The acquittal ot Samuel Evans, alleged Klansman, at Ebensburg, Pa., af few days ago, charged with murder in connection with the Lilly riot, is a great victory for the organization for truth and righteousness. Statements from one present at the trial are as follows: The case of Samuel Evans went to trial June 13, petitions were presented asking for severance, which were granted. Selection of jurors began at 9:50 a. m.; jury completed at 2:33 p. m.; first venire exhausted
before noon; state closed it3 case at 11:58 a. m., June 14. Defense began at 1:45 p. m., June 14, and closed at 4:22 p. m., case going to the jury without argument; jury left box at 5:04 p. m., and gave its verdict of "not guilty" at 6:51 p. m. Judge Finletter in his charge, to the jury, in referring to the Ilan,
made the statement that they had gone to Lilly. In a Catholic com
munity, deliberately "to wave a red flag in the face of the bull and that they expected to be gored"; further, he asserted, that the fiery cross was an emblem of "war" and the "robe" was to strike "terror" to all those whom the Klan opposed, as it had been used to terrorize the negro in the South, following the Civil war. Falls In Explanation In denning "riot," "affray" and "unlawful assembly" to the jury, he particularly refrained from explaining to them that there was no difference in the penalty for the three charges, although he could not help knowing that the last assembly had
not enacted a new law changing or graduating the penalties. When the

that they had all believed that
"affray and unlawful assembly" car
ried a much lighter penalty than
"riot," and that the two charges car
ried a nominal fine and short im
prisonment.
Judge Finletter was in frequent consultation with Judge Evans and
the district attorney, following the giving of the murder case to the jury. Following this conference the
judge stated to the defense attorneys
i that "If they would withdraw their
motion for new trial" that the dis
trict attorney would nol pros the
murder charges, that he would not
under any circumstances grant bail and that he would Impose the max
imum sentenco of two years on all
the defendants on the charges of
"affray and unlawful assembly." Very Much Disappointed
The; district attorney is said to b
very much disappoints.! at the verdict in the Evans case as he believed it was the strongest he had. Immediately fallowing the verdict he refused to talk with the Klan attorneys but did not hesitate to talk with the attorneys for the Lilly defendants, it is said.

(Bureau Publication and Education) WASHINGTON, D. C, June 24. Scott Woodward, of Fort Worth, Texas, one of the two attorneys who has been trying his worst to unseat Senator Mayfield, of Texas, for the
last six months, has been sued by the Western Union Telegraph Company for the -recovery of $1,800, money paid to him which the company alleged did not belong to him Suit was filed in the District of Columbia Supreme Court, on June 14 for this amount, together with all costs and interest since June 5, 1924. Attorney Paul E. Lesh, of Wash
ington, representing the telegraph company, says that an agent of the telegraph company, at Breckenridge, Texas,' on June 5 received $200 for telegraph transmission to Mr. Wood
ward, who has been staying at the
Shoreham hotel in this city. Money
is transmitted by wire in code and Lesh says the WTong word was used which indicated that the telegraph
company made the mistake and in
stead of paying Woodward $200 he
was given $2,000.
Mistake Is Discovered The mistake was discovered by the
company the next day, June 6, and demand was made on Wood-ward for the return of the $L800. One of the company's officials then talked with Woodward about the matter on June
7, and Woodward said he had been expecting funds from Texas and that
he had presumed the amount he re
ceived was correct. He said he had
used the money and could not return it that day. He promised that the matter would be straightened up by June 10. This was not done- and the
telegraph company filed suit on June
14, acting on instructions from headquarters in New York, which decided to take no chances because Woodward is a transient in Washington. Scott Woodward is one of the two men who have been in Washington since last November actively engaged in the Peddy-Mayfleld senatorial election case. He has been asso
ciated with Luther Nickefs, trying
in every way to embarrass and
handicap Senator Mayfield in his
senatorial duties. Criminal Action Possible
The case as far as it has gone Is
only a civil action. When, asked if the matter did not border on criminal action, Attorney Lesh says that depends on whether Woodward pays
back the money as demanded and
whether or not he kept the money
with a gntlty knowledge that he re

(Special to The Fiery Cross) CINCINNATI. Ohio, June 24. The old order of things here in Hamilton county of packing juries, school boards and the like, to say nothing of public schools, with non-Protes
tants of a most pronounced type, is slowly changing as the Klan spirit and sentiment is forging to the front in all affairs, public and private. There was a time in Hamilton county when only non-Protestants were wanted on juries, school boards of ublic schools, with non-Protes-tion at Schnectady, New York, Pittsand in the public schools, but the Klan mind has been working here and is snaking considerable inroads on public attention. Nowadays the
change seems to be for the better and on the merit system and not on the private religious affiliation or pull that was so manifest In the past. There is a growing sentiment everywhere for all-American, Protestant school teachers, especially in
the public schools of our land. And why not? The non-Protestant school teacher has his or her opportunity in the private and parochial schools of the country; therefore, it is only right and fair that our boy3 and girls who attend the public schools
should be taught, tutored, educated
in an ail-American way by real American, Protestant, school- teach
ers. All honor and praise to the superintendent and principal who has the nerve to insist on such teachers from the school boards of the
country.

five-year 5 per cent secured notes
due July 1, 1929, and have placed
them privately with investors at 99 and interest, to yield about 5.25 per
cent. The terms of the issue provide for the pledge of $15,000,000 first and refunding mortgages 4s as security for the loan with 20 per cent margin to be maintained. Proceeds of the issue are to.be used to redeem $8,000,000 of the company's 6 per cent notes given to .the director general for general additions and betterments and for other corporate purposes.
