title, and interest which the said Henry D Smith had to the following described real es tate, situate, lying and beinn in the county of Franklin, and State aforesaid, to-wit: No. 1. The north east quarter of section seventeen, (IT) town twelve, range twelve, rast2J meridian, IGOacres.in Posey township, Franklin county, and District of Indiana. No. 2. The east half of the north west quar ter of section seventen, ("17) town twelve range twelve, east 2 1 principal meridian, 80 acres, in Posey township, Franklin county, and District aforesaid. No. 3. The west half of the north west quarter of section seventeen (17) town twelve, ransre twelve, east 2d meridian, 80 acres, in Posey township Franklin county, and District aforesaid. No. 4. The south east and southwest quarters of the south east quarter of section 8, town 12 range 12, east 21 meridian, 80 acres, in the rnshiD of Posev, Fianklin county, and Disforesaid. 5. The east half or the north west quarr, ineeasi nan ot me soutn wesi quarter ana the west hair orthe south east quarter of section twelve, town twelve, range twelve, east 2d meiidian, 240 acres, in Posey township, Franklin county, and District aforesaid. No. 6. Lots "number 2, 10, 13, 19,20, in block number sixteen (16) at the town of Laurel, in the township of Posey, and county of Franklin, and District aforesrid. No. 7. Lot No. 13 in blockJNo. 17, of the town of Laurel, Posey township, Franklin county, and District aforesaid. The said Henry D. Smith claims title to No. 1, by a deed in fee of general warrantee, from James Conwell and wife, dated July 30. 1837. This tract is subject to a mortgage given to Francis A. Conwell to secure the payment of five thousand (5.000) dollars, dated August 6. 1841. He also claims title to No. 2, by virtue or a deed in fee of general warrantee from James Conwell, dated July 12, 1837, James Conwell by virtue of a patent from the United States. This lot is subject to a mortgage to the State or Indiana, dated July, 1837, to secure the payment or a bond for four hundred (4,00) dollars, the amount of a loan of a part of the surplus revenue, by said State to said Henry D.Smith; said bond is of even date with the said mortgage, payable 5 years after date, and drawing 9 per cent, interest, payable annually in advance. He claims title to No. 3, by virtue of a certificate from the receiver of the Land Office at rSnr-innnti it-lf.t Tnno Ifi 1 R3fi fnr thf xnnth half thereof and by deed in fee for general) warrantee from John Daniel for the north halj threor. This tract is encumbered as follows: the eouth half theTeof by the mortgage to the State of Indiana mentioned above, given as security for the payment of the said bond to said State, os above mentioned; and the north half thereof is included in the mortgage also mentioned above, given to i rancis A. Uonwell to secure him in the payment of the said sum of S5,000. He also claims title to No. 4, by virtue of a deed in fee of general warrantee from James Conwell, dated July 12, 1837. This tract is encumbered by the above mentioned mortgage to the State or Indiana, to secure the payment of the said bond for 400 making the third and last encumbered in said mortgage. He also claims title to No. 5, by virtue or a deed in fee of general warrantee from Ed.vard R. Records, dated July 19. 1837. This tract is encumbered by a mortgage executed by the said Edward R. Records, dated July 18, 1837, to secure the payment or a bond for the sum of $500, of even date with said mortgage, and payable live years after date, drawing nine per centum intrest per annum, payable annually in advance. He also claims title to No. 6, by virtue of deeds in fees or general warrantee, dated October, 1840, (with the restriction that ardent spirits shall not be made or retailed thereon,) executed by James Conwell, the original proprietor or said town. Lots No. 2, 19, & 20, or this No. are embraced in the aforesaid mortgage to Francis A. Conwell, to secure the payment of the said sum of S5.O00, dated August 6, 1841. Lot No. 13 of this No. is encumbered by a title bond for a deed to Isaac York, executed by Henry D. Smith. The consideration of which was the execution by said York of a deed in fee to certain lands, which stipulation the said York has wholly failed to perform. He also claims title to No. 7 by virtue of a deed in fee of general warrantee from James Conwell, dated October, 1840. This number is encumbered by a title bond for a deed exe cuted February 12, 1839, by the said Henry D. Smith to Thomas E. Wilson of Rush county, Indiana, the consideration for which is 300, of which 89 50 have been paid to the said Henry D. Smith. Further, all the foregoing lands are subject to a lien in favor of those creditors who have obtained judgment on their claims against the said Henry D. Smith. C. F. CLARKSON, Assignee. Dec.5, 1842.
