act uneonstitunonsi and vcid is a unttnILUOUS one, alt the judges concuring. It was written by Chief-justice Elliott and is an elaborate one, covering thirty-.six pages of closely written matter. Assuming the statements ol the respondents to be true, that the court needs more assistant, it sites authorities to .show that the judicial departmentoi' the State government is an independent one and being independent it must cnoose its own assistants. Such had been the practice from the time

ol

Queen Eliza

beth in the Engiibh courtrj, in the federal courts and i.a the courts of this State. The claim that the officers proposed to be created are analogous to master commissioners or commissioners in chancerj* is denied.

Tim bill, although obscure, the opinion continues, docs nor propose to create myre assistants, out does assume to create judicial ofiicevs and a tribunal unknown to the Constitution. Authorities arc cited to show that the whole judicial power of the Stare is vested in courts composed of judges, and that i./.n:y fcuuh judges can exercise its judical powers, ijr.eh powers can nc hdelegated. A deputy judge is an cillcei unheard of in jurisprudence, and unknown to the Com.Tilution. Thcsptchlc duty of dccidi.'-.g every queM.mii a:i»h-g directly is imposed unon. the t: .ur'. am: this is imperative, this c'ulv net delegated to other persoiis. Tne people have a right to coaetitutinr. -.'! courls, and this right can not be taken away.

The decision of the court which he that the Legislature has a right t.» appoint the trustees of the insane Hospital is likewise a volumumu:-* document, »h'-

Judge Coffey in his opinion holds hat the duty conferred by the Constitution on the General Assembly to provide for the benevolent institutions dots no- carry with it the power to appoint officers to manage huch trusts. Certainly no such power is expressed, and it it exitt-i it must be by implication. An appointment hy the Legislature to an oihee not connected with the discharge of its duties as a legislative body, involves the exereife ox executive power or administrative -junctions. By Section 1, Article 3, oi the Constitution, it is rohibited from exercising such fttnetmn.'i uiilef-s the power to tlo so is ex-pjvs.-dy conferred upon it by the Condilution. Yet how nanv are dishonest through ignorance, expediency, or intentionally. One can be,dishonest and vet sav noth--'•W'i,-?-.

A clerk who lets.-, a customer buy a damaged piece of goods, a witness who holds back the truth which would clear a prisoner, a medical practitioner who takes his patient's money when knows he is doing him no .good,— all arc culpably dishonest.

Speaking of the dishonesty of medical men reminds us that only the past

week there has come under our peraoiuti observation a form of dishonesty which is almost too mean for narration.

It is generally known that doctor bind, tnemselves by codes, resolutions and oaths not to use any advertised medicines. Now, there is a 'medicine on the market which, ior the past ten 3"ear -, has accomplished a marvelous amount of good in the cure of Kidney and Liver diseases, and diseases arising from the derangement of these great organs,—we refer to Warner's Safe Cure, So widespread are the merits of this medicine that the majority oi the doctors ol this country know from actual evidence that it will cure Advanced Kidney Pisease, which is but another name for Bright's Disease.

The medical profession have put themselves on record as admitting that there is no cure lor this terrible malady, yet there are physicians base enough to procure Warncr'ci Safe Cure iu a surreptitious manner, put the same into ph-un, four-ounce vial.?, and charge their juiticntsliJ.OO per via!, when a sixteenounce bottle of the remedy, iu its original package, can be boncht at any drug store in the world for §1.25. i't! i.aps the doctor argues that the euro oi the patient justifies his dishonesty. yet he will boldly stand up at the uex: county medical meeting and denounce Warner's Safe Care as a patent tyf dicir.e. and one v. Yleb he cannot and wii! not nee.

The fact is that the people are waking up to the truth !ha':-he medical profefr-&-ion is far from honest. a:id that it doer, not pos ess a
