim to have great veneration for the memory of Mr. Lincoln, and pretend that, In prescribing unheard of conditlona on the Southern States, they are carrying out hia policy. In 1862 Mr. Lincoln pubHsbed a letter, from which the following is an extract:

“ My paramount object is to aave the Union, and not either to save or deatroy slavery. If I could save the Union without freeing any slaves I would do It, and if I could aave it by freeing all the slaves, I would do It; and if I could save it by freeing some and leaving others alone, I would also do that. What I do about slavery and tbe colored race I do be*ami I believe it help* to save the Union; and what I forbear, I forbear because I do not believe it would help to aave tbo Union. Row strangely these wise and patriotic sentiments, coming back to us from tbe grave, aa It were, look when placed side by aide with the revolutionary and unconstitational eaptiouaness of a radical Congreaa? How graat the contrast between tbe earnest longing of Mr. Lincoln for a restored Union and the devilish lust of power and plunder which characterizes tbe radical Congress?
