That the constitutional right of the initiative and referendum should in nowise he abridged is the burdeu of the contention of the Michigan supreme court in deciding that the so-called anti-parochial school amendment to the state constitution shall go on the ballot at the November election. The state supreme court thus voids legislation which would hare pre

vented any future attempt to influence the existence of parochial and private elementary schools through use of the initiative. After Michigan's first vote on this

was informed that they had got the law passed which now has been declared unconstitutional. Opposition Organizes Michigan has been a proving ground for parochial school defense tactics. Had the Michigan legisla

tion thrown insurmountable obstacles in front of circulation of petitions for a vote on parochial schools been allowed to stand, it would have furnished a pattern for use wherever else parochial schools were similarly threatened. The case is one in which James Hamilton, of Detroit, president of the Michigan Public School Defense League, was asking a mandamus directing the secretary of state to certify the proposed amendment to the election commission. The secretary of state had refused on the ground that the proposed amendment was in contravention of the constitution

of the United States and of act 204 of the state laws of 1923, and that the names on the petition were not submitted at one time. Court's Decision Concerning the question of contravening the constitution ofrhe United States, the court said, quoting from a former decision: " "If the defendant in case may I decide whether the proposed amendment is constitutional and thus refuse to submit it, may he not, in

! iny case in which it is his judgment iiiat the proposed amendment is un- . constitutional, decline to submit it? I h' he may exercise this power is he :iot going further than his duties as ! a ministerial officer authorize him to go? If the proposed amendment should receive a majority of the legal

votes cast, there is then time enough to inquire whether any provision ol the federal constitution has been violated. Until that time comes we must decline to express any opinion as to the unconstitutionality of the proposed amendment.

long demonstration on opening day

when Senator Harrison, in his keynote speech, first mentioned the

name of the deceased President,

Woodrow Wilson. The cheering and marching delegates went around the

big arena several times during the

demonstration, which lasted fifteen

or twenty minutes.

WASHINGTON, June 28. The special naval board which has been investigating the proposed removal of the post-graduate school from Annapolis has submitted a report recommending that the institution be maintained there. Secretary Wilbur has taken the report under advisement.

City is a funny place in which

Democratic party before this one for over fifty years. Judging from what

has happened here at this cwnven

tion, It will be fully another fifty years before the party will return here for another such convention. And there's a reason.

The writer was present at a meeting of the Democratic national committee, held in Washington last January, and heard New York speakers tell the committee what fair-minded newspapers this city possessed and how all candidates would receive

equal attention and get the same fair treatment. The facts in the case have not borne out this prediction. Pnpers Unfair Never, in the last twenty-five years at least, has a convention city through its newspapers, been any more unfair than has New York. Everything here has been for Al Smith, and the uncalled for and untruthful things said about a candidate other than Smith was never more apparent. The New York pa

pers, practically all of them, have been, more unfair tords the can-' didacy of Mr. McAdoo than all others put together. They certainly have not given the California candidate the fair treatment that the city's representatives promised at the Washington meeting of the committee. All delegates and alternates, to say nothing of the thousands of visitors, have noticed this and commented on it. Mr. McAdoo has never, up to this moment, had a fair deal in the New York papers. On the contrary, they have misrepresented him on every hand. Even when he

got a demonstration in the convene

All doors to Madison Square Garden were thrown widn onen at the r'crht moment and thousands of Smith rooters were almost rushed into the arena to pnt a ston to the McAdoo demonstration. That's

what New York calls impartial and fair treatment. The convention

"Show this administration an oil well and jj: will show you a foreign policy." One of Senator Pat Harrison's party jibes that brought great applause.

"The Democratic party will have neither pets nor puppets to protect nor corrupt cabinet members to coddle," was one of the promises that Senator Pat Harrison made for his party in his keynote address.

Madison Square Garden is likened to the world's largest fireless cooker. The heat was stifling in the big hall even before one orator had spoken.

"This is a Democratic year," said Senator Harrison, and his words found echo throughout the va'st audience. "Nominate any good Democrat and we will win." This touched a popular chord and the great throng cheered him time and again. That even made all the candidates say "Amen."

Klux Klansmen in the city of Charleston came Sunday night when

a number of Klansmen, in regalia, solemnly filed into the Spring Street Methodist Church and made their way to the altar, where they presented to the Rev. J. H. Danner,

pastor, an envelope containing a let

ter and a $100 bill.

News of the presentation had evi

dently spread, as the church was

filled to capacity, many persons crowding the aisles and blocking the

passageways.
