From the JS'eviark Daily Advertiser. Important Decision concerning Promissory JVbies. At the late term of the Supreme Court of New-Jersey, nn important decision was made, in the case of Brittin vs. Freeman, affecting usurious translations with promissory notes, and the admissibility of endorsers a witnesses. As this decision is of importance to the public, we hare obtained the following summary of the points decided for publication. It was decided 1st. That the endorser of a nte, o.- other negotiable instrument, in a suit between other parties thereto, is n competent witness to prove, that the instrument, or the endorsement thereof, was made on an usurious or other corrupt or unlawful agreement; or to prove any other matter tending to defeat the plaintiff's recovery. And, 2J. That if the holJer of a promissory note, valid in its creation between the original parties, endorsed it to another by a general endorsement, for a less sum than the amount due upon it, after deducting legal interest, the transaction will be Usurious, unless the excess retained by the endorser was allowed to him to cover the expense of remittance of the difference of exchange between the place of the transaction and the place where the note is payable; but such allowance most not he used as n mere cover for taking more than legal interest. 3d. That such usurious endorsee cannot re cover upon the note against his immediate endorser,nor against any prior party to the note. 4th. That if the holder of a note transfers it by del:ery, or by endorsement without re course to him, it is a sale and not a discount of the note, and consequently not usurious, though the vender gets for it much less than it is actually worth provided such transaction was not resorted to for the purpose of effecting a loan at a grater iaterets than is allowed !v law. The Collector of JVea-Yark. A paraeranl has been going the rounds in the newspapers, i.u we punnsnea it in our last, slating that the Collector of New-York realized the sum oTone hundred thousand dollars as fees this year. We understand Mr. Hoi t will make a great turn, but not as "fee of office." The laws of the United States give half the property seized and conJemned for a breach of the revenue laws, to the informer who discovered the fault. Mr.' Hoy t was in several istances himself the discoverer, and consequently the informer, and is therefore entitled to the reward. He has saved the Government about half a million of dollars which would have been lost, and he is by laic ih u remu teratned. This is one of those "God sends" that a man tel loin ever meets with more than once in his life. If there is any thing in the world that will make a man feel bad, except pinching his fingers in the crack of the door, it is unquestionably a quarrel. We ascended this celebrated hill, and stood on the temples which rose from every section of the city, and towered proudly on the acropoli?, made this celebrated speech: "Ye men of Athens, 1 see that in all things ye are too superstitious." The ruins of the very temples to which l.e pointed wrre before our eyes. Seven's Russian and Turkish Empires. Marriage in Haste. On Sunday, the 2'2d instant, there was seen rushing through Pennsylvania Avenue, Washington City, a vehicular conveyance that contained two ladies and two gentlemen. One of the ladies looked anxious and confused ; the other had her face glowing w ith a mischievous smile, expressive of the success of some notable scheme. One of the genllen c:i looked as though he had drawn a pizie in the lottery, the brow of the other was clouded with peiplexilies of a charge d'affaires to the court of Hymen. The carriage stopped at a respectable distance from the residence of a minister of the gospel, and the ladies and gentlemen alighted and proceeded to see the pastor. After a time had elapsed sufficient to tic the Gordian knot, they sallied forth with a smile of satisfaction beaming on ench countenance, and to cool their pertubed .spirits, they took a stroll towards the Capitol. The bride was a young lady of fifteen, the groom not out of his teens; and they looked like a charming pair. The bridesmaid and groomsman followed after, looking as pleas-! ed as though they had escaped from air earthquake. They sauntered along mute, -. t . wan unioio uappincss, ana were about entering the capitol gate, w hen the bride's papa and her brother, who were laying in ambush, seized the lady and her attendants, and carried them to a carriage. The groom attempted a rescue, but he was knocked down, and his bride was spirited nway before he recovered from the shock. She and her fair companion weie conducted, in the safe keeping of father and binther, to Alelandria. Wether the affair will result in a reconciliation or an appeal to the laws, our informant saith not; certain it is that the elopement was successful so far as ty ing the knot is concerned. Bal.imore Sun. A VAST ESTATE AN1 WOXDUrJCS STOUT. The Cincinnati Gazelle supplies us with a condensed statement of particulars connected with a law suit whi h is to be tried at New Orleans during the ensuing winter, in nhich Major General Gaines, who bus recently married a second wife, lays claim, in her right, to an estate now estimated to be worth Izcrlvr millions of dollars. Mrs. Gaines claims to be the legitimate daughter of the late Daniel Clark. Mr. Clark settled in N. Orleans, under the dominion of Spain, and became an extensive merchant and speculator, besides distinguish ing himself as a politician. He died in 1813, and Mr. Kelt, of the mercantile firm of Clark & Relf, of N. Orleans, took imme diate possession cf his immense estates, un der a will executed in ISll. From that period to the present, Mr. Keif has controled, conducted nnd disposed of Mr. Clark's estate without accountability to anyone. Mrs. Gaines claims as Mr' Clark's daughter. Her 6fory is a romantic one. In lS02or 1S03, Mr. Clark married in N. Orleans a lady, scpera'.cd from her husbanJ. The seperation had taken place in consequence of proofs that he had n previous living wife but before these proofs were effectiualy obtained. Upon this account the marriage was kept private. Mrs. Gaines was born of this marriage, and named Myra. Disagreements arose between Mr. Clark and his wife which resulted in a final sepera'ion, in the year IS07, no public acknowledgment ol the marriasre having taken nlarr. It would seem, if aiy dependence can be placed upon rumors and roports, that the civil war which has so long distressed and desola ted fepnin, is about to be brought to a close. Don Carlos, who has for so many years contended for the crown, appears to have become too far enfeebled and exhausted to car-; ry on the contest any longer, and I is troops, having been beaten by the Queen's forces, seemed to be resolved to abandon his cause. land either retire from the field, or go over to their lawlul sovereign. Ave presume the strength of the hierarchy has been exerted on his part, he being, professedly at least, a truer devotee of the church than the Queen was supposed lo be. Although the country lms been wasted and impoverished, and a vast many lives have been sacrificed, the controversy will not have been terminated without the production of some benefit to the nation. The power nnd influence of popery has been greatly weakened, the inquisition can never be revived, convents cannot be reinstated, and ecclesiastical tyranny and despotism are, to a great extent, destroyed. There is probably no finer country in Europe than Spain; and under a liberal system of constitutional government, it would speedily iccover from the evils it has heretofore labored under, and in a short time become flourishing and prosperous. The papal yo!;c has impoverished and degraded Spain, as it has every country where it has been worn. Freed from the inquisition and the monastic iistiluliois, as fortunately n large part of Catholic Europe now is, the : introduction of sc hools, and the general diffu sion of knowledge, will soon c hange the as pect of the countries which have been held in bondage to the Iloman Pontiff. and elevate the character of the great body of the people; who, finding themselves eecurc against hie rarchical oppression and extortion, will become industrious and intelligent, and will maintain their proper influence in the ailYiis of the nations. Simple Remedy to purify Water. It is not so generally known as it ought to be, that pounded alum possesses the property of purifying water. A large table spoonfull of pulverised alum, sprinkled into a hogshead cf water (the water stirred round at the time,) will, alter a lapse of a few hours, by precipitating to the bottom the impure pa'rlic les, so purify it that it will be found to possess nearly all :he freshness and clearness of the finest spring water. A pailful, containing four gallons, may be purified by a single te.pooiful. A British captain aVthe battle of the Nile, was g'mng orders on his vessel, when a shot struck him in the head, depriving him instantaneously of sense of speech. Living, however, he was tken home and remained in the Greenwich Hospital fifieen months. At the end of that n -riofi. during which he had cxhibctcd no signs of intelligence, an operation was performed upon him by a skillful surgeon, that nj m micnt restored him to his faculties. He immediately rose in his bed, and completed ihe. order. A Fish Stoy. On a passage, some time since, to Jamaica, w ith troops on board, a lad, who was a fifcr, setting on the gunwale, by a sudden roll of the ship, fell overboard, and was directly swallowed by a shark. A hook w as immediately bailed with a piece of beef, and thrown over the stern, which was seized by the shark, and the fish was presently ha-il-e:l on board.
