We have accordingly interchanged communications with a majority cf the judges of the Mipremo Court and do not lind a jx-rfect accord cf opinion on the question of jurisdiction. In this ease we have considered what we ought to do. The question I not w hether the acciw-d have Wn guilty of murder and ought to suffer death. But the difficult point is whether they ought to le tried and punnhed by a I'nited States Court, or by a state Court, and thisijuestion should be settled bv a formal adjudication of the Miprenie Court at Wushton. Fnless the question I certified to the Supreme Court, a derision cannot be had, because Congress ha made no provision, even in a case w here the js tialty i death, for an apeal or writ of error. We have, therefore, felt it our duty to certify the question to the supreme Court. As tlnafe ha been no session ofthat Court since these prisoners were tried, an earlier cut rv of the order of the Court wa not imiortant. "By the rules of the Supreme Court, this question can 1h heard and decided at the enduing term, if the Attorney (ioncral requests it. Certifying the question in one of the cases w ill suffice, because precisely the same question arises in all. An entrr w ill, therefore, be made in the ease (ieorge V.
