(Front th Indianapolis Republican, No Apportionment law. Ptrhap th ruost rcmarkabl incident which marks tho tr.injre CTeut ful hUtory of tlio recent union of tue Uencral Assembly, wu the fail ur to pnM an apportionment lair. Without pasting such a Uw, it in sup Tono(l that no new Aaaembly can bo legally elected, and thus by n diso beyal of tut Constitution, iho Itcpre aenUtive and LrghtlaUlo feature of tho government U abrogated, tho chief Republican idea act aside, and practical and real despotism established. Tho onlj remedy, is an appeal to Congress, or a Convention of ino people. Tho refiuircment of tho Stato Contitulion, which are clear and positive, touching this important matter to at follows: Stfo. 4. "The General Assembly, shall at its ttcon'l session after (ho adoption of this Constitution, and every sixth yoar , theieafter, c.iuo an enumeration to to nuilo of all the whito malo inhabitants over tho a-'o of twenty-ono years. See, 5. The number of Senators and Representatives hall, at the tion next following each period of ma liny tack enumeration, it Jixed by law and apportioned amonu tho several counties, according to tho number of whito mala inhabitants, above twenty one ye am of ago, in each: Provided, that the first and second elections of members of the General Assembly, under this Constitution, shall bo according to tho apportionment, last made. K'kjIK. The first general election under this Constitution shi.II bo held in tho year one thousand eight hundred filty-two. SdtJuls. From this it seems to bo conclusive, that even if the Governor should call an extra suasion of the present General Assmbly the defect could not bo con stitutionallv cured. Tho Government U de facto in a revolutionized condition. It is well for us perhaps that the U. 8. Constitution guarantees to us a republican form of Government, for wo know it to bj trui that somo of our politicians would be glad to abolish it if they could. Z3TYe believe it is tho Ohio State Journal that relatej tho causo and provocation of a law suit as herein after set forth. Tho mcsmcrizerwas badly taken and 'done' as soundly as the An itiaercnt mcsmerizer, who, for some time past has been extendinghis peregrinations through this nnd the neighboring counties, wis, ono evening expatiating largely upon the wonders and extraordinary powers of mesmerism, and, among other strange things, ho said that he could mesmerise boiling water to such a degree that it would not contain the least portion of heat, and to prove it to tho satisfiction of all present, he offered to bet fifty dollars that' an egg might be put into the boiling water anJ remain there half an hour, and when taken out, it hlitmld be in the same, condition as when newly laid. A rather green looking individual' standing by, dryly remarked, as he pulled out his pocket book, and taking therefrom fifty dollars. 'I'll take that bet, cover this The mesmerizer not suspecting such prompt action on tho part of any one of his h arcrs, was rather tuktm aback, but seeing no means of retreat, he rather unwillingly rummaged his pockets, but could find only forty dollars. 'Never mind; that'll do,1 said tho green looking one, 'wo'll make tho bet fort dollars and the squire here shall hold tho stakes, and to-morrow we'll try the experiment.' In vain the mesmerizer tried to reason with his belting friend; in vain he told him that he knew he should win his money, that he had tried tho experiment often, and hs he was a very clev tr fellow, ho should regret exceedingly tobe compelled to tako his money. Öutthe green 'un refused to back out, he was a great lover of science, and he wanted to see tho power of mesmerism tested upon the boiling egg. The next day came and with it a crowd to witness the experiment. The water was brought, tho fire was kindled, the pot was put on, and after the water was seen to bo in a boiling condition, the egg was put in, and re ined half an hour. The whole power of mesmerism was applied to the pot and its contents, and when the ez2 was taken out it wes lound to be boiled as hard hs as nard hs Hard as an egg might be expected to be, after boiling half an hour. Tho Squire handed aver tho forty dollars that had been staked upon the result, together with his own money, to the green one, and the mesmerizer now brings suit to re cover back his money. Tho trial U expected ta come olT next week. Evading the Temperance law. The most outrageous and blaaplicnous proceeding ever heard of in thi country, free country as it is, was a dodge of some (trtnan beer houu keepers in New York, contrived for the purpose of evading the Sunday liquor law which was bvinj rigidly enforced by Mayor Wood. The idea was to have sham religious services on Sunday at which beer was tobe used as sacrament, aud then a collection was to bo tilt: a up to pay fho preacher, who w; s personated by the owner of the hou In tho bar rtnd billiard room, No. 143 Chatham street, a mock alt r was erected on a billiard table, wax candle wero placed near it, tho shutters closed, and the room lighted with gns. Tho proprie terofthe establishment, Lewis Decker, was dressed in a long black clerical robe, white neckerchief and black skull cap. At 10 o'clock Mr. I)., took a seat near tho alter aad apologized to bis congregation for not having commenced tb.) exercises earlier, gh ing as a reason for the delay, that hi . .. ,. .... two chaplains iiau not arrived, having, he presumed, been drunk over Satur day night, the samo as all other mit J ' isters. AnJ, alter waning tor the pretented chaplains for sometime, he called his har-keekcrs to cflicintc in their stead, and they donned clerical robe, tied tablecloths around their necks by way of whito neckerchiefs, and served the company wi h betr. Tho proprietor of the housd read pa sages from the Bible, and exhorted the company, as "'Independent Free Thicker,' 'to do their own thinkini . a . eara e anumeir own unnking. ino services lasted all day, and tho congicgatun numbered near four hundred. Mayor Wood : ays thtco aro several such pla cet in.New York, all of which he is
defrrrninc il to tunnress. A act of
men who would thus defy and revile tho ordinances of God and man should be most signally punched. CV. Cowl. Tho Admlnl.tratioa breakdown In New llfunpshlre. Tho late election in New Hampshire it tho most fatal Llow.thnt the Ucmo cralio party has ever received from a Stale olcction. It proves beyond doubt that tho ndminiitnUion of Mr. Picrco is not only unpopular, but that tho Democratic party is dead. For the first time in nearly thirty years, Massachusetts and iSew Hampshire st ind politically as they do geographically, side by side. They will bo represented in the next Congruss by mui having the same party alfinities, and present a solemn phalanx in opposition to tho administration. The election shows that tho American candidate for Governor i elected by from two to thrco hundred majority over all others. . Tho Whigs' and tree Soilers have gono almost in a body for the American candidate. Tho most important victory, howervr! is in tho hirire American majority in the Legislature, which secures tho election of two opposition United States Senators, one of whom will unquestionably bo John 1'. Hale, und tho other is likely to bo James Dell, the gentleman who consented to run ns tho Whig candidate for Governor in tho lato race. It may turn out, however, that Edmund liurko will bo tho S-n a tor in tho place of liell. Two years ago tho State, gave Franklin Pierce for President, 7,165 maioritr over both Scott and Hale. Tho State was represented in the last Congress by two administration Senators, and three administration representatives. In tho next Congress, it will bo represented by two Senators 1. i I iv.rji. uku w. opposite character. The change is nt.lhcl, and tho victory complete. Cm. Uivettc. Takino'it Coot. 'Your houso is on fire, air," said a stranger, rushing into i he parlor of a sober citizen. OV TUR . TWENTY-THIRD VOLUME OF THE INDIANA AMERICAN. cO The alarm that was caused by the hard t.'mes, which was resulting in csuslnjr many papers to suepend entirely, and sellout, and which caused many old and cttablicd papers to reduce their, dimensions, deterred us from making the enlargement we had contemplated, at the beginning ol the volumn. Thoujh thwar. tod, for the time being, we still kept our purpose, in view, and now present the patrons and borrows of tho American, The Largest Paper in Indiana.
And, if It Is ne4 the best paper, it shall not bo for want of unceasing application to Its interests, on tho part of its editor. When we took charütf of the American, some sixteen months ago, it was not without many a fear that we would not be able to retain its large subscription list. Dut this has constantly increased, notwithstanding tho discouraging clrcumtanccs of the past year, and we now have a circulation that justifies the expenditure we have made in enlarging. In addition to the embarrassment which grew out of our want of experienco as an editor, we were somewhat alarmed at the fears of many personal friends. They thought it impossible for us to succeed, unless wo should consent to become the' Organ of some party. Dut having Jong ago settled in our mind that parties will become corrupt, aud that they are usually kept in ex Istenco for the lenrliit of a few aspirants, we determined to pursue our chosen course, and fail, if fail we must, In attempting to publish a paper that should be truly independent. The readers of the American know full well, that we do not in cqn by being independent, that we Will not tske sides for or against the question at isaue. It has not been hard to tell on which sldo of any question we have been, nor shall if be in future. We mean to sny, that no caucus or convention, no wljwam or council, or tribe, shall dictate what we may say or may not say. We know everybody knows, that a paper that sells itielf to party, must leave un reproved tho political blunders or dishonesties of its party, and distort and misrepresent tho acta of its opponents. We havo certainly triad to avoid theso errors, and shall continue to try in future. How far we have succeeded , we leave with our candid, conttant readers. How far we shall succeed in future, must be judged - the future. by the questions now at issue, we need not define our position. It Is not an equivocal one, as our reaJers well know. On the questions to srise, we shall
speak when they come up; without fear, master how we may speak. Hence the . ü mmm But our readers will want, not only

Mseuns and Odd Fellows, and benevolent men of all classes, will no doubt confer a fuvcr upon many on orphan, and widow, by calling' their attention to our ternie, in regard tolhein. If thy arc too poor to rnie even a dollar, wo will join with any benevolent persons in raising it f them, if there is not benevolence enough in thfir Wnmediatc neighborhood- fur that purpose. He it remembered that we ntk no man to take the paper merely to support it. From present appearances, it will live and tKnirih without such suba-criberi, though it receives neither state, county nor corporatioe patronage. Yet we have reaion to believe that many will do themselves tho pleasure-of contributing to ho sustenance ol such a paper, rather than patronize the worthier cheap pa den of other states. ' .
