Under the Preemp tion clause, it will be observed, tne Ctatt in which the lands lie can s.iter them all, or any particular class of them at the graduated prices. arxorsta or the mu Tht irt section provldee that the minimum price of the public landsof the United States shall be reduced alter trie lat of July, 1853, and aold according to the following acale: For lands wbicb shall have been offered at public aale end remain unsold for five yesrs, onr dollar per acre; for landa which have . as i . a i been offered at paoiic saie ana remain unsold ten years, seventy-five ceois an acre; for landa which aball have been offered at publia aale and remain unsold fifteen yeara, fifty centa an acre, for lands which have been offered at public ale, and remain uusold twenty-five cent en acre; and for lande which ahall have been offered at public sale and remain unsold thirty yesrs, twelve and a hah cents an acr; providing that the graduating process, from fifty centa to twenty-five cents an acre, shall not take pine until the landa in the filty cent etas ahall have been exposed to sale for a period of st least two years, at the price of fifty cents per sere, alter which the price of tbe said landa ahall be reduced to twent-five cents per acre. The second aection provides that whenever a State ahali desire to acquire preemption right to all .he lands, or to all the lands of any certain elate and price within ite borders, for other purposes than a railroad or canal, and aignifles the ssmo to the President of the United Stateaby an act of its Legislature, ther shall be granted on the follow ing terma: TbH aaid Slate may fix the r, rice ol said Lode above that prescribed n tbe first section of this set, reserving the excess to itself; provided that the title ahall not pass to the purchaser until he has paid the pri .e fixed in the aaid first section to the United States, and that they shsll be subject to the same legal anbdivision in the sate and survey as are now provided by law; and provided further, that any State which ahall accept the provision of thia act, and ahall preempt any lands under it, ahall take them in full of the five per cent, fund thereafter to become due from the proceeds of said lands. But any State accepting the provisions of this and tbe preceding section shall take the landa at the price fixed for each particular class, and no lands ahall be sold by them for twenty-five cents to acre, until tiey shall have been previously subjsct to entry through a period of two years at the price cf fifty cents per acre, to be paid to the United States. The third section provides that whenever a State shall charter a railroad or canal to run through the land of the United States, and such State shall accept the benefit of the provisions hereinafter prescribed by an act to be passed at a general session of its Legislature vpoi due notice being given of tbe fact to the Secretary of the Jnterio', it shall be his duty to set apart, of the public lands, seven thousand six hundrelaod eighty acres per mile of railroad or canal, within twelve miles on each side, and aa near the route of such railroad or canal aa possible, and the same ahall be withdrawn from aale or entry by public advertisement cf the Secretary of the Interior, except in the manner and fur.n hereinafter prescribed. The fifth section provides that, in the erent of a difference between the 1 stmaster General and the railroad company as to the compensation for carrying the mails, the matter ahall be settled by mutual agreement between the Postmanter-General and the Governor of the State in which such railroad lie. : The sixth section provides that the lands purchased t? any State, under Ihe proviaion ol the third aection of this act, shall be implied by said State for the construction of the railroad or canal lor which - they were reserved; and that no lai ds ahall be included within the opts ration of thia act to which the Indian title has not been extinguished.
