BREWER ACQUITTED OF MANSLAUGHTER CHARGE
After Being Out All Night Jury Frees Man Who Killed Kell Boy. Friday morning, after being out all night, the jury brought in a verdict of acquittal for George Brewer. Brewer, who lives at Morocco, some time ago ran down and killed Elmer Kell, of Beaver City, while driving through the streets of that town at a high rate of speed in his automobile. Brewer was arrested' on a grand jury indictment charging involuntary manslaughter and the case was tried this week at Kentland before Special Judge McCray, of Indianapolis. W. H. Parkinson, of Rensselaer, and T. B. Cunningham, of Kentland, were Brewer’s attorneys and the state was represented by Prosecuting Attorney Longwell, Judge Darroch and Frank Ross. The sentiment was very much against Brewer at Beaver City and he had an uphill fight to avoid conviction, which would have meant a sentence of from 2 to 14 years in the penitentiary. After balloting the greater part of the night the jury decided to take a rest until after breakfast the next morning, when the final ball"* acquitting Brewer was tak-u. The first seven ballots stood 6 to 6. The eighth ballot stood 8 for acquittal to 4 for conviction. The next stood 10 to 2 and the next 11 to 1, when the jury decided to quit balloting until morning, when two ballots were required to decide the case. The trial lasted three days and was a hard fought battle on both sides.
