It places every public journal, every ,iwr r,f the bar. and every private citien absolutely at the mercy of a Judge who may deem criticism upon his actions contempt. Under the statutes which tha Lill repeals, puuihment of this offense -vaa a fine not to exceed ?250 or 30 days' imprisonment; but the fair publication of the proceedings of any court was sanctioned bv the statute ana am no iviusmuw contempt. Under the new law, the common law a Judge has absolute right to decide what constitutes a contempt, who is the guilty party, what shall be his punishment and how it shall be inflicted. If the t3ovornor signs the bill, any paper in New York publishing the proceedings of Barnard's court, fairly or uufairly, respectfully or buried under periods of denunciation, renders its conductors liable to be summoned by Barnard before Barnard, by Barnard indicted, by him tried without the attendance of council or the presence of a jury; by Barnard convicted, by Barnard sentedced to a fine of tea dollars or a hundred thousaud, and by Barnard relegated to prison for any length of time, from one month to twenty years.
