SUSTAINED BY THE COURT
The Ttia^sraryLo'n Act Hi Id to ba C«ristitutional.
The last of the coiisti tutional case* which have been recently brought before the Supreme Court was disposed of Friday in an opinion reversing the decision of Judge Howland and holding that the act authorising the temporary loan of $1,4(10,000 is unconstitutional. The opinion of tho court was written by Judge Mitchell, all Ihe Judge# concuricg. It is not unusually long, but it ia
much involved that it is inseparable. The consuiation over the opinion lasted until a short time before the cases we^e handed down to the Clerk this afternoon at 2 o'clock. The opinion denies the power of the Legislature to borrow money for any purpose other than to supply a casual deficit or for some of the other purposes specifically enumerated, and also denies that the Legislature has any general power to incur a debt on behalf of the State. A casual deficit is held to beone not designedly
created, and it is said in snbsiance that the Legislature can not purposely create a deficit and borrow money to supply a deficiency
BO
created. It* further heid
tnat tbe court ia bound to presume that the Legislature, acting upon the information communicated to it by tbe Governor and the Auditor of State, correctly decided that there was a casual deficit within the meaning of the constitution.

Scarct has a new invention been annoan id before a host of imitations spring 1 on every side.
No hi, tier encomium can be paid the inventoior discoverer than to encounter imitatioi, notwithstanding such flattery is not atieptabie.
Insone cases successful imitation is rendered impossible, inasmuch as the iinitatorls unable to lend a complete knowledge to the subject or ha3 not the means aiihand to aid him.
Perhajs no article has been th© object of attempted imitation more than the worlowide specific for tlie prevention and aire of kidney and liver disorders, faniliarly known as Warner's Safe Cure'
In the reparation of this intensely popular ronedial agent,it is claimed that
cure, evtn if the correct formula is known, lecause the peculiar devices and highly expensive mechanism used in its manufacture are beyond the reach of ihe would-be imitator.
Addinc to this the lack of a long experience. which has rendered perfect every step in its preparation which inventive genius can suggest, together with thegreat skill exercised in the selection cf only the very best materials, the geniune article is perfection itself.
Some effort is a^o being made to imitate a popular line of old-fashioned log cabin "Iwine cures'' known as "Warner's Log Cabin" remetii^F, comprising a sarsaparilla for tho blood, ps and buchu lor the Etomach and system, cough remedy for coidd, rose cream for catarrh, extract for relief from pain, hair tonii% porous plasters and pills.
Successful imitation is rendered impossible for the reason that the same care has been given in their preparation.
An expensive laboratory, costing thousands of dollars, has been specially constructed for their manufacture and ia under the immediate supervision of the best chemists known.
Poor material and means employed would be susceptible to easy imitation, but with the best of material, machinery and skilled labor employed, these household articles are given to the public beyond the reach of all successful counterfeiters.
