INDIANA SUPREME COURT. Fowler v. Throckmorton. Opinion by Judge Blackford. Held, that under the statute of 1833 suit cannot be sustained upon a usurious contract including the illegal interest. It is void as against law. imtney v. Rightclaim, et al. ludge Sullivan gave the opinion. Held, that a judgement prior in time, has priority in lien over a subsequent judgment at the same term. Barr v. Binford. Judge Sullivan. Held,
that a term for years is such a chattel interest
as may be sold on execution from a justice's Court. Eldon v. IVynn. Ejectment: Blackford Judge. Wynn, a native of England on the 11th of October, 1820, declared his intention to become a citizen of the United States, but did not register in his application, his wife and children. In February 18'21.he purchased the land in controvercy, and died in August 1823, without having been naturalized, having devised the
land to his daughter Isabella, then a member of
his family, though born in England. After her father's death, she married Eldon, and died in September 1830, leaving a son who also died in July 1834. The plaintiffs, John and Joseph Wynn, and James and Isabella Medd. claim the property as heirs of Isabella Eldon. The two first, are her brothers, born in England. John was naturalized in September 1830, and Joseph in October 1836. James and Isabella Medd, were children of Mary, an alien sister of Isabella Eldon, and born in the United States. Isabella Eldon died in possession of the premises.
The Legisiaturein February 1840.passeda spe-
cial act by which Isabella Lldon died seized, was declared to be vested in such of her airs as were by the laws of the State capable of ac
quiring real estate oy descent, in tne same
hats of straw attract the attention of passengers in"the pleasant suburbs of Florence. Her attire is elegant, her expression sweet, and her colour fresh and lucious. In her look one reads affection, as she awaits her lover's or perhaps her husband's return from the city. The picture gives us much pleasnre. No. 8. The Old Knifegrinder, by the same. His study of Natures, appears to us to be very truthful and characteristic." Ci'n. Gaz.
Important application of Mesmerism. The efficacy of this agent in important surgical operations has at last been tested in a case of amputation of the leg, performed last Saturday week by Mr. Ward, surgeon, Ollerton, near Worksop, and w ith the most successful result.
I he patient, a man, naci previously been mesmerised by a gentleman from York, of high
standing m the legal profession, whose human
ity on this occasion entitles him to the highest
credit, ana ne succeeaea in rendering him per
fectly insensible to the pam of perhaps one of
the severest operations to which mankind can be subjected. On being questioned afterwards he stated all the sensation he had was an indistinct recollection of having heard a crash, but he had felt no pain or inconvenience. He was mesmerised, and kept in a state of somnolence during the night, and when roused next morning seemed quite refreshed, and going on very well. At the first dressing he was again mesmerised, and was perfectly unconscious during the course of it, and by the last accounts was going on very favorably. The case has naturally excited ?reat interest in that part of the country, as it has opened tip quite a new era in the medical profession. Sh'jfieldIris.
