When tbe Supreme Court of Indiana decided in tbe case of Gairrix vs. Wilcox, 21st Indiana, that the section of the act of tbe 3d of March. 1C3, exempting from liability any per on who committed outrages upon tbe citizens by or J er of the President, that Court was denounced without stint, because it would not sanction lawlessness, military and mob tyranny. We take the following from the Nashville Union: We published, a short time since, a brief article in regard to a decision by Judge Smalley, in the United Slates Circuit Court for Yermoot

A very interesting and important cae has recently been tried iu the United States Circuit . Court fur Vermont, held at Rutland, before Judge Smaller. It was an action for auault and battery and false imprisonment, brought by Hiram Walker, a manufacturer of Burlington, against C. R. Crane, Assistant i'rovoit Marnbal of the Unite I Stales for tbe First Congresional District oT Vermont. Tbe trial is reported at length in tbe Montpelier Argus and Patriot, from which we condense the material facti in tbe case. Tbe plaintiff went to Rutland in August, 1 b63, for the purpose of enlisting a substitute for a young man in bis employment. lie made arrangement with one Norton, who was on bis wsy to Rutland with three Canadians to be en1 ited, to furnish him with one of those men. Norton made a contract with the Selectmen of Rutland, for tbe other two men. Upon going up to the I'rovost Marshal's office to pay off bis man, tbe plaintiff was rodelj accosted, charged with being a substitute broker, and thrust down stairs. Some words ensued, when defendant arretted pUint.ff, and confined him in Rutland jail, in the common room with vagrants and criminals, but shortly after be was taken out by a squad of soldiers and diOharged. The detendaut was subsequently sett fur to go to the Provost's office to pay hia man, wbicb be did. Tbe defendant put in the order of the Provost Marshal General of Vermont to exclude from bis office bounty and substitute brokeis. lie also put in evidence for the purpose of shoeing tbat filaintiff negotiated with tbe selectmen of Itutaod for the sale of three Canadians; that he was interested in tbe contract wbich had beeu made with them; that they closed the contract with him and Norton, jointly, and that plaintiff did not deny he wss a bounty broker. Defendant also put in evidence an opinion of William Whiting, Solicitor of the War Department, giving a construction to certain sections in the Enrollment Act, wbich bad been published by tbe Department, in a circular form, for the guidance of Provost Marshals. The plaintiff put in evidence to show that he was not and never bad been in any way a substitute broker, and that be had no interest whatever in tbe c; ntract with tbe Canadians, except to obtain one as a substitute. It was claimed for the defendant that be was justified under the orders he had received, in excluding the plaintiff from the office, and the entrance to it, on account of his being a substitute broker; thit the plaintiff was guilty of an offence against tbe Knrollment Act, in threatening and obstructing an officer of the Government; ano lb it the defendant was justified in summarily arresting bim under a section of the Act of March 3, I5b3, which is as follows: "And be it further enacted. That any orJerof the President, or under bis authority, mad at any time during the existence of this rebellion, shall be a defense in all courts to any action or prosecution, civil or criminal, pending or to be commenced for any euch, seizure, arrest or imprisonment, made, done or committed, or acts omitted O be doue, uuder and by virtue of such
order, or under color of any act of Coogre; and such defense may be made by special plea, or under the general insue." Tbe defendant further claimed that pending tbe rebellion, the military authority was paramount to the civil, and tbat summary arrests under martial law wer justifiable and proper, and constituted no cau.e of action. Judge Smaller, in charging the jery, ruled that the section in the act of March 3, lbC3, above quoted, was in violation of the Constitution of tbe United Stttes, and afforded no protection for act done under the authority of that section; that the language used by tbe plaintiff did cot amount to anj offense againtt the Knrollment Act; also, that the opinion of Whiting in regard to the construction of tbat act was erroneous; and that martial law not having beeu declared io Vermont, the civil law remaioed in full force, and was cot subordinste to military authority, lie submitted the question of damages to the jury, ruling tbat if defendant honestly be lieved, and bad reason to believe, that the plaintiff was a substitute broker, and came within the effect of the order to exclude persons of tbat description, it should go in oitiatien of damage, even if the fact euouM be found to b otherwise. Tbat the negro should, as an inhabitant of the country, be allowed all bis civil rights, have the protection of the laws, in his subordinate relation, all will admit; but it is believed tbat it will be attended with untold evils to both racei, if be is associated with tbe white man aa an equal in its administration of tbe Government. Bat this policy of tbe Democracy cannot be carried out, for the reason that the right of suffrage is conferred by tbe States severally, and some of them have already conferred it on the negro; and others will do so they mut do so, where the Republicans are in power, to maintain their consistencj in claiming tbat tbe Southern States shall be required to confer it, as a condi lion of having a just representation in Congress. All the Democrats can do, on the negro question in Indiana, therefore, is: 1. To oppose negro suffrage in Indiana. 51. To oppose, in Congress, measures calculated to force negro suffrage on the Southern States. Ilow, then, can we preserve this country from being Mexicanized? From the evils which Governor Mortojt admits must follow such an event?

Nothing could more cleirlj demooetrato that the amendment should be entitled, an amendment to deprive the Southern States of a large portion of their Representatives, and reduce them to belplesness. This is Northern fairness to the Southern members of our Union. It appears, also, that tbe Journal holds tbe doctrine that, in our Government, the people are not represented, but voters. It seems that it is a time-honored prin ciple with tbe Republicans, to disregard and mu tilate our Federal Constitution, so far as, by so doing, they can harras and opprem the South. 17Secretary Seward, iu a 1 iter to Gov. The M. E. Church, North, recently attempted to forcibly obuin poscession of a M. E. Church in Pike county, Mo. The case came beloreaJud?e of that county, who decided io favor of tbe Northern party. An appeal was taken to the Supreme Court of Missouri, which reversed the decision. The Columbia (Tenn.) Herald, of the 4th inst , says: "The colored troop heretofore doing provost duty at this placp, left for part unknown last Sunday. The ci'v has been unuullv quit during the week, and we doubt if a wore orderly, law abiding community can be found an j where, Notta or South." An asignation house, kept by Mrs. Jennie Wood, in Chicago, wss blown up a few eights iure. A tan of powder with a fuse attached was thrown through the window. There are Ciö convicts in the Ohio Penitentiary, thirty-one of them b'ing females. C. A. Read k Co., of Cleveland have suspended payment ar,d closed their doors. Another amendment to the Constitution of the United Stttes is proposed by leading Radical?, i. e. SAactioning all Union debts contracted in the war, and ignoring all debts created in attempting to overthrow the Union; and that all the Southern States be required to adopt it before recognition. It is reported that President Johason in a conversation with .nrf John Covode, of Pennsylvania, said tbat Kentucky was giving bim more trouble than any other State in the Union.
