They failed in this attempt, as the wind blew from the north. We succeeded in getting canvass upon hert and after receiving a good pelting from stones, we made out to get out ofthe way. The wind was very light, and soon We discovered a boat limited with men coming oftit after the schooner. FIFTH DISTRICT. We regret lo see the name of Gen. Jonathan McCarty, announced in the last Ccnnersville Watchman as a candidate for Congress in the 5th District. Messrs. Ray an J Rariden have hcretofoia been announced; and it is in contemplation lo hold convention to'decide upon the candidate of the Whigs. It is said and believed that Gen. McCarty will not submit to the voice of the people expressed through a convention-, which will, at least, greatly endanger the election of a -Wliig. Although the fifth is Uic most decidedly Whig district in the state, it is not enough so for two WSig candid ites to- run with impunity. At the last Presidential election Gen. Harrison received 7,273 votes, and Van Uurcn MICK .One half of the whig vote is 3.63G, about 500 less than the Van Buren vote. - If Gen. McCarty will not submit his claims to a convention, h cannot be elected; and the success of either Mr. -Rnrideji or Mr. Ray, will be plated in imminent danger. We hope our friends in that District, than whom Whigs of a mote undincluug nature cannot be found in the state, will merge all personal partialities in an ardent desire to promote the cause of true Democracy and republicanism, and ma consequent happmese and prosperity of tut; luuim i. inuiana journal. . The opinion was brief, considering the mas or testimony, and the length of argument submitted by the counFcl, stating for the most part, merely the conclusions to which the Court had arrived, without going into the reasons leading to such conelusions. It decided that the 'excindin res-oItttions,'-asthcy are cnlled,passed bv the general assembly of IS37, were not only constitutional, but also just; that they were not to he considered Uiibe aspect of a judicial sentence, but as a legislative act; that they did nothing more than dissolve the four eyaods, fvhich it was conceded the assembly had a right to do; that the act being within the power of that body, it reasons for performing it noujd not be reviewed bv a civil tribunal; &, as the eonsequenec of all this, that the persons claiming to be commissioners from presbyteries within the cxifided jynodav to the nssembtj of 1839; had ao color of right to seat ' in that body. l urther, the court decided, that while on these J X School had been unjustifiable, they had keen io themselves entirely irrccular aVlt ts .a . .
