Hauswirth, 40 years old, of Hazel Hill, pleaded guilty yesterday before Circuit Judge McElhlnney at Clayton, to a charge of manslaughter, in connection with the death of Fred Merlons. 86. a retired farmer of Overland, who was injured by Hauswirth's automobile on October 18, 1922. Which -was a county, waajruled by a "Grand Giant" and four "Goblins;" the smallest unit of said organization was a "Den" or community organization, of which at times there were several in each county, each "Den" being under what were called a "Grand Cyclops" and two "Nighthawks;" the said "Genii," "Hydas " "Furies" and "Nighthawks" 'were staff officers. The private members of said organization were, called "Ghouls;" this order and organization was collectively called "The Invisible Empire of the Ku Klux Klan;?' the alleged objects of this order were substantially similar to those set forth as aforesaid as the purposes of defendant's said order, and were embodied in what was called a "Prescript," and were to protect the weak, Innocent and defenseless against Indignities, wrongs and outrages of the lawless, the brutal and the violent; to relieve the oppressed; to succor the suffering and unfortunate; to 'protect and defend the Constitution of the United States and all laws passed in conformity thereto, and to protect the States and the people from all Invasion from any sourcse whatever; that said alleged purpose of protecting the Constitution of the United States and all laws passed pursuant thereto: that pursuant, to
hthe actual purposes of said conspir acy tne memo era of said organization banded together under military rules and regulations for the said purpose of rendering nugatory the said amendments to the Constitution of the United States, and the said laws passed pursuant thereto, and in carrying out the purposes of this conspiracy brought about a condition of affairs in the states of Mississippi, North Carolina, South Carolina and Tennessee which amounted to an incipient insurrection against the government of the United States; that for the purpose of meeting this situation the Congress of the United States passed certain Innroamong which is what is now known as section nineteen of the Federal criminal code, commonly known as the Ku Klux Klan Act; these laws gave the president of the United States power to declare a state of war whenever he considered it necessary. lowing its organization several thousand arrests of its members were made and 1,260 thereof were .convicted of crimes in the states of Mississippi, North Carolina, South Carolina and Tennessee. Some of the cases growing out of said convictions were appealed to the Supreme Court of the United States and that court In the case of "Ex parte, Yarbrough," 110 U. S. 651, sustained these convictions. Plaintiffs further aver that as a result of the foregoing and pleaded facts, to be considered a member of an organization whose avowed purpose is to extol, praise and sanctify those guilty of the criminal acts alleged, would cause such persons to fall into disrepute with all honest, well-intentioned, patriotic citizens of the United States, and cause them to be treated by those citizens with contempt, loathing and aversion and would cause such citizens to withdraw their patronage, trade' and financial support from them, and, as aresult, to work irreparable injury to such persons in their business, occupation, profession or calling. Plaintiffs further aver that for the purpose of carrying outvthe said conspiracy the said defendant and the said other persons whose names are unknown, after its organization in July, 1916, as aforesaid, caused and are now causing all persons who join said conspiracy and enter said defendant's organization, to sign the following application: "To His Majesty, the Imperial Wizard, Emperor of the . FORMER JfflUONAM DDES IN POORHOUSE TAUNTON. Mass., Oct 13. William D. Marvel, once a millionaire mine owner and politician, in New York City, died here lately in the city almshouse, to which he was admitted five years ago. He returned to Taunton, his birthplace, about twenty years ago after failing in a series of suits to recover $3,500,000 from mining deals. Marvel at one time was a member of the New York City Board of Transportation, and occupied sumptuous offices in the old Trinity Building, where, according to stories he later told, prominent politicians used to meet to decide public issues.
