THE AMERICAN.
Joha 8. Eeid It U due to the public tht I should reply to the article M John 8. Reid, published last week in the Indiana American, Conner vi lie Telegmph, and Franklin Democrat. I regret that the editors of the two latter paper should see proper not to publish my first article in regard to Judge Reid. In that article I made charges against the official conduct of Judge Reid, which, if true, the people ought to know. Ia regard to aueh publications, every gentleman conducting a public journal mast act on his own convictions of duty and propriety, and consequently I have no complaint to mske. Yet it would have suited my ideas of justice better, to have my article published with, or in the same papers in which the Judges answer appears, and then let the public who are interested, determine the question. Judge Reid, and those disposed to excuse or justify his conduct, desire to divert attention from the charges, by imputing my action to improper motives. It is said that I am a disappointed aspirant for office enter tain (eel tags of envy and jealousy at Raid's promotion and political success. These imputations I desire to say, are simply ridiculous. If I know myself, there is not in all my composition, character or conduct, a particle of envy, ill-will or jealousy towards nay man, living or dead; and nothing earthly, give me more unalloyed satisfaction, than the prosperity and success of all those around see: and I never did desire success, by prostrating, or at the expense of other. And, though my political principles and predüictions .are established, and well nown ia the narrow eirele of my own acquaintance, I think, without egotism, I can truthfully say, I possess cry fsw of the elements of a partisan I have no friends to reward no enemies'to punish no tool to put forward no aspirations for office, and simply wish to discharge my duties as aoj humble ci tinea. To show the utter fallacy of these imputations I must make a statement. The Hon. Henry Berry, Sen., as sterling a democrat as ever lived, and ae honesta man as God ever made, presided as Judge of the Probate Court of Franklin county, Cor near 20 years, to the entire satisfaction of our whole be:- and the suitors of his court; was re-elected twice without opposition; and the records of his court will show, that on his retirement, the bar and officers of his court, without distinction of party, unanimously and spontaneously evidenced their repeot for and confidence in him a a man and judge, by resolutions which spoke their sentiThis was what was done by and for the Democratic Judge Berry. On the other hand Judge Reid, in leaf than four years, has so outraged the rules of propriety tho feelings and rights of counsel and parties, that those who have been most intimately associated with hin in the administration of justice, and best know his crooked devices, loathe and detest him most. And today, aside from the outside pressuie of political influence, th re are but few " " members of the tmr in the Diftriot who siflottrelr desire his re-elwetion ho siaoereir desire Tbe detail of his The detail of his conduct on I conduct on the ' tt.mi.lt in ilia Aim rnforrml tn in mW r- r ücle published in the American of the j L11.L..1 .L- a : t i 18th tnst., are literally tote and I was so utterly overwhelmed with indignation, at nie wanton and unprovoked official oppression, thai I could scarcely find language to express my feelings, and because I used language not to be misunderstood, he and his parti - sans say that I was abusive. "BaooavtLLB, May A, 1850. Messrs. Oeorge Holland and John 8. Reid, bath baviog referred to us for the feet as they occured under our observation in tbe Common Pleas Court on the day of April 1656, we re spond rather as sr biters than other wise, and make a plain statement, confined to the fscts in the esse. Tbe oase referred to by tbe psrtiee in their statement msde to the public, being ready for trial, tbe plaintiff proposed to swear aeveral of the defend ants as witnesses' to which Mr. Holland ob jested as connsel for two of the defendants who were absent. The Judge promptly ruled that the defendants ooold oot be witnesses. When the object aad purpose of the testimony was explained, the Court admitted to bare misunderstood tbe purpose, and decided that the defendants could be sissssietTl and directed that they should be worn, to which Mr. Holland objected, when the Judge remarked thnt be was satisfied that he was right and for plaiatisT t proeeed to have the whsums swore. Mr. Holland then remarked that be wished first to be beard to hie objections and have time to examine taw law on the saDiect, to a, .a a w iat at a e whkh the Jadiie rtrattad. that be had had the ueeuon before hi hereto
fore and had decided it, and (hat the i
! plaintiff should proceed to swear the j witness. Mr. Holland then wrote n I bill of exception? to tin-point named, which was signed by the Judge. The defendants were sworn as wit- j nesses when the plaintiff proposed to J prove by them, the statements of tbo deceased Mr. Woodworth, his ioten- j tions and understanding as to certain funds loaned or advanced to Brookbank a son-in-law, which funds it was
alleged in the plaintiffs petition were 1 said plaintiff do recover against said advancements made to the daughter 'defendant, the said sum of 9724,43 to of Woodworth the then wife of Brook-! be levied and made of) the goods and bank, since a widow, end now Mr. chattels of the said deceased, in the Wood one of the defendants, to which hands of the said administrator, and it Mr. HoHsod objected, insisting that is ordered by the court, that said adthe evidence should be confined to ministrator do pay fifty cents on the the statements or admissions made at dollar on said sum so recovered as
the time of making the loan or advancement. The Court overruled the objettioe and allowed the questions asked; when Mr. Holland enquired of the Judge if ho was taking down the testimony. The Judge replied that he was taking down such as be wanted or chose. Mr. Holland then remarked, that he wished all the testimony taken down: the Judge repeated, that be would only take down such as he chose or wanted, when Mr. Holland said, "if the court will not take it al down. I wish to take it down myself," to which the Judie replied "vou can the Judge replied "you can 1 write what you please-" Mr. Holland loos nis seat ana commenced writing. The Judge urged the examination of the witnesses, when in answer tu a request of Mr. Holland for time to get down all of the testimony the Judge said, "You can't have it." Mr. Holland then arose and said "this is a curious way of doing business and I buliere my clients nave no rights recognised here" and asked if the Judge would sign a bill of exceptions, "that the Judge would neither take down the witnesses testimony nor allow time for the counsel to do so," to which the Judge responded "no I will not." Mr. Holland again took his seat, and wrote out his bill of exceptions, and tendered it to tha Judge for inspection and and signature. The Judge peremptorily refused to have it read, sign or allow it. Mr. Holland then remarked asjhis clients' rights were n ot recognised by the court he would abandon the case, and, taking his hat in band, walked out of the oourt room, remarkiag as ha left, that he would appeal to the country for their maintainsnce. JNO. H. FAKQriI AR. WILSON MORROW. " I had reason to believe when I wrote my first article, the course that would be pursued by Reid and his friends. And bad I consulted my own ease, I should have remained silent. But had I done so, I would have felt myself guilty of moral cowardice and recreant to duty. I felt that in Raid's court I did every thing for my client which it was in my power to do; unless I had seen proper to turn the tempi'of justice into a Bear Garden, and by fore, or an appeal to the bystanders. t . . a a got into a personal conflict with Reid, u l:u f r -i i ij i I ujr wu.t... t ,,i, t wou.uprrn.tps .on,my own Stir respect, and iritre Him ' nl-,ihU nrtnr- f ,e Uim m,..r some plsusiblo pretence for his unwsr-,,. rintible OondUOt. 1 he whole feAtuis res ofthec.se w.th . probable enscqueness pitswd rapidly in my mind, before I left the court house; sud sober socI .t s . u B"1 -pproTe my course. l V 1 WW I i mi. , . a ... ..
