Our organisation at that time was only to protect ourselves against any and all who should come against us I to destroy our livea and property. It was not our purpose lo resist the Territorial law; our organisation had nothing to do with or against lite laws; it was not the purpose of the people of Lawrence to resist the wriis of the rosSerilf; I beard people say if the Sheriff has any writs let him come and arrest them. It was not the purpose of the peoI pie of Lawrenee 10 resist Governor Shannon, it be came with militia of the Territory alone, but they were determined to resfet the Misjourians who came up. The principal important testimony subsequent to this, was that of N. B. Blooton, who deposed substantially that be was one of the Judges of Election, at a poll five miles from Lawroe, at the Spring Election; snd that a body of about a hundred Missourians endeavored first to persuade him to buy, and then to threaten him, into receiving thuir votes. He stated that he resigned before voting lime! 1 did not eo out and see any ot the del egates when they came in, but when they arrived the fact would be announced by cheers and speeches. A great deal of drinking was done, and threats made against "the abolitionists " There was no free State ticket there that day. We contemplated having one, but on ascertaining that they intended to come over in overwhelming forces, we abandoned the idea. We could have carried the day by a large majority if the Missourians hnd remained at home. I had a list of the actual settlers who voted on that day, but my house was burned donrn during the invasion and the list with it. These men got to fighting among themselves. I sw an old man and a boy, about ten years of age, who were beaten by them, and were brused and bloody. These men wer armed. I heard persons declare, at Weston, Mo., that ibey were coming over. I heard it publicly announced that these men ?ame from Missouri Mr. Kellogg, a pro-slavery man, who was a candidate, refused to run because the Missourians came over to vote. If any man had protested against the election, his life would have been in danger. I refused to sign the oertificstes to the Governor stating that the election was fuirly held. E. R. Zimmerman, sworn. I came here in December, 1864, from Pennsylvania. I settled in Kickupoo, and have resided in that distriot ever since. I was one of the judges of eUclion on the 3Uth Msrcb, st Hayes, about seven miles Irom Kickapoo. I went the afternoon before election to Hayes, and saw camp-fires all around. Next morning only one of the other judges tppointed by Gov. Reeder, appeared at the polls Thompson. A crowd of strangers soon began to gather round, demanding that the polls be opened our residents left. Thompson and I sppoin'ed another judge, and selected two slerks. I had considerable dimeulty in getting the judges to open the polls. They would go out snd whisper i the crowd outside. They were POth pro-slavery men. We agreed to an oath to administer to the Voters. The first man that eame up in answer to thu oath, be said. "I'm bet." lie finally to k the oath, swearing he was a resident. By Mr. Whiitield I waa asked by Robert Riddle, of Leavenworth, to distribute them 1 understood thai the movement for a State organization was not part'eipated in by one party alone. I know of many pro slavery men who voted for the Constitution. I was never at any meeting whore they resolved they would repudiate the laws. 1 was at a meeting at Leavenworlh when the objeet of the State movement whs stated by Mr. Ptirro't to be to noumute delegates for a Con--liiuiiunal Convention to be voted for by the people. Pro-slavery men were nominated as candidates at this
