FIFTH DAY.
Morning, Jan. !3, 1847. ; at 9 o'clock. Pending the reading of tha minntaa, Oooding morad to anand tba Journal by striking out all that part relating to what was done alto tha vacation of the Chair on Monday, by Liot Governor Willanl, and before tha occupancy of it by Lieut. Governor Hammond. II waat abled by ayes 27, nays 22. By Saga, that tha Committee on tha J udiciary be instructed to inquire into the legality and constitutionality of tha occupancy of tha Chair of tha senate by A. A. Hammond, and report to the sanata. A preamble to the resolutions recites the proceedings of yesterday, prariona to the inauguration of Got. Willard, and refers to the clauses in the Constitution which require that tho rotes for Governor and Li an ten ant Governor to be opan and trabtiahed in both Houses. Iu a speech in support of the resolution, Mr. Sage said he was glad of the exchange, in looks, at leaet, in tha presiding officer. Ha had heard through Madam Rumor that tho present President of the Senate had misgivings as to tha legality of his inangnraL Perhaps the new LieL Governor did not know all ha crooks, twist and turns of tba Democratic party, as he had understood that he was only a recent conTrt to the Democratic party, having been feared in the old Whig organisation. He hoped the resolution would be adopted, and an invtttigarion had. Gooding wished to know if the Democratic side of the senate was to have no peace. He wished to know how far the opposition would go in their warfare against government. He knew nothing of tha joint convention in the Houae yesterday. Its adjournment was unknown to him. Ha waa for no tricks, and no dishonorable acta. He wanted to elect two U. S. Senators, but he desired to do it legally and honorably. Ha made an extended speech, reviewing tha action of tho Republican Senators, and censuring their conduct. They had taken all power from the presiding officer in the appointment of committees, fec, and now they propose to take the Chair itself from him. He moved to indefinitely postpone the resolution. A message from Gov. Willard authorized Samuel Osborn to make communications from the oxecutive Department to the senate during its session. Murray asked Gooding if ho recollect ed when he Gooding, as a Whig, denounced Mr. Bright, aa President of the Senate, for giving hUoastiug vote toward postponing the election of U. S. Soaator himself. Murray thought a moral lecture from tha senator from Hancock, which ho had bajn reading the Republicans, came with an ill grace from him, when he had been suataiuing, for two years, the acta of a Democratic senate that refuaed to do what the senator now call constitutional acts. Ha denied tba charge made that the senate refuaed yesterday to go into joint convention. While the senate was making the necessary arrangements to go into the House, the then President. of the senate detivered hie valedictory, marched down and want into the Hall of tho House of Representatives, on invitation of the speaker of the House, by a private note, thirtyfive minutes prior to tho timu when tho House itself, by its own action, had invited the senate to meet with them in their end of the capitol to witness the inauguration of tha new Governor. Tba tenntor from Hancock talked of revolution, but he was happy to say that the Repub leans were not responsible for tha inauguration of that revolution. This senate waa elected undor tho proclamation of Governor Wright and not by a law of tba General assembly ns tho Constitution renuired. Murray reviewed tho action of Gov. Tho Journal was therefore correct. SIXTH DAY. Wednesday morning, Jan. 14. Senate met at 9 o'clock. A messeage from the Governor announced the resignation of Gordon Tanner as State Librarian, and a consequent vacation in that office. RESOLUTIONS. By Sage, that 2000 copies of the Governor's Meeaage delivered before the House of Representatives on the 9th inst., and 2,000 copies of tho Inaugural Address delivered before tho Houso of Representatives on the 12th inst., be printed for the use of tho Senate. Anamendment proposed by 77efren to strike out "Home of Representative," and insert "Legislature" was tabled by 26 ayoa to 1 9 nays. By Yaryan, that the message from tho Governor referring to tho State Library and tho vacancy in the office of the State Librarian, bo referred to the committee ou state Library. By Yaryan, that the Judiciary committee be instructed to inquire into the expediency of repealing all valuation and appraisement laws, dec. JOINT RESOLUTIONS. The Senate occupied a largo portion of the morning session in discussing amendments on the second reading of tho bill for tho rejveal of tho present statuto rul.it -ing to divorcements. A message from the ouse announced the passage of a resolution, and requesting tho concurrence of tho Senate, for the election of a Sute Librarian, iu joint convention, on Saturday, at 10 o'clock. The ouso message for the election of a State Librarian on Saturday in Joint Convention was tabled. Ayes 25, nays 21. Murray offered a resolution, requesting the concurrence of the Zrouso, that John D. Dillon be elected State Librarian for two years, A motion to lay on the tablo was lost. Tho resolution was adopted. Ayes 26, nays 21. On motion, the Senate adjourned. Wednesday morning, Jan. 14. for a joint convention, on Monday, was tabled by 27 ayes to 20 nays. On motion, the senate adjourned until to morrow morning at 9 o'clock. Friday morning, Jan. 16. The House met By Wiley, to so amend the act relative to free banks, as to prohibit themjfrom issuing notes of a less denomination than ten dollars. Marvin offered an imperative resolution, requiring a bill to be reported repealing that part of tho school law which levies a tax of 10 cents for the support of public schools. (Studabaker opposed this resolution. It was an imperative one, and we were uot prepared to determine so important a question. The Constitution requires a system of common schools to be sustained, and as this resolution was calculated to destroy it; he considered it unconstitutional. Herod considered the present system unequal and unjust it was based on wrong principles becauso tho means raised to upportit were not equal. As welljnight we require tho State to provitlo clothing for tho children, if, as is urged, we should provido for their education at tho common expense, because they are tho children of the State. Conner, of Wabash, thought the resolution premature. After further debate, tho resolution was laid on the tablo Ayes 68, noes 34. This voto may bo regarded as a test of the opinion of the Houso in favor of retaining a school tax. Whether it it will be increased, is a question not decided. Ou motion, the House adjourned.
